Download or read book OLAF at the Crossroads written by Constantin Stefanou and published by Bloomsbury Publishing. This book was released on 2011-08-31 with total page 227 pages. Available in PDF, EPUB and Kindle. Book excerpt: The authors offer many insights into the regulatory, operational and institutional opportunities and challenges for OLAF, the European Commission's Anti-Fraud Office. Since OLAF was set up in 1999, significant changes in its functional environment have taken place including in EU criminal law and especially in mutual assistance and substantive criminal law; the reconstruction of Eurojust and Europol through recent Regulations and Memoranda of Cooperation; and the entry into force of the Lisbon Treaty. The authors advance the view that OLAF's current legal framework must address these issues adequately. The approach they take is multi-disciplinary. OLAF is examined here through the prisms of EU politics and national, European and (to some extent) comparative law, focusing not only on the identification of current problems in regulation and procedure but also on its positioning within the context of European integration. Operational issues are then extensively discussed, making this a book for practitioners as well as policy makers and academics. The book addresses the theoretical and practical aspects of anti-fraud actions within both criminal and civil aspects of public law. Although OLAF works within an incomplete EU legal framework and with varying cooperation by national authorities, its staff have devised mechanisms that address some of these issues. Nevertheless, rules covering procedural and operational issues will need to be safeguarded within future legislation.
Download or read book After Madrid written by Great Britain. Parliament. House of Lords. European Union Committee and published by The Stationery Office. This book was released on 2005 with total page 208 pages. Available in PDF, EPUB and Kindle. Book excerpt: This report examines the EU's response to international terrorism after the Madrid bombings in March 2004, including the European Council declaration and the European Commission's proposals on data exchange and intelligence sharing between law enforcement authorities; data protection issues; EU institutional structures designed to combat terrorism; the international dimension, including the role of Interpol, data transfer and passports; terrorist financing and access to financial databases. Conclusions reached by the Committee include that the EU's role in combating terrorism should remain a co-ordinating one in support of the Member States, which must retain primary responsibility, and the EU should engage with international agencies, particularly Interpol. Given the range of interests involved, effective co-ordination, and the work of the EU Counter-terrorism Co-ordinator, are crucial, and the present proliferation of EU groups and agencies needs to be reduced and streamlined. A uniform data protection regime within the EU would not only provide better data protection but would also facilitate the exchange of information.
Download or read book A Constitutional Order of States written by Anthony Arnull and published by Bloomsbury Publishing. This book was released on 2011-03-03 with total page 688 pages. Available in PDF, EPUB and Kindle. Book excerpt: This collection celebrates the career of Professor Alan Dashwood, a leading member of the generation of British academics who organised, explained and analysed what we now call European Union law for the benefit of lawyers trained in the common law tradition. It takes as its starting point Professor Dashwood's vivid description of the European Union as a 'constitutional order of states'. He intended that phrase to capture the unique character of the Union. On the one hand, it is a supranational order characterised by its own distinctive institutional dynamics and an unprecedented level of cohesion among, and penetration into, the national legal systems. On the other hand, it remains an organisation of derived powers, the Member States retaining their character as sovereign entities under international law. This theme permeates both the constitutional and the substantive law of the Union. Contributors to the collection include members of the judiciary and distinguished practitioners, officials and academics. They consider the foundations, strengths, implications and shortcomings of this conceptual framework in various fields of EU law and policy. The collection is an essential purchase for anyone interested in the constitutional framework of the contemporary European Union.
Download or read book Information Sharing and Data Protection in the Area of Freedom Security and Justice written by Franziska Boehm and published by Springer Science & Business Media. This book was released on 2011-11-06 with total page 475 pages. Available in PDF, EPUB and Kindle. Book excerpt: Privacy and data protection in police work and law enforcement cooperation has always been a challenging issue. Current developments in EU internal security policy, such as increased information sharing (which includes the exchange of personal data between European law enforcement agencies and judicial actors in the area of freedom, security and justice (Europol, Eurojust, Frontex and OLAF)) and the access of EU agencies, in particular Europol and Eurojust, to data stored in European information systems such as the SIS (II), VIS, CIS or Eurodac raise interesting questions regarding the balance between the rights of individuals and security interests. This book deals with the complexity of the relations between these actors and offers for the first time a comprehensive overview of the structures for information exchange in the area of freedom, security and justice and their compliance with data protection rules in this field.
Download or read book EU Criminal Law written by Valsamis Mitsilegas and published by Bloomsbury Publishing. This book was released on 2009-03-16 with total page 561 pages. Available in PDF, EPUB and Kindle. Book excerpt: EU Criminal Law is perhaps the fastest-growing area of EU law. It is also one of the most contested fields of EU action, covering measures which have a significant impact on the protection of fundamental rights and the relationship between the individual and the State, while at the same time presenting a challenge to State sovereignty in the field and potentially reconfiguring significantly the relationship between Member States and the EU. The book will examine in detail the main aspects of EU criminal law, in the light of these constitutional challenges. These include: the history and institutions of EU criminal law (including the evolution of the third pillar and its relationship with EC law); harmonisation in criminal law and procedure (with emphasis on competence questions); mutual recognition in criminal matters (including the operation of the European Arrest Warrant) and accompanying measures; action by EU bodies facilitating police and judicial co-operation in criminal matters (such as Europol, Eurojust and OLAF); the collection and exchange of personal data, in particular via EU databases and co-operation between law enforcement authorities; and the external dimension of EU action in criminal matters, including EU-US counter-terrorism co-operation. The analysis is forward-looking, taking into account the potential impact of the Lisbon Treaty on EU criminal law.
Download or read book Conundrum written by Richard Bacon and published by Biteback Publishing. This book was released on 2013-06-18 with total page 244 pages. Available in PDF, EPUB and Kindle. Book excerpt: Government failure is affecting everyone. The single mum worried sick by a tax credit demand from HMRC to 'repay' thousands of pounds she never received; the family whose holiday was ruined because the Passport Office couldn't issue passports in time; the school that couldn't open at the start of term because CRB checks were being carried out by an organisation in meltdown; the farmers led to bankruptcy and even suicide by a Kafkaesque system for administering farm payments; and rail operators facing an uncertain future because the Department for Transport inadvertently landed the whole rail franchising system in chaos. Why is government getting it so wrong? Richard Bacon and Christopher Hope delve into the astonishing world of cock-ups and catastrophes and ponder why those at the top continue to fall short.

Download or read book Human Rights Protection in Europe written by Great Britain: Parliament: House of Lords: European Union Committee and published by The Stationery Office. This book was released on 2006-04-04 with total page 124 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Commission has proposed the creation of an EU Fundamental Rights Agency. The Agency's principal task will be to provide assistance and expertise to EU institutions and Member States when implementing Community and third pillar legislation. While it has been broadly welcomed by Member States, national human rights institutes and non-governmental organisations, there are concerns that the Agency's activities may overlap with those of other bodies in the field and more particularly, with the work of the Council of Europe. This Report discusses the extent to which duplication might arise. Chapter 3 looks at the geographic scope and remit of the Agency and considers the extent to which these will result in overlap with the Council of Europe. Aside from human rights bodies in general, there is the potential for duplication between the Agency and the proposed European Institute for Gender Equality. Chapter 4 discusses whether there is a need for two separate bodies or whether the Fundamental Rights Agency should be responsible for all fundamental rights and discrimination matters, including gender issues. Finally the Committee considers whether the Agency will be sufficiently independent from the Commission and the Council and makes recommendations as to the composition of the Agency's management and executive board.
