This book was released on 2011-10-19 with total page 92 pages. Available in PDF, EPUB and Kindle. Book excerpt: In safeguarding national security the Government produces and receives sensitive information. This information must be protected appropriately, as failure to do so may compromise investigations, endanger lives and ultimately lessen its ability to keep the country safe. The increased security and intelligence activity of recent years has led to greater scrutiny including in the civil courts, which have heard a growing numbers of cases challenging Government decisions and actions in the national security sphere. Such cases involve information that under current rules cannot be disclosed in a courtroom. The UK justice system is then either unable to pass judgment and cases collapse or are settled without a judge reaching any conclusions. This green paper aims to respond to the challenges of how sensitive information is treated in the full range of civil proceedings. It looks for solutions that improve the current arrangements while upholding the Government's commitment to the rule of law. It also addresses the need for public reassurance that the national security work is robustly scrutinised, and that the scrutinising bodies are credible and effective. The proposals in this consultation are in three broad areas: enhancing procedural fairness, safeguarding material and reform of intelligence oversight.

Book The justice and security green paper

Download or read book The justice and security green paper written by Great Britain: Parliament: Joint Committee on Human Rights and published by The Stationery Office. This book was released on 2012-04-04 with total page 74 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Joint Committee on Human Rights (JCHR) calls for statutory clarification of law on disclosure of national security-sensitive material, but finds no case for more extensive change. The Government has failed to make the case for extending "closed material procedures" to all civil proceedings and to inquests: the Government has not demonstrated that the fairness concern on which it relies to justify the proposal is in fact a real and practical problem. The Committee believes that closed material procedures are inherently unfair and the proposals in the Green Paper are a radical departure from longstanding traditions of open justice and fairness. Nor does it accept that replacing the current law governing disclosure of sensitive material (the law of Public Interest Immunity, or "PII") with closed material procedures is justified. The rule of law requires that decisions about the disclosure of material in legal proceedings be taken by judges not ministers and the current legal framework of PII has not been shown to be inadequate. There is a case, however, for that legal framework to be made clearer in the way in which it applies to national security-sensitive material and the Committee suggests how that could be done by legislation and changes to the Coroners Rules and guidance. The Committee regrets that the Green Paper overlooks the very considerable impact of its proposals on the freedom and ability of the media to report on matters of public interest and concern.

Book International Liability Regime for Biodiversity Damage

Download or read book International Liability Regime for Biodiversity Damage written by Akiho Shibata and published by Routledge. This book was released on 2014-03-26 with total page 346 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Nagoya-Kuala Lumpur Supplementary Protocol on Liability and Redress to the Cartagena Protocol on Biosafety, adopted on 15 October 2010 in Nagoya, Japan, provides an international liability regime for biodiversity damage caused by living modified organisms (LMOs). Its adoption marks a significant development in the legal design for international environmental liability regimes, as it incorporates for the first time in global treaties an administrative approach to liability. This book examines the Supplementary Protocol from both practitioner and academic perspectives. In its three parts the book explores the historical development, legal significances, and future implementation of the core provisions of the Supplementary Protocol, focusing specifically on its incorporation of an administrative approach to liability for biodiversity damage and its relation to civil liability. Contributors to the volume include Co-Chairs of the negotiating group and the negotiators and advisors from some of the key negotiating Parties, offering valuable insights into the difficult-to-read provisions of the Supplementary Protocol. The book demonstrates the significant changes in the political configuration of environmental treaty negotiations which have come about in the twenty-first century, and argues that the liability approach of the Supplementary Protocol has important implications for future development of international liability regimes under international environmental law.

Book Minimum Income Schemes in Europe

Download or read book Minimum Income Schemes in Europe written by International Labour Organisation and published by International Labour Organization. This book was released on 2003 with total page 306 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book investigates the paradox of rich countries of Western Europe, who have high levels of poverty whilst proclaiming its eradication as one of the primary social and economic goals. It looks at how policies often do not achieve their goals, why countries need mechanisms to reduce wage inequality and why they choose to provide universal benefits instead of systems of selective benefits targeted at the poor. Along with cross-countries comparisons, the volume also presents analysis of the minimum income in France, Portugal, Italy, Finland, Ireland, Belgium, and Greece.

Book Education in Hong Kong 1941 to 2001

Download or read book Education in Hong Kong 1941 to 2001 written by Anthony Sweeting and published by Hong Kong University Press. This book was released on 2004-07-01 with total page 712 pages. Available in PDF, EPUB and Kindle. Book excerpt: It provides comprehensive coverage of developments in formal and informal education in Hong Kong from the end of 1941 to the beginning of the new millennium. As was true of its predecessor, each Part of this book is subdivided into three sections: Commentary, Chronicle, and Evidence. Such an organization facilitates flexible reading. Readers primarily interested in analysis, interpretation, and the identification of themes are likely to focus initially on the Commentary sections and to move, as they feel stimulated, to the relevant entries in the Chronicle and/or items of Evidence. Readers who seek either more encyclopedic understanding or detailed answers to specific questions may well wish to focus primarily or at least initially on the Chronicle sections, and then to search for substantiation in the Evidence section or for amplification in the author's Commentary. At times, some readers may wish to browse through the Evidence sections, reaching possibly serendipitous discoveries. Academic and general readers are likely to be particularly interested in Part I of the book, which deals with education in Hong Kong during the Japanese occupation, a topic that has received only very rare and generalization-bound treatment in other publications. The author offers insights into all levels of education. His conceptual scope incorporates many types of education - including the mainstream academic education, technical education, teacher education, special education, physical education, civic education, education that focuses on morals, that which focuses on culture, and the various sorts of non-formal and informal education.

Book European Law on Unfair Commercial Practices and Contract Law

Download or read book European Law on Unfair Commercial Practices and Contract Law written by Mateja Durovic and published by Bloomsbury Publishing. This book was released on 2016-07-28 with total page 235 pages. Available in PDF, EPUB and Kindle. Book excerpt: The book examines the ambiguous relationship between the European law on unfair commercial practices and contract law. In particular, the manuscript demonstrates that the Directive 2005/29/EC on unfair commercial practices (UCPD) has had a major impact on contract law, despite the declaration concerning the formal independence between the two branches of law established by Article 3(2) UCPD. The insights and conclusions identified in the book contribute to a better understanding of European private law and the general process of Europeanisation of private law in the European Union, and in particular of contract law.
