The author had then been for twenty years in the active practice of the legal profession, and continued in it for some time afterwards. In his earlier years at the bar he was more often engaged in suing than in defending railroad companies; in the later years more in counselling and defending them than in suing them. Since 1876, also, he has taught Railroad Law, at some length, to the third-year class in the Yale Law School. He has therefore studied the subject enough to have some appreciation of its difficulties. Part of these, it has seemed to him, have been due to the inclusion in treatises upon it of much that is not peculiar to railroads. His attempt has been to limit his work to what is peculiar to them, so far as this was possible without sacrifice of order or danger of obscurity. Upon the same day, yet no fires had been communicated other than these upon this day from this engine that engines in good order, and carefully managed, seldom communicated. Fire to the adjacent grass and stubble and where it appeared that something was seen to be thrown out of the smoke-stack, and fall into the neighboring stubble, and almost immediately the stubble was in a blaze, and thereafter a piece of coal was found surrounded by ashes in the stubble, and apparently the remnant of a piece of coal six inches in diameter, which had been there burning; and where the conductor of the train, at the first station after pass ing these fires, telegraphed to the assistant superintendent of the road, that the en gine was setting the country on fire and where it appeared from the testimony of experts that where an engine starts a suc cession of fires, and others operated along the same road under similar circumstances of wind and weather do not start any, the difference can be reasonably accounted for only upon the supposition of defects in the construction, condition, or management of the engine doing the damage, it was held that a verdict finding negligence would be sustained, although several competent wit nesses who examined the engine at and shortly after the fire testified, that it was in perfect order, and supplied with the best appliances for preventing the escape of fire, and that the engineer was compe tent and careful, and he testified that he used all possible care and precautions to prevent the escape of sparks and fire upon that day; and although there was no direct testimony contradicting these witnesses, and that it was impossible for any one from the testimony to point out in what respect, if at all, the engine was defective, or out of order, or the engineer guilty of negligence. Book excerpt: Excerpt from The Railroads and the Courts Out of a total of seventeen judgments rendered by the circuit courts against the four leading railroad companies of this state, in actions which came before the supreme court for review during a period of eleven years, (from June, 1873, to June, 1884), and which were brought for killing or injuring persons, or injuring property, at railroad crossings, sixteen were reversed and but one was affirmed, and that one was affirmed by a divided court, after two prior judgments in the same case had been reversed by the supreme court. Out of a total of twenty-seven judgments rendered by the circuit courts against the same companies, in actions which came before the supreme court for review during the same period, and which were brought for injuries resulting in death, twenty-four were reversed and but three affirmed, one of which was the judgment above mentioned, affirmed by a divided court after two prior reversals. Out of a total of sixty-three judgments rendered by the circuit courts against the same companies, in cases which involved the question of negligence, and were tried by jury, and which came before the supreme court for review during the same period, fifty-three were reversed and but ten affirmed, five of which were affirmed upon the first trials, and the other five upon the second or third trials.
