The book opens the concepts of groups and the state, arguing for the complexity of their relations and interpenetrations. Carol Weisbrod draws on richly diverse historical and cultural material to explore various structures that have been seen as appropriate for adjusting relations between states and internal groups. She considers the experience of the Mormons, the Amish, and Native Americans in the United States, the Mennonites in Germany, and the Jews in Russia to illustrate arrangements and accommodations in different times and places. The Minorities Treaties of the League of Nations, political federalism, religious exemptions, nonstate schools, and rules about adoption are among the mechanisms discussed that sustain cultural difference and create frameworks for group life, and, finally, individual life. Book excerpt: Addressing a host of hot-button issues, from the barring of Christian student groups and military recruiters from law schools and universities to churches’ immunity from civil rights legislation in hiring and firing ministers, Paul Horwitz proposes a radical reformation of First Amendment law. Arguing that rigidly doctrinal approaches can’t account for messy, real-world situations, he suggests that the courts loosen their reins and let those institutions with a stake in First Amendment freedoms do more of the work of enforcing them. Universities, the press, libraries, churches, and various other institutions and associations are a fundamental part of the infrastructure of public discourse. Rather than subject them to ill-fitting, top-down rules and legal categories, courts should make them partners in shaping public discourse and First Amendment law, giving these institutions substantial autonomy to regulate their own affairs. Self-regulation and public criticism should be the key restraints on these institutions, not judicial fiat. Horwitz suggests that this approach would help the law enhance the contribution of our “First Amendment institutions” to social and political life. It would also move us toward a conception of the state as a participating member of our social framework, rather than a reigning and often overbearing sovereign. First Amendment Institutions offers a new vantage point from which to evaluate ongoing debates over topics ranging from campaign finance reform to campus hate speech and affirmative action in higher education. This book promises to promote—and provoke—important new discussions about the shape and future of the First Amendment.

Book excerpt: Participatory governance has a long history in India and this book traces historical-intellectual trajectories of participatory governance and how older Western discourses have influenced Indian policymakers. While colonial rulers devolved power to accommodate dissenting voices, for independent India, participatory governance was a design for democratizing governance in its true sense. Participation also acted as a vehicle for localizing governance. The author draws on both Western and non-Western theoretical treatises and the book seeks to conceptualize localizing governance also as a contextual response. It also makes the argument that despite being located in different socio-economic and political milieu, thinkers converge to appreciate localizing governance as perhaps the only reliable means to democratize governance. The book aims to confirm this argument by reference to sets of evidence from the Indian experience of localizing governance. By attempting a genealogy of participatory governance in the West and in India, and an empirical study of participatory governance in India, the book sheds light on the exchange of ideas and concepts through space and time, thus adding to the growing body of literature in the social sciences on ‘conceptual flow’. It will be of interest to political scientists and historians, in particularly those studying South Asia.

Yet the banks have been accused of failing to implement their own environmental policies, thereby contributing to environmental degradation in borrowing countries. In this book Tamar Gutner analyzes the environmental policies of three MDBs: the World Bank, the European Bank for Reconstruction and Development, and the European Investment Bank. She compares their performance in Central and Eastern Europe, where the need for economic and environmental reform has been particularly urgent, and where these MDBs are among the largest donors. Gutner finds many obstacles to efforts to "green" the three banks, most notably a mismatch between the environmental mandates and existing patterns of institutional design and incentives. The depth and scope of the banks' green activities reflect the degree of shareholder commitment to environmental issues and how demand-driven the MDB is designed to be. Surprisingly, the World Bank, the most scrutinized and criticized of the three MDBs, has been rather more responsive than its counterparts to its environmental mandate in the region. The discussion is framed by larger explorations of the behavior of international organizations and the sources of their innovation and inertia in addressing new policy issues. Gutner demonstrates the need to examine the impact of different stages of the policy process on new mandates and to incorporate both political and institutional variables when developing theories about the behavior of international institutions.
