It is possible that a more logical method of treatment might demand a detailed consideration of the problem as it has been worked out in each individual state, but this method would have necessitated too much of a deviation from the position taken that the problem is national rather than local, and so this phase of the problem has been emphasised at the possible expense of logical arrangement. Be it Enacted by the General Assembly of the State of Colorado: Section 1. The Industrial Commission of Colorado created by the act of the General Assembly of Colorado, which commission for the purpose of this Act shall be a body politic and corporate under the name prescribed by said Act, shall enforce and administer the provisions of this Act and wherever the word commission is used in this Act it shall be construed to mean the Industrial Commission of Colorado. The said Commission, in the administration of this Act shall be governed by its provisions if there be conflict between the same and the provisions of the Act creating said Commission. Section 2. The term "Commission" when used in this Act shall mean The Industrial Commission of Colorado. Section 3. Unless the context otherwise requires, a word used in this Act in the singular number shall also include the plural. Section 4. The following terms as used in this Act shall be construed and have the following meaning, unless otherwise specifically defined in the context: (a) The term "order" shall mean and include any decision, classification, rate, rule, regulation, direction, requirement or standard of the Commission, or any other determination arrived at or decision made by such Commission. Book excerpt: Excerpt from Workmen's Compensation: History and Operation of Workmen's Compensation in Great Britain The attitude of public opinion in England toward the relations of master and servant, of which the latest law regulating the accidents of industry is an outcome, is shown by the current decisions of judges, by attempted legislation, and by the legislation adopted. That this attitude has changed greatly with the times is illustrated by Parliament's expression of view in 1825, that "all combinations of workmen are injurious to trade," while in 1875 a diametrically opposite view was held, and legislation was enacted in accordance with that view, it being then admitted by the Conservative leader, Lord Beaconsfield, that "for the first time in the history of the country employer and employed sit under equal laws." Again, in 1837 it is said that "principles of justice and good sense" require "that a workman should take on himself all the ordinary risks of his employment," while in 1897 the legislature said, "sound economic doctrine requires that the employer shall take all the ordinary and extraordinary risks involved in the carrying on of his industry." Examination of the workmen's compensation act of 1897, as amended in 1900, of the parliamentary steps by which it became law, and of its working, leads at the outset to an inquiry into judicial decisions of 60 years before, and the measures subsequently introduced into Parliament dealing with accidents which were the result of the growth and concentration of industries. Common Law of Negligence. In 1837 the general principles of the common law of negligence formed the only basis of recovery by a workman from his employer for an accident. Under these general principles a man was held to be responsible to others, including his servants, for injuries resulting from his own negligent acts, or from the negligent acts of his agents in the scope of their employment. As one Senator defined it: The law is in the nature of a bargain; for, if it obliges the head of an industrial undertaking to make good the loss in curred by the victim, without inquiry as to the cause of the accident, on the other hand, it only makes the patron responsible for a part of the damage suffered. Unfortunately this original basis of the law has been more and more lost sight of, and the tendency is to construe and amend the act as though intended to make the employers the ones to be held re sponsible for any damages resulting from accidents. Disregarding the fact that the employees were to share the burden, too, both courts and legislature are daily more inclined to interpret and to change the law so as to aid the injured as much as possible in their efforts to obtain compensation from their superiors. The statute has come to be re garded more as a species of class legislation and as a measure directed against the employers in the interests of the workingmen. Hence the feeling that the poor and unfortunate should be favored whenever pos sible in their attempts to recover from the well-to-do masters and that the employees and physicians are acting quite legitimately and entirely within their rights in endeavoring to turn the law into as great a source of pecuniary profit to themselves as possible.
