Book The Laws of Land Warfare

Download or read book The Laws of Land Warfare written by Donald A. Wells and published by Praeger. This book was released on 1992-12-04 with total page 232 pages. Available in PDF, EPUB and Kindle. Book excerpt: Although it is generally assumed that there have always been limits to what soldiers are permitted to do in war, it was not until 1863, in the heat of the Civil War, that the United States issued its first Army manual. Subsequently, manuals of land warfare were issued in 1914, 1934, 1940, 1944, 1956, and 1976 by the American military. In this volume, Wells provides a systematic examination of the evolution of American rules of warfare. In addition to providing the texts of key elements of the manuals and analyzing them, Wells relates the manuals to international attempts to set limits on war practices. This book will be invaluable to those concerned with military law, here and abroad, to students of international law, and to military policy makers.

Book excerpt: The purposes of the Law of War are the conduct of armed hostilities on land is regulated by the law of land warfare which is both written and unwritten. It is inspired by the desire to diminish the evils of war by: a. Protecting both combatants and noncombatants from unnecessary suffering; b. Safeguarding certain fundamental human rights of persons who fall into the hands of the enemy, particularly prisoners of war, the wounded and sick, and civilians; and c. Facilitating the restoration of peace. "The Law of Land Warfare" (FM 27-10) provides authoritative guidance to military personnel on the customary and treaty law applicable to the conduct of warfare on land and to relationships between belligerents and neutral States. Although certain of the legal principles set forth herein have application to warfare at sea and in the air as well as to hostilities on land, this Manual otherwise concerns itself with the rules peculiar to naval and aerial warfare only to the extent that such rules have some direct bearing on the activities of land forces.

Book The Ashgate Research Companion to Military Ethics

Download or read book The Ashgate Research Companion to Military Ethics written by James Turner Johnson and published by Routledge. This book was released on 2016-03-23 with total page 587 pages. Available in PDF, EPUB and Kindle. Book excerpt: This Companion provides scholars and graduates, serving and retired military professionals, members of the diplomatic and policy communities concerned with security affairs and legal professionals who deal with military law and with international law on armed conflicts, with a comprehensive and authoritative state-of-the-art review of current research in the area of military ethics. Topics in this volume reflect both perennial and pressing contemporary issues in the ethics of the use of military force and are written by established professionals and respected commentators. Subjects are organized by three major perspectives on the use of military force: the decision whether to use military force in a given context, the matter of right conduct in the use of such force, and ethical responsibilities beyond the end of an armed conflict. Treatment of issues in each of these sections takes account of both present-day moral challenges and new approaches to these and the historical tradition of just war. Military ethics, as it has developed, has been a particularly Western concern and this volume reflects that reality. However, in a globalized world, awareness of similarities and differences between Western approaches and those of other major cultures is essential. For this reason the volume concludes with chapters on ethics and war in the Islamic, Chinese, and Indian traditions, with the aim of integrating reflection on these approaches into the broad consideration of military ethics provided by this volume.

Book 21st Century U S Military Law of War Deskbook JAG Textbook on History and Framework of Law of War Legal Bases for Use of Force Geneva Conventions War Crimes Human Rights Comparative Law

Download or read book 21st Century U S Military Law of War Deskbook JAG Textbook on History and Framework of Law of War Legal Bases for Use of Force Geneva Conventions War Crimes Human Rights Comparative Law written by U. S. Army and published by . This book was released on 2017-12-31 with total page 174 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Judge Advocate General Law of War Deskbook provides coverage of the history and framework of the law of war, the legal basis for the use of force, Geneva Conventions on the wounded and sick in the field, Prisoners of War, Civilians in the Battlefield, Occupation and Post-conflict governance, means and methods of warfare, war crimes and command responsibility, human rights, and comparative law. Military operations involve complex questions related to international law. This body of law provides the framework for informed operational decisions, establishes certain limitations on the scope and nature of command options, and imposes affirmative obligations related to the conduct of U.S. forces. Commanders rely on Judge Advocates to understand fundamental principles of international law, translate those principles into an operational product, and articulate the essence of the principles when required. This Law of War Deskbook is intended to replace, in a single bound volume, similar individual outlines that had been distributed as part of the Judge Advocate Officer Graduate and Basic Courses and the Operational Law of War Course. Together with the Operational Law Handbook and Law of War Documentary Supplement, these three volumes represent the range of international and operational law subjects taught to military judge advocates. Our audience is the beginning and intermediate level practitioner; our hope is that this material will provide a solid foundation upon which further study may be built.

Download or read book Customary International Humanitarian Law written by Jean-Marie Henckaerts and published by Cambridge University Press. This book was released on 2005-03-03 with total page 610 pages. Available in PDF, EPUB and Kindle. Book excerpt: Customary International Humanitarian Law, Volume I: Rules is a comprehensive analysis of the customary rules of international humanitarian law applicable in international and non-international armed conflicts. In the absence of ratifications of important treaties in this area, this is clearly a publication of major importance, carried out at the express request of the international community. In so doing, this study identifies the common core of international humanitarian law binding on all parties to all armed conflicts. Comment Don:RWI.

Book The Commander s Handbook on the Law of Land Warfare FM 6 27 MCTP 11 10C

Download or read book The Commander s Handbook on the Law of Land Warfare FM 6 27 MCTP 11 10C written by Headquarters Department Of The Army and published by Lulu.com. This book was released on 2019-09-17 with total page 204 pages. Available in PDF, EPUB and Kindle. Book excerpt: DOD policy requires "[m]embers of the DoD Components comply with the law of war during all armed conflicts, however such conflicts are characterized, and in all other military operations" (Department of Defense Directive [DODD] 2311.01E). This publication addresses topics that are also addressed in the DOD Law of War Manual. In the event of a conflict or discrepancy regarding the legal standards addressed in this publication and the DOD Law of War Manual, the latter takes precedence. In many cases, any apparent conflict or discrepancy may be due to this publication's efforts to provide guidance to Commanders by describing legal concepts more generally rather than exhaustively as found the DOD Law of War Manual. In certain instances, this publication will set out a current policy or practice for Army and Marine forces rather than a legal requirement.
