This book engages with the text of Namibia's Public Enterprises Governance Act 1 of 2019 (PEGA). The objective of the PEGA is to provide for the efficient governance of public enterprises and the monitoring of their performance. A Manual on the Public Enterprises Governance Act in Namibia helpfully considers the policy context that led up to the PEGA and sheds light on the Act in a way that is easy to follow. The PEGA was preceded by a policy paper by the Ministry of Public Enterprises that expressed the perceived shortcomings of prior legislation governing public enterprises in Namibia. A proper governance model and accountability were identified as lacking. It was hoped that the PEGA would transform the governance of the country's public enterprises. However, the liquidation of Air Namibia in the era of the PEGA is testimony that the law has serious deficiencies, which this book helps to point out. A Manual on the Public Enterprises Governance Act in Namibia argues that the PEGA is inadequate to address governance challenges and recommends necessary reforms. The book will benefit lawyers, academics, students and researchers interested in the governance of public enterprises. Fiscal risks from public entities (PEs) materialize when funding requirements are higher than expected or revenues shortfalls occur. The government’s strategy for managing PE related fiscal risks should be informed by the likelihood of PE experiencing difficulties and, in such an event, the magnitude of the potential impact on the government. A two-step methodology was proposed for assessing the likelihood of fiscal risks materializing from PE. The authorities are also considering legislative amendments to strengthen the institutional arrangements for supervising PE.

Reforms should streamline business regulations, contain public sector wage dynamics, and reduce costs of key production inputs. Over time, it is important to remove non-tariff barriers to exports, foster the adoption of new technologies, and address shortages of skilled workers.
