Book excerpt: The Criminal Justice Act 2003 introduced a new style of community sentence known as a community order. For offences committee after 1 April 2005, magistrates and judges have been able to tailor communty sentences to the severity of the offence and, at the same time address offending behaviour. The most common order contains a single requirement obliging the offender to complete specified number of unpaid work hours. The National Probation Service supervises all offenders subject to such orders, plus those released from prison on licence or given other sentences to be served in the community. This report examines how well they have been implemented and whether they are meeting sentencing objectives. It is felt the National Probation Service could improve efficiency by increasing the consistency with which community orders are implemented within local Probation Areas. Better data on capacity, costs and the number of orders completed as sentenced would help the Service demonstrate value for money. The report makes several recommendations to this end.

Book excerpt: By September 2005, the prison population in England and Wales reached a record level of 77,300, an increase of 25,000 prisoners over the last ten years, resulting in increased levels of overcrowding and stretched resources. According to Home Office data for 2004, there were 141 people in custody per 100,000 of the population in England and Wales, compared to 98 per 100,000 in Germany and 93 per 100,000 in France. This NAO report examines how the National Offender Management Service (which has responsibility for managing and accommodating prisoners) is dealing with the pressure on places and the implications for performance, particularly the accuracy of Home Office projections of the future population and the impacts of overcrowding on the adult prison estate. The report does not deal with sentencing policy. Findings include that prison population projections have proved unreliable over the longer term; overcrowding is a particular problem for local prisons; the costs of temporarily holding prisoners in police cells have been considerable; and overcrowding disrupts prisoner rehabilitation programmes designed to prevent re-offending.

Book excerpt: The Committee undertook this inquiry to address concerns about the imprisonment of Welsh prisoners outside Wales. At present there are only four prisons in Wales, all in the South, and there is little provision for juveniles and no prisons for women. The overcrowding means that Welsh prisoners have a reduced chance of serving their sentence near home and reduces the chances of successful resettlement on release. The Committee believe there should be new prison places in North Wales, separate provision for young offenders and a new approach to women prisoners along the lines suggested by Baroness Corston. The report also address concerns about support services for mental illness amongst prisoners, the amount of Welsh language provision and education services.
