Book excerpt: In this article, I discuss how preferential trade agreements have started incorporating consumer protection provisions, in deviation from the traditional practice of leaving consumer protection to domestic law. The article first outlines the traditional frontier between consumer law and trade law. After describing two models for incorporating consumer protection provisions -- in chapters on e-commerce or in a dedicated consumer protection chapter -- the article explores whether this is a welcome evolution or an instance of trade agreements overstepping. I argue that a rationale exists for including consumer protection in trade agreements due to the growth of cross-border business-to-consumer transactions and the need to align regulations to the scope of the problem. However, the institutional structure around consumer protection in trade agreements must be improved to make this successful.

Book excerpt: Lead paint toys and tainted baby formula milk from China, along with other scares involving consumer goods, have focused the public's attention on the risks of a global supply chain that no state controls. Yet, domestic instruments available to protect consumers against unsafe or undesirable foreign goods and services are limited. This article explores, from a comparative legal perspective, what shapes international trade regimes to be more or less consumer-oriented, using primarily EU law as a counterpoint to the WTO, but also NAFTA and MERCOSUR. Ultimately, the article suggests that the WTO's producer-centered liberalization focus leaves consumers underserved and seeks to articulate a more holistic understanding of the trade liberalization project that accounts both for producer and consumer interests. Although the WTO may not be the appropriate or optimal forum to fulfill such needs, a more robust examination of the intersection between producer-oriented trade rules and consumer interests is warranted.

Ever since, there had been various contributions by scholars on the question of consumer rights and their status under various fragmentations of international law. However, in this paper, the focus is to understand the status of consumers in the World Trade Organisation (WTO). As part of this, primarily the paper analyses various agreements of the WTO and consumer-related disputes that were brought before the dispute settlement body (DSB) of the WTO to understand the extent of protection afforded to the consumer in this trade forum. Secondly, it investigates consumer representation in various committees and councils of the WTO and the participation of consumer organizations in the decision-making processes of the WTO to understand the inclusivity of consumer issues in the WTO.

For most of the advanced countries, trade has raised standards of living, while for most emerging economies, growth did not begin until their integration into the global economy. The economic explanation is simple: international trade facilitates specialization, increased efficiency and improved productivity to an extent impossible in closed economies. However, recent years have seen a significant slowdown in global trade, and the global system has increasingly come under attack from politicians on the right and on the left. The benefits of open markets, the continuation of international co-operation, and the usefulness of multilateral institutions such as the World Trade Organization (WTO), the International Monetary Fund and the World Bank have all been called into question. While globalization has had a broadly positive effect on overall global welfare, it has also been perceived by the public as damaging communities and social classes in the industrialized world, spawning, for example, Brexit and the US exit from the Trans-Pacific Partnership.
