Book excerpt: As veterans have returned from Operation Iraqi Freedom and Operation Enduring Freedom, veterans’ preference hiring within the federal government has become a contentious issue. Some believe this policy reduces the quality of the federal workforce. This paper tests if preference reduces the efficacy of the federal workforce by using OLS regressions to measure the relationship between the percentage of an agency’s workforce with veterans’ preference and the engagement of that agency’s workforce. This paper draws on data from the Office of Personnel Management regarding the employment of veterans, and their preference status, in agencies, Federal Employee Viewpoint Survey Scores, and Fedscope data on agencies. The analysis shows that the preference given to disabled veterans does have a negative impact on employee engagement. However, standard preference has a mild positive effect on engagement and hiring veterans who do not qualify for preference has an even stronger positive impact on employee engagement. I recommend that the federal government reduce the preference benefit given to disabled veterans. However; hiring managers should not avoid hiring veterans who qualify for standard preference and should seek out high ranking officers who do not qualify for preference.

Book excerpt: Pursuant to a congressional request, GAO examined federal agencies' hiring and selection of veterans, focusing on: (1) whether the Office of Personnel Management (OPM) and other agencies provide veterans points that can place them higher on hiring lists; and (2) why federal agencies are not hiring veterans receiving such points. GAO found that: (1) as of September 1990, veterans made up about 30 percent of the non-Postal Service federal workforce, double their percentage in the civilian labor force; (2) qualified veterans applying for federal jobs may claim 5 or 10 preference points over the points that all candidates receive for education, work experience, and test scores; (3) federal agencies are required by law to hire veterans who score higher than or equal to nonveterans on the same hiring lists; (4) agencies properly assigned veterans' preference points in 99.7 percent of 1,862 applications GAO reviewed, and also correctly placed veterans on certificates of eligible job candidates; (5) the preference points appear to only minimally affect nonveteran applicants, because of the low number of veterans entering the federal workforce; (6) high placement on the certificates does not ensure the selection of veterans, since hiring officials can use various methods to identify and recruit candidates, including the Outstanding Scholar Program, internal transfers and promotions, and direct hire authority; (7) OPM does not enforce the requirement that agencies explain why they did not use certificates; and (8) OPM does not adequately track, monitor, or analyze agencies' use or nonuse of certificates or their veteran hiring practices. GAO also found that, while state and local governments employ about 12 percent of all employed veterans in the civilian labor force, an examination of 10 state governments' hiring practices indicated that they offer veterans less hiring preference than the federal government does.

Book excerpt: By law, federal agencies are to provide preferential hiring consideration to veterans and others as a measure of national gratitude and compensation for their military service. The proposed Veterans Employment Opportunities Act of 1997, S. 1021, is to amend title 5 of the United States Code to provide that consideration may not be denied to veterans who are eligible for preference when applying for certain positions in federal service and for other purposes. Preference-eligible veterans represent a larger portion of the federal workforce than veterans do of the civilian workforce, and from 1993 through 1997 veterans with preference represented about 21 percent of all new career appointments to federal service. From 1990 through 1997, preference-eligible veterans represented a significantly higher percentage of the federal workforce than did veterans overall in the total civilian workforce. As figure 1 illustrates, preference-eligible veterans represent a gently declining portion of the federal workforce, and veterans also represent a declining portion of the total civilian workforce. However, in each year from 1990 through 1997, the percentage of preference-eligible veterans in the federal workforce was about twice as high as that of veterans in the civilian workforce.

Book excerpt: Veterans’ preference policies in government employment, at all levels, have existed for the intention of providing advantages for veterans who consider employment in public service after military service. While the purpose of these policies is well intended for veterans who have served, there exists the potential that this practice can be perceived as an endorsement to hire from a pool of candidates that consists of mostly white males. From a representation standpoint, for women and minority groups, this creates the potential to undo much of the progress that has been made in terms of better representation within the public workforce. However, overall, veterans have experienced a wage premium in the public sector compared to the private, which creates the challenge that veteran employment can have a negative effect on one area of employment equity while maintaining a positive effect in another. Furthermore, external factors, both market-based and employment-based, may influence these effects as well. This research examines how veteran employment has impacted public-private representation among veteran women and minority groups, overall veteran public-private wage gaps, and the explanatory factors that affect veteran hiring and pay variances. Using public use data from the American Community Survey (ACS) 1-year Public Use Microdata Sample (PUMS) files this research looks to fill in the gap in the literature related to public-private veteran employment representation and wage variances. The findings of this research first indicate that even though veterans are overrepresented in government service, veteran women and minorities have an even higher likelihood of representation in government service compared to the private sector. The explanatory factors that influence this finding are GSP, per capita income, and the unemployment rate, while union membership illustrates mixed results. Second, this research indicates that veterans are paid a wage premium working in the public sector compared to the private sector. The explanatory factors that influence this finding are per capita income, the unemployment rate, and union membership, while GSP does not. The overall contribution of this research builds upon the literature related both the composition and compensation of veterans and the external factors that influence public-private employment equity.

The Code was first published in 1926, and a new edition of the code has been published every six years since 1934. The 2012 edition of the Code incorporates laws enacted through the One Hundred Twelfth Congress, Second Session, the last of which was signed by the President on January 15, 2013. It does not include laws of the One Hundred Thirteenth Congress, First Session, enacted between January 2, 2013, the date it convened, and January 15, 2013. By statutory authority this edition may be cited "U.S.C. 2012 ed." As adopted in 1926, the Code established prima facie the general and permanent laws of the United States. The underlying statutes reprinted in the Code remained in effect and controlled over the Code in case of any discrepancy. In 1947, Congress began enacting individual titles of the Code into positive law. When a title is enacted into positive law, the underlying statutes are repealed and the title then becomes legal evidence of the law. Currently, 26 of the 51 titles in the Code have been so enacted. These are identified in the table of titles near the beginning of each volume. The Law Revision Counsel of the House of Representatives continues to prepare legislation pursuant to 2 U.S.C. 285b to enact the remainder of the Code, on a title-by-title basis, into positive law. Subsequent epidemiologic studies conducted on military and veteran populations that served in the operations in Afghanistan and Iraq provided scientific evidence that those who fought were in fact being diagnosed with mental illnesses and experiencing mental healthâ€"related outcomesâ€"in particular, suicideâ€"at a higher rate than the general population. Those disparities are caused not only by fundamental differences in health status across segments of the population, but also because of inequities in factors that impact health status, so-called determinants of health. Only part of an individual's health status depends on his or her behavior and choice; community-wide problems like poverty, unemployment, poor education, inadequate housing, poor public transportation, interpersonal violence, and decaying neighborhoods also contribute to health inequities, as well as the historic and ongoing interplay of structures, policies, and norms that shape lives. When these factors are not optimal in a community, it does not mean they are intractable: such inequities can be mitigated by social policies that can shape health in powerful ways. Communities in Action: Pathways to Health Equity seeks to delineate the causes of and the solutions to health inequities in the United States. This report focuses on what communities can do to promote health equity, what actions are needed by the many and varied stakeholders that are part of communities or support them, as well as the root causes and structural barriers that need to be overcome.
