Book excerpt: This monograph offers a comprehensive analysis of the implementation of global anti-money laundering and counter-terrorism financing (AML/CTF) regulations in the United States and the European Union. It provides academics, legal professionals and interested readers with a deep understanding of the developments of the AML/CTF legal framework and guides them into the dimension of its most difficult relation with international and European human rights law. The implementation of global anti-money laundering regulations in the United Stated and the European Union has essentially led to the suspension of laws governing privacy and bank secrecy. Banks and other financial institutions now operate as an extension of law enforcement. The current Anti-Money Laundering regime jeopardises the fundamental achievements of the constitutional state. The increasing centralisation and cooperation of the competent authorities in the exchange of personal data information creates a security architecture that leads to a considerable risk of freedom restriction. In particular, the extension of the authorities ́ power of intervention granting them access to citizens ́ personal data without the need for initial suspicion underlines that a substantial part of the constitutional state is at risk. Furthermore, banks appear to use these policies as an instrument to clear legitimate but less profitable customers, in particular those with a migration background. Consequently, the implementation of the AML/CTF legal framework appears to follow a discriminatory path and clearly discloses incompatibility features with respect to the European Convention on Human Rights and Article 21 of the Charter of Fundamental Human Rights of the European Union. This monograph further explores factors contributing to the inefficiency of AML/CTF regulatory and legislative measures. Such factors are identified in inconsistent rules, which make the cooperation among national investigative authorities within the EU and at an international level more challenging. As a result, this work acknowledges regulatory and legislative harmonisation with respect to AML/CTF regimes as a central tool to successfully improve the effectiveness of AML/CTF regimes, while preserving the individual right to privacy, due process and civil rights.

The method is law and economics. The PhD thesis itself is also based on a comparative analysis of the Danish and British AML regimes.The main findings are: failure to develop adequate risk-based AML systems, taking into account varying levels of money laundering risk, is not only to be considered in the context of legal risk but also and more importantly in the context of integrity risk; anti-money laundering (AML) has to be made part of financial and non-financial institutions' corporate social responsibility policies; the Risk Analysis Manual provided by the Central Bank of The Netherlands lists very specific and comprehensive assessment criteria for a broad range of risks facing financial institutions. This manual could be considered by international bodies and individual financial institutions in informing their risk control; due to their intelligence access, cross-national agreements of cooperation and exchange of information and contacts to multiple stakeholders, financial intelligence units are better placed in educating financial institutions on AML matters by means of regular typology publications and other guidance based on SARs and other intelligence; and AML considerations should be incorporated in other areas of law, such as immigration law concerning wealthy individuals, if the AML regime is to achieve its intended impact.The paper highlights how the AML regime in general and the risk-based approach in particular could be improved so as to meet concerns of both regulatory authorities and regulated entities.

BitGold Inc. is a federally chartered Canadian Corporation regarded by Financial Transactions and Reports Analysis Centre of Canada as a dealer in precious metals and stones. This paper relies mainly on primary and secondary data drawn from the public domain. It also relies on documentary research and empirical research. FINDINGS - This paper determined that the Anti-Money Laundering measures adopted by BitGold Inc. cannot effectively combat money laundering and terrorist financing.This paper made the following recommendations:i. Verification of customer's identity should also be done via Skype.ii. BitGold's terms and agreement should state expressly the period within which records would be keptiii. BitGold Inc. should create and maintain a comprehensive program to manage the Anti-Money Laundering risks associated with third-party payment processors like Blockchain Limited and Coinbase, Inc.iv. BitGold Customer Due Diligence measures should provide an exemption for low-risk customers.

The reflection paper straightforwardly calls for additional resources to be made available to the European Banking Authority to counter money laundering. Suggestions for better cooperation and information sharing among anti-money laundering and prudential supervisors, however, risk being ineffective, as long as the underlying incentives to engage in international regulatory competition towards low enforcement of anti-money laundering standards are not addressed. To eliminate the potential for regulatory competition, anti-money laundering supervision needs to be raised to a European level.

But how to design the role of FIs and regulators, and their relationships, in order to increase the effectiveness of the AML rules?In this paper we analyze the problem using a principal-agent framework to describe the AML setting when a RBA is applied, focusing on incentive problems arising in a three-layer hierarchy, which includes public authorities, financial institutions, and regulators.
