Book excerpt: The Islamic Compliance Quality Management System-Requirements from Islamic Perspectives (ICQMS): MS 1900:2005, has been introduced and implemented in Malaysia for quite sometimes. The controlling and monitoring body is SIRIM Malaysia. The implementation of MS 1900:2005 is based on the ISO 9001:2000 standard which is revised as ISO 9001:2008 (Quality Management System), a Quality Management System established by the International Organization for Standardization (ISO) that is applicable for all type and size of organizations. It establishes a standard with the objectives to improve the effectiveness of products, services and processes. In fact ICQMS, MS 1900:2005 has become a basis in measuring standard recognized nationwide in measuring quality from Islamic perspectives. With the references to the Malaysian contexts, this paper intends to give a brief overview on its philosophic establishments, practices and components within the philosophic values and requirement of Shariah based compliance in accordance to Al-Quran and Hadeeth.

Nearly 20 percent annual growth of Islamic finance in recent years seems to point to its resilience and broad appeal, partly owing to principles that govern Islamic financial activities, including equity, participation, and ownership. In theory, Islamic finance is resilient to shocks because of its emphasis on risk sharing, limits on excessive risk taking, and strong link to real activities. Empirical evidence on the stability of Islamic banks, however, is so far mixed. While these banks face similar risks as conventional banks do, they are also exposed to idiosyncratic risks, necessitating a tailoring of current risk management practices. The macroeconomic policy implications of the rapid expansion of Islamic finance are far reaching and need careful considerations.

Book excerpt: Purpose: This study aims to develop a Sharīʻah-compliance rating mechanism for the Islamic financial services industry (IFSI), with a special focus on banking. The banking sector is taken as the area of focus due to its leadership role in the volume of global Sharīʻah-compliant assets.Design/methodology/approach: The objectives of the Islamic financial system (IFS) are selected as the basis for ratings. A range of performance indicators (leading to achievement of the objectives) is grouped into four broader categories and used in the study to allocate scores with a sum total of 100. Special considerations - including the amount of resources required in performing an activity, suitability of prevailing business conditions, the degree of compulsion/discretion in performing a task and linkage with the essence of the IFS - were taken into account in the allocation of scores.Findings: This study groups multiple performance measures into four categories, including portfolio construction (deposits mechanism, participatory and asset-based modes of financing), access to finance (service to the less-privileged and sector screening), reputation (disclosures and stakeholders' survey) and Sharīʻah governance (Sharīʻah supervision and controls, charitable operations, human resources, product development and organization). The Portfolio, Audit, Reputation and System (PARS) rating system is then developed.Practical implications: A Sharīʻah-compliance rating system is helpful in measuring the progress towards goal achievement of the IFS and in gaining stakeholders' trust. It is also important for Sharīʻah boards and regulators in policy formulation, for management in addressing weaknesses and taking corrective measures and potentially for standard-setting bodies.Originality/value: This study presents a comprehensive quantitative Sharīʻah-compliance rating mechanism, taking into consideration the objectives of the IFS - equitable distribution of wealth and financial stability, in addition to Sharīʻah-compliance in operations. Development of Sharīʻah-compliance quality ratings for Islamic banking is essential to gain customers' trust; the suggested methodology is thus a contribution to the literature on Islamic finance.

Book excerpt: Abstract: The structures and processes established within an institution offering Islamic financial Services (IIFS) for monitoring and evaluating Shariah compliance rely essentially on arrangements internal to the firm. By being incorporated in the institutional structure, a Shariah supervisory board (SSB) has the advantage of being close to the market. Competent, independent, and empowered to approve new Shariah-conforming instruments, an SSB can enable innovation likely to emerge within the institution. The paper reviews the issues and options facing current arrangements for ensuring Shariah compliance by IIFS. It suggests a framework that draws on internal and external arrangements to the firm and emphasizes market discipline. In issuing its fatwas, an SSB could be guided by standardized contracts and practices that could be harmonized by a self-regulatory professionals' association. A framework with the suggested internal and external features could ensure adequate consistency of interpretation and enhance the enforceability of contracts before civil courts. The review of transactions would mainly be entrusted to internal review units, which would collaborate with external auditors responsible for issuing an annual opinion on whether the institution's activities has met its Shariah requirements. This process would be sustained by reputable entities such as rating agencies, stock markets, financial media, and researchers who would channel signals to market players. This framework would enhance public understanding of the requirements of Shariah and lead to more effective options available to stakeholders to achieve improvements in Islamic financial services.
