Book excerpt: During the formative classical period of Islamic jurisprudence, wellknown scholars possessed not only the intellectual skills required for analytic reasoning, but also a broad general knowledge of the fi elds relevant to the cultural contexts in which they issued their edicts. A viable fatwa requires knowledge of the Shari‘ah as well as local customs, cultural realities, individual and communal implications, and related matters. The original juristic tradition was formulated and fi xed during the fi rst three Islamic centuries, a time of widespread sociopolitical turmoil. Of course, the jurists’ legal outlooks and thinking processes could not have escaped this reality. While Muslims of the prophetic and rāshidūn periods adhered closely to the authentic texts due to their sincerity, piety, prophetic training, and proximity to the revelation, the changing environment in which their descendants functioned gradually started to impact how the authentic texts were understood, interpreted, paraphrased, and implemented. Both the Muslim and the non-Muslim worlds have drastically changed since that time. The new geopolitical and scientifi c realities of our rapidly changing world demand a fresh look at some aspects of the established juristic tradition. The way forward involves a systematic fresh look at and reevaluation of the old fatwas, as well as the issuance of new ones with a maqāsidī outlook that can deal successfully with today’s ever-changing global realities. In this edited volume, papers on fatwa and iftā’ point to an approach that is both rooted in the Islamic legacy and committed to meeting the challenges of the modern world.

Unlike other studies dealing with the so-called ‘Formative Period’, this book focuses on the extant writings of early mystics rather than on the later Ṣūfī compilations. These early mystics articulated what would become a hallmark of Islamic mysticism: a system built around the psychological tension between the self (nafs) and the heart (qalb) and how to overcome it. Through their writings, already at this early phase, the versatility, fluidity and maturity of Islamic mysticism become apparent. This exploration thus reveals that mysticism in Islam emerged earlier than customarily acknowledged, long before Islamic mysticism became generically known as Ṣūfism. The central figure of this book is al-Ḥakīm al-Tirmidhī, whose teaching and inner world focus on themes such as polarity, the training of the self, the opening of the heart, the Friends of God (al-awliyāʾ), dreams and visions, divine language, mystical exegesis and more. This book thus offers a fuller picture than hitherto presented of the versatility of themes, processes, images, practices, terminology and thought models during this early period. Book excerpt: One of the so-called ecstatic (or intoxicated) Sufis of Baghdad, Abū Ḥusayn al-Nūrī (d. 907/8) was famous for his quasi-blasphemous utterances and shocking public behavior. He was often enraptured by a passionate love of God that led him to eccentric acts that scandalized both ordinary people and the religious authorities. Besides yielding to divine love and beauty, he would occasionally come near succumbing to bodily temptations and carnal passions. Despite Nūrī’s outrageous behavior, Junayd, the moderate or sober Sufi par excellence, held him in high esteem, kept corresponding with him, and commented upon his controversial ecstatic sayings. This book collects Nūrī’s literary legacy by surveying the sources for his life—poems, sayings, and comments on the Quran, including an exchange of letters between him and Junayd preserved in the Cairo Genizah—and by discussing the authorship of the Stations of the Hearts, which has been widely attributed to Nūrī.
