The authors give particular attention to the evolution of Malay polities and their close links with indigenous groups who lived on the oceans and in the deep jungles of the region, from Sumatra to Borneo. This provides the background to the establishment of the Malay port of Melaka, which was conquered by the Portuguese in 1511, foreshadowing the establishment of a British colonial regime in the late nineteenth century. Although the large numbers of Chinese and Indian migrants who arrived to work in the tin and rubber industries contributed to economic expansion, colonial policies did not encourage communal interaction. The authors trace the process by which post-independence leaders in Malaya attempted to counter the legacy of ethnic hostility while answering Malay demands for an affirmation of their rights and a stronger commitment to Islam. The incorporation of the Borneo states of Sarawak and Sabah into the Federation of Malaysia in 1963 rendered the goal of welding a nation from areas that were geographically separated and culturally disparate even more problematic. The intense emotions attached to issues of race were made tragically evident in the racial riots of May 1969, which this book sees as a watershed in modern Malaysian history. As Malaysia enters the twenty-first century, the government is determined to oversee the transition to an economy focused on manufacturing and advanced technology, and to eliminate poverty and the association between occupation and race. Sungai Selangor is an important water resource for the state of Selangor. It is the major contributor in meeting water demand to the Selangor State and Kuala Lumpur. Since early days, Sungai Selangor has played a central role in the development of settlements in northern Selangor. Theresearch described here is an attempt to understand the development forces operating in the Sungai Selangor watershed. The approach taken is intentionally multi-disciplinary, as it attempts to paint a broad brush picture of the current situation within the Sungai Selangor watershed. Increasing pressures on land development is a major factor that causes land use conflicts in the watershed. Spatial-environmental governance should improve collaboration and connections between citizens and decision-makers at the watershed scale. Many issues within the economic, social or environmental realm necessitate an understanding of the spatial context within which such forces operate. The book is organized in ten chapters, each chapter being devoted towards addressing particular issues considered prevalent or outstanding within the community living within the watershed. Although the book has been written in an academic manner, it should also appeal to the general public and students in higher education institutions as it relates to topical issues. Beginner researchers may find that the discussion of various issues within a location-specific context might spark off their interest to begin their own research on particular aspects that appeal to their own area of expertise.

City officials classified plantation residents as squatters and, unaware of years of toil, attachment to the land, and past official promises, questioned any right they might have to stay, wondering “How can there be a plantation in Kuala Lumpur?” This story epitomizes the dilemma faced by Malaysian Tamils in recent years as they confront the moment when the plantation system where they have lived and worked for generations finally collapses. Foreign workers from Indonesia and Bangladesh have been brought in to replace Tamil workers to cut labor costs. As the new migrant workers do not bring their whole families with them, the community structures—schools, temples, churches, community halls, recreational fields—need no longer be sustained, allowing more land to be converted to mechanized palm oil production or lucrative housing developments. In short, the old, long-term community-based model of rubber plantation production introduced by British and French companies in colonial Malaya has been replaced by a model based upon migrant labor, mechanization, and a gradual contraction of the plantation economy. Tamils find themselves increasingly resentful of the fact that lands that were developed and populated by their ancestors are now claimed by Malays as their own; and that the land use patterns in these new townships, are increasingly hostile to the most symbolic vestiges of the Tamil and Hindu presence, the temples. In addition to issues pertaining to land, legal cases surrounding religious conversion have exacerbated a sense of insecurity among Tamil Hindus. Based on seventeen months of ethnographic fieldwork, this compelling book is about much more than the fast-approaching end to a way of life. Tamils and the Haunting of Justice addresses critical issues in the study of race and ethnicity. It is a study of how notions of justice, as imagined by an aggrieved minority, complicate legal demarcations of ethnic difference in post colonial states. Through its ethnographic breadth, it demonstrates which strategies, as enacted by local communities in conjunction with NGOs and legal advisors/activists, have been most “successful” in navigating the legal and political system of ethnic entitlement and compensation. It shows how, through a variety of strategies, Tamils try to access justice beyond the law—sometimes by using the law, and sometimes by turning to religious symbols and rituals in the murky space between law and justice. The book will thus appeal not only to scholars of Southeast Asia and the Indian diaspora, but also to ethnic studies and development scholars and those interested in postcolonial nationalism.

Book excerpt: In "The Politics of Islamic Law" political scientist Iza Hussin offers a genealogy of contemporary Islamic law, a political analysis of elite negotiations over religion, state, and society in the British colonial period, and a history of current Muslim approaches to law, state, and identity. Hussin argues that Islamic law as it is legislated and debated throughout the Muslim world today is no longer the "shari ah" as it previously existed. She shows that shari ah an uncodified and locally administered set of legal institutions and laws with wide-ranging jurisdiction was transformed (not eradicated as some have argued) during the British colonial period into a codified, state-centered system with jurisdiction largely limited to law regarding family, personal status, ethnic identity, and the private domain. As a result, the practices, beliefs, and possibilities inherent in law, changed, and so did the strategies, attitudes and aspirations of those who used this changing system. Its present institutional forms, its substantive content, its symbolic vocabulary, and its relationship to state and society in short, its politics are built upon foundations laid during the colonial encounter, in struggles between local and colonial elites. "The Politics of Islamic Law" undertakes a cross-regional comparison of India, Malaya, and Egypt which illustrates that Islamic law is a trans-global product shaped by local political networks. The rearrangement of the local elite combined with the new reach of the state made possible by colonial power gave local elites a vested interest in this twinning of the centrality of Islamic legitimacy and the marginalization of its legal content. These processes are traced through close examinations of debates over jurisdiction, the definition of Islamic law, and in turn the nature of the state. This work makes an important contribution to critical debates in comparative politics, history, legal anthropology, comparative law, and Islamic studies."
