This examination deals with early experimentation of electronic monitoring devices within the behavioral sciences setting, and traces its development and use up to the current period. Environmental factors which have helped electronic monitoring shift from an experimental model to a working tool within corrections are also examined. Following a review of the available literature, issues and controversies surrounding electronic monitoring are explored. The data utilized in this study was obtained through two primary sources. The first was a literature review in which numerous sources where considered in order to trace the emergence and development of electronic monitoring within the United States. Secondly, legislation was examined in order to support thesis arguments. Based on the results of the review of the literature and legislation, two conclusions were reached. First, the use of electronic monitoring will probably increase the efficiency of the corrections system employing it. This efficiency may increase prison and jail populations. Secondly, this new technology will continue to grow within the field of corrections, and risks can be expected, since many new programs are coming on-line before any scientific study on electronic monitoring can be conducted and evaluated.

This report examines its cost effectiveness and covers: whether breaches of curfew are detected and dealt with promptly; the cost compared to custody; the impact on the offending behaviour. The main conclusion is that electronic tagging does offer value for money but effectiveness is undermined by delays in fitting tags and delays in responding to breaches of curfew.

Book excerpt: In November of 2006, California voters passed Proposition 83, also known as the "Sexual Predator Punishment and Control Act: Jessica's Law" or simply, Jessica's Law. This law not only enforced the use of GPS surveillance units to track all convicted sex offender parolees, including juveniles, for the rest of their lives, but it also enforced a strict 2000-foot residency restriction thus greatly limiting the locations of where parolees can live and work. As a result, the number of registered sex offenders has increased as well as the amount of money used to fund such popular surveillance policies. Since the passing of Jessica's Law, the California Department of Corrections and Rehabilitation (CDCR) now leads the nation in the use of GPS surveillance for the community management of sex offenders on parole. The use of GPS to track sex offender parolees is driven by several factors including the desire to control re-offending behavior and to "keep kids and communities safe." However, studies conducted on recidivism rates for released offenders question whether or not these expectations are, in fact, realistic. This dissertation begins with a discussion of the history of electronic monitoring schemes used within the United States criminal justice system. Charting the uses of surveillance technology throughout the past 40 years, findings suggest that growth is widespread and changing. Additionally, this dissertation details changes in sex offender legislation including legal justifications and political rhetoric associated with current law. Most importantly, this dissertation utilizes qualitative data from focus groups with sex offender parolees on GPS. Findings indicate that Jessica's Law, as a criminal justice policy, does little to help reintegrate or rehabilitate parolees, nor does it effectively curtail reoffending behavior. Instead, analysis within this dissertation demonstrates how Jessica's Law and GPS technology are counterproductive, exclusionary, and costly.

Book excerpt: This report contains a futures study, a strategic- management plan, and a transition-management plan pertinent to the use of electronic monitoring as a custody alternative in California by the year 2000. A nominal group panel was established to identify trends and events that could impact electronic monitoring. The five key trends assessed included court limitations on jail population, the reliability and public confidence in electronic monitoring, criminal justice resources, and the use of fees for custody alternatives. The data show that public acceptance of electronic monitoring will increase during the next decade. The study further shows that the issue of increased use of electronic monitoring is more political than technological. A situational audit shows that the organization is marginally prepared to accept change. A stakeholder assessment reveals that the positions or persons critical to increasing the use of electronic monitoring are all part of the local criminal justice system. Strategies were developed through use of the modified policy delphi. The selected strategy involves a combination of an educational campaign aimed at the public and media, as well as a team-building workshop for stakeholders. An implementation plan was established to increase the use of electronic monitoring. For the transition-management plan, critical-mass individuals were identified, and strategies were designed to enlist their participation in increasing the use of electronic monitoring. A transition-management team was selected to achieve the increase. The study concludes that the use of electronic monitoring is a desirable and feasible alternative to traditional incarceration.
