Book excerpt: Excerpt from Legal Essays At the time of his death Professor Thayer was actively at work on a second volume on Evidence. This, as he said in the introduction to his "Preliminary Treatise on Evidence at the Common Law," was to be similar in form to the Preliminary Treatise, but "of a more immediately practical character, giving a concise statement of the existing law of evidence." He hoped to finish the book within a year, and he meant then to publish a single volume on Constitutional Law resembling the Preliminary Treatise in its form and general scope. He had collected much material for both books, but it was not in shape for publication, and to one who knew the standards which he set for himself, and his ceaseless labor in revising and perfecting his work, even when it seemed most complete, the attempt to shape his matter by another hand would be little short of desecration. It appears from notes in his diary that he also had it in mind in the meantime to collect in book form some of the essays which he had prepared on many different occasions. The shape in which these were left makes this work possible after his death, and it is of special value from the fact that much of the material which would have gone into the proposed treatise on Constitutional Law may be found in these essays. Thus in a measure they preserve the fruits of his long and deep study of constitutional topics. Some of the essays were prepared for oral delivery, and in some cases for non-professional audiences. While that eminent jurist, chief-justice Shaw, was upon the bench, nearly all the opinions in this class of cases emanated from his pen, and it was a subject in respect of which he evinced a peculiar mastery. His Opinions are essays, elaborate, lucid, and convincing. I have made extensive extracts from them, since I have found no other authority so thoroughly satisfactory. I have added no appendix of forms to aid in drafting submissions, awards, &c., for the reason that this assist ance seemed to me wholly needless. All these docu ments, so far as matters of formality go, are such simple instruments that a layman could hardly go wrong in drawing them, and no lawyer could need guidance. In matters of substance, on the other hand, where errors are more naturally made, no general form could be of real use. Mr. Russell's forms are drawn with reference to elaborate English statutes and rules of practice which call for a considerable amount of technical precision. No similar necessity exists among us. Book excerpt: Excerpt from Essays on the Constitution of the United States: Published During Its Discussion by the People, 1787-1788 In 1888 the editor selected from the pamphlet arguments published during the discussion of the Constitution of the United States, prior to its ratification by the States, a collection of fourteen tracts, and printed them in a volume under the title of Pamphlets on the Constitution of the United States. The reception given that collection clearly proved that these writings were only neglected because of their rarity and inaccessibility, and has induced the editor to collect another, though largely similar class of writings, which he believes of equal value and equally unknown. In the great discussion which took place in the years 1787 and 1788 of the adoption or rejection of the Constitution of the United States, one of the important methods of influencing public opinion, resorted to by the partisans and enemies of the proposed frame of government, was the contribution of essays to the press of the period. The newspapers were filled with anonymous articles on this question, usually the product of the great statesmen and writers of that period. Often of marked ability, and valuable as the personal views of the writers, the dispersion and destruction of the papers that contained them have resulted in their almost entire neglect as historical or legal writings, and the difficulty of their proper use has been further increased by their anonymous character, which largely destroyed the authority and weight they would have carried, had their true writers been known.
