Book Essays on the History of Parliamentary Procedure

Download or read book Essays on the History of Parliamentary Procedure written by Paul Evans and published by Bloomsbury Publishing. This book was released on 2017-12-28 with total page 469 pages. Available in PDF, EPUB and Kindle. Book excerpt: 8 February 2015 marked the 200th anniversary of the birth of Thomas Erskine May. May is the most famous of the fifty holders of the office of Clerk of the House of Commons. His continued renown arises from his Treatise upon the Law, Privileges, Proceedings and Usage of Parliament, first published in 1844 and with its 25th edition currently in preparation. It is known throughout those parts of the world that model their constitutional arrangements on Westminster as the 'Bible of Parliamentary Procedure'. This volume celebrates both the man and his book. Bringing together current and former Clerks in the House of Commons and outside experts, the contributors analyse May's profound contribution to the shaping of the modern House of Commons, as it made the transition from the pre-Reform Act House to the modern core of the UK's constitutional democracy in his lifetime. This is perhaps best symbolised by its enforced transition between 1834 and 1851 from a mediaeval slum to the World Heritage Palace of Westminster, which is the most iconic building in the UK. The book also considers the wider context of parliamentary law and procedure, both before and after May's time. It constitutes the first sustained analysis of the development of parliamentary procedure in over half a century, attempting to situate the reforms in the way the central institution of our democracy conducts itself in the political contexts which drove those changes.

  • Author : Michael Zander
  • Publisher : Bloomsbury Publishing
  • Release : 2020-06-25
  • ISBN : 1509934553
  • Pages : 557 pages

Download or read book The Law Making Process written by Michael Zander and published by Bloomsbury Publishing. This book was released on 2020-06-25 with total page 557 pages. Available in PDF, EPUB and Kindle. Book excerpt: As a critical, in-depth analysis of the law-making process, this book has no equal. It deals with all the stages and forms of law-making: - the preparation of legislation; - its passage through Parliament; - statutory interpretation; - the operation of the rules of precedent in judicial decision-making; - the many facets of judicial law-making; - the machinery of law reform. The new eighth edition covers the operation of EU law in the UK after Brexit. It also covers pre-Brexit events such as the unprecedented legislation by backbench MPs to stop a No Deal Exit from the EU and the two great Supreme Court decisions over the triggering of Brexit and the prorogation of Parliament. The books draws on a wide range of sources including important new empirical research such as Lord Sumption's 2019 Reith lectures (Trials of the State – Law and the Decline of Politics) and the work of Sir Geoffrey Palmer, former Prime Minister and Justice Minister of New Zealand on The Law Reform Enterprise. There are new sections on the attempt to control the size of the House of Lords, on whether Parliament should have a role in the selection of senior judges and on the topical question whether decisions of the courts on constitutional questions are 'legal' or 'political'.

Book Delegated Governance and the British State

Download or read book Delegated Governance and the British State written by Matthew Flinders and published by OUP Oxford. This book was released on 2008-08-21 with total page 384 pages. Available in PDF, EPUB and Kindle. Book excerpt: The delegation of functions and responsibilities to quasi-autonomous bodies operating with a significant degree of autonomy arguably empowers governments to address a wide range of social issues simultaneously without having to be involved with the minutiae of day-to-day socio-political interactions. Delegation therefore provides a structural and esoteric capacity beyond the cognitive and physical limits of politicians. There is nothing wrong with delegation as such. The problem relates to the failure to manage delegation in Britain. And yet we actually know very little about how the state beyond the core actually operates, how many bodies exist, what they do, how they are recruited, or why they were created. These gaps in our knowledge are all the more problematic in light of recent pronouncements by politicians at the national and European levels that 'depoliticisation' is a central strand of their approach to governing. This book seeks to fill these gaps in our knowledge while at the same time cultivating a more balanced or sophisticated approach to the study of delegation. Delegated public bodies as they have been used as a tool of governance in the past should not be confused with how they might be used in the future. This book draws upon research conducted within the very core of the British political system during a Whitehall Fellowship within the Cabinet Office. It argues that the British state is 'walking without order' due to a general acceptance of the logic of delegation without any detailed or principled consideration of the administrative of democratic consequences of this process. In order to underline and develop this argument this books analyses the history of delegated governance in Britain before mapping out the topography of the state beyond the core. Delineating the contours of the state in this way, as well as drawing on theoretical models and insights that have been developed in not only other disciplines but also in relation to other governance frameworks, provides new perspectives on perennial themes and issues. It also raises new questions about the role of the state, the capacity for collective action, the need to reflect on the logic of delegation vis-à-vis specific models or forms of democracy, and the need to politicize the logic of delegation by locating it back within the sphere of public contestation. As such the research presented in this book and the conceptual framework it develops will be of interest to scholars, practitioners and politicians around the world with an interest in multi-level governance, public policy, and democratic design.

Book The Racialisation of British Policing

Download or read book The Racialisation of British Policing written by Simon Holdaway and published by Bloomsbury Publishing. This book was released on 1996-03-06 with total page 226 pages. Available in PDF, EPUB and Kindle. Book excerpt: Drawing extensively on his own and others' research, Simon Holdaway argues that to understand manifestations of race within and outside the police, we need to analyse processes of racialisation previously ignored by the untheoretical emphases of much of criminology. Importantly, he analyses how 'race' is manifested within the organisational and cultural contexts of British policing. Laced with quotations from research, contemporary policy documents and other sources, this is a graphic and compelling account of racialised relations within police work which will appeal to students on a very wide range of social science degrees, from sociology to police studies.
