Book Western Water Rights and the U S Supreme Court

Download or read book Western Water Rights and the U S Supreme Court written by James H. Davenport and published by McFarland. This book was released on 2020-09-30 with total page 298 pages. Available in PDF, EPUB and Kindle. Book excerpt: Exploring the little-known history behind the legal doctrine of prior appropriation--"first in time is first in right"--used to apportion water resources in the western United States, this book focuses on the important case of Wyoming v. Colorado (1922). U.S. Supreme Court Associate Justice Willis Van Devanter, a former Chief Justice of Wyoming, ruled in that state's favor, finding that prior appropriation applied across state lines--a controversial opinion influenced by cronyism. The dicta in the case, that the U.S. Government has no interest in state water allocation law, drove the balkanization of interstate water systems and resulted in the Colorado River Interstate Compact between Wyoming, Colorado, Utah, New Mexico, Arizona, Nevada and California. The exhaustive research that has gone into this book has uncovered the secret that Associate Justice Van Devanter had waited eleven years to publish his opinion in this important, but politically self-serving, case, at last finding a moment when his senior colleagues were sufficiently absent or incapacitated to either concur or dissent. Without the knowledge of his "brethren," save his "loyal friend" Taft, and without recusal, Van Devanter unilaterally delivered his sole opinion to the Clerk for publication on the last day of the Supreme Court's October 1921 Term.

Book A Place We Call Home

    Book Details:
  • Author : K. Amimahaum Ducre
  • Publisher : Syracuse University Press
  • Release : 2013-01-04
  • ISBN : 0815633068
  • Pages : 180 pages

Available in PDF, EPUB and Kindle. Book excerpt: Faith holds up a photo of the boarded-up, vacant house: "It’s the first thing I see. And I just call it ‘the Homeless House’ ‘cause it’s the house that nobody fixes up." Faith is one of fourteen women living on Syracuse’s Southside, a predominantly African-American and low-income area, who took photographs of their environment and displayed their images to facilitate dialogues about how they viewed their community. A Place We Call Home chronicles this photography project and bears witness not only to the environmental injustice experienced by these women but also to the ways in which they maintain dignity and restore order in a community where they have traditionally had little control. To understand the present plight of these women, one must understand the historical and political context in which certain urban neighborhoods were formed: Black migration, urban renewal, white flight, capital expansion, and then bust. Ducre demonstrates how such political and economic forces created a landscape of abandoned housing within the Southside community. She spotlights the impact of this blight upon the female residents who survive in this crucible of neglect. A Place We Call Home is the first case study of the intersection of Black feminism and environmental justice, and it is also the first book-length presentation using Photovoice methodology, an innovative research and empowerment strategy that assesses community needs by utilizing photographic images taken by individuals. The individuals have historically lacked power and status in formal planning processes. Through a cogent combination of words and images, this book illuminates how these women manage their daily survival in degraded environments, the tools that they deploy to do so, and how they act as agents of change to transform their communities.

Book Grassroots Elections in China

Download or read book Grassroots Elections in China written by Kevin J. O'Brien and published by Routledge. This book was released on 2014-07-22 with total page 199 pages. Available in PDF, EPUB and Kindle. Book excerpt: Twenty years after the launch of village elections, the time is ripe to assess the progress and impact of China’s most notable political reform. Where have elections been conducted well and where have they been conducted poorly? How have procedures changed over the years and have elections truly transformed how power is exercised in the countryside? What methods are researchers employing to study elections and how have scholars from different disciplines contributed to our knowledge of grassroots politics in China? This book carefully examines the implementation and effects of China’s village, township, and people’s congress elections, both in terms of democratizing the polity and spurring other changes in state-society relations. The chapters in this book have been published across several issues of the Journal of Contemporary China.
