Download or read book Effects of Insurance on Maritime Liability Law written by Muhammad Masum Billah and published by Springer Science & Business Media. This book was released on 2014-01-07 with total page 330 pages. Available in PDF, EPUB and Kindle. Book excerpt: The book examines how the absence of insurance in the past led to some special maritime liability law principles such as ‘general average’ (i.e., losses or expenses shared by all the parties to a maritime adventure) and the limitation of shipowners’ liability. In the absence of insurance, these principles served the function of insurance mostly for shipowners. As commercial marine insurance is now widely available, these principles have lost their justification and may in fact interfere with the most important goal of liability law i.e., deterrence from negligence. The work thus recommends their abolition. It further argues that when insurance is easily available and affordable to the both parties to a liability claim, the main goal of liability law should be deterrence as opposed to compensation. This is exactly the case with the maritime cargo liability claims where both cargo owners and shipowners are invariably insured. As a result, the sole focus of cargo liability law should be and to a great extent, is deterrence. On the other hand in the vessel-source oil pollution liability setting, pollution victims are not usually insured. Therefore oil pollution liability law has to cater both for compensation and deterrence, the two traditional goals of liability law. The final question the work addresses is whether the deterrent effect of liability law is affected by the availability of liability insurance. Contrary to the popular belief the work attempts to prove that the presence of liability insurance is not necessarily a hindrance but can be a complementary force towards the realization of deterrent goal of liability law.

Download or read book Constructing Crime written by Janet Mosher and published by UBC Press. This book was released on 2010-05-10 with total page 227 pages. Available in PDF, EPUB and Kindle. Book excerpt: Constructing Crime examines why particular behaviours are defined and enforced as crimes and particular individuals are targeted as criminals. Contributors interrogate notions of crime, processes of criminalization, and the deployment of the concept of crime in five areas the enforcement of fraud against welfare recipients and physicians, the enforcement of laws against Aboriginal harvesting practices, the perceptions of disorder in public housing projects, and the selective criminalization of gambling. These case studies and an afterword by Marie-Andre Bertrand challenge us to consider just who is rendered criminal and why.
Download or read book Environmental Law in Canada written by Jamie Benidickson and published by Kluwer Law International B.V.. This book was released on 2020-01-14 with total page 234 pages. Available in PDF, EPUB and Kindle. Book excerpt: Derived from the renowned multi-volume International Encyclopaedia of Laws, this book provides ready access to legislation and practice concerning the environment in Canada. A general introduction covers geographic considerations, political, social and cultural aspects of environmental study, the sources and principles of environmental law, environmental legislation, and the role of public authorities. The main body of the book deals first with laws aimed directly at protecting the environment from pollution in specific areas such as air, water, waste, soil, noise, and radiation. Then, a section on nature and conservation management covers protection of natural and cultural resources such as monuments, landscapes, parks and reserves, wildlife, agriculture, forests, fish, subsoil, and minerals. Further treatment includes the application of zoning and land-use planning, rules on liability, and administrative and judicial remedies to environmental issues. There is also an analysis of the impact of international and regional legislation and treaties on environmental regulation. Its succinct yet scholarly nature, as well as the practical quality of the information it provides, make this book a valuable resource for environmental lawyers handling cases affecting Canada. Academics and researchers, as well as business investors and the various international organizations in the field, will welcome this very useful guide, and will appreciate its value in the study of comparative environmental law and policy.

This book was released on 2005 with total page 544 pages. Available in PDF, EPUB and Kindle. Book excerpt: This atlas is aimed at collecting, compiling and desseminating information on mental health resources in the world. It presents updated and expanded information from 192 countries with analyses of global and regional trends as well as individual country profiles. Newly included in this volume is a section on epidemiology within the profiles of all low and middle income countries. It shows that mental health resources within most countries remain inadequate despite modest improvments since 2001. Availability of mental health resources across countries and between regions remains substantially uneven, with many countries having few resources. The atlas reinforces the urgent need to enhance mental health resources within countries.

Download or read book The Palgrave Handbook of Criminal and Terrorism Financing Law written by Colin King and published by Springer. This book was released on 2018-05-04 with total page 1247 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Palgrave Handbook of Criminal and Terrorism Financing Law focuses on how criminal and terrorist assets pose significant and unrelenting threats to the integrity, security, and stability of contemporary societies. In response to the funds generated by or for organised crime and transnational terrorism, strategies have been elaborated at national, regional, and international levels for laws, organisations and procedures, and economic systems. Reflecting on these strands, this handbook brings together leading experts from different jurisdictions across Europe, America, Asia, and Africa and from different disciplines, including law, criminology, political science, international studies, and business. The authors examine the institutional and legal responses, set within the context of both policy and practice, with a view to critiquing these actions on the grounds of effective delivery and compliance with legality and rights. In addition, the book draws upon the experiences of the many senior practitioners and policy-makers who participated in the research project which was funded by a major Arts and Humanities Research Council grant. This comprehensive collection is a must-read for academics and practitioners alike with an interest in money laundering, terrorism financing, security, and international relations.
