  • Pages : 305 pages

Available in PDF, EPUB and Kindle. Book excerpt: The History of Michigan Law offers the first serious survey of Michigan's rich legal past. Michigan was among the first states to admit African-Americans and women to its law schools and was the first governmental entity to abolish the death penalty. Additionally, the state, unlike its midwestern neighbors, did not enact racial exclusion laws in the post-Civil War era. Michigan has also played a leading role in developing modern rape laws, in protecting the environment, and in assuring the right to counsel for those accused of crimes. The story of Michigan's legal development includes high profile cases such as the Dr. Ossian Sweet murder trial, the cross-district busing case Milliken v. Bradley, and the affirmative action cases brought against the University of Michigan Law School. The History of Michigan Law documents and analyzes, as well, Michigan legal develpments in environmental history, civil rights, and women's history. This book will serve as the entry point for all future studies that involve the law in Michigan. With 2005 marking the bicentennial of the establishment of the Michigan Supreme Court, as well as the bicentennial of the creation of the Michigan Territory, The History of Michigan Law has appeal beyond the legal community to scholars and students of American history. Book Do Exclusionary Rules Ensure a Fair Trial

Download or read book Do Exclusionary Rules Ensure a Fair Trial written by Sabine Gless and published by Springer. This book was released on 2019-04-17 with total page 387 pages. Available in PDF, EPUB and Kindle. Book excerpt: This open access publication discusses exclusionary rules in different criminal justice systems. It is based on the findings of a research project in comparative law with a focus on the question of whether or not a fair trial can be secured through evidence exclusion. Part I explains the legal framework in which exclusionary rules function in six legal systems: Germany, Switzerland, People’s Republic of China, Taiwan, Singapore, and the United States. Part II is dedicated to selected issues identified as crucial for the assessment of exclusionary rules. These chapters highlight the delicate balance of interests required in the exclusion of potentially relevant information from a criminal trial and discusses possible approaches to alleviate the legal hurdles involved.

Download or read book An Ethics of Interrogation written by Michael Skerker and published by University of Chicago Press. This book was released on 2010-04-12 with total page 269 pages. Available in PDF, EPUB and Kindle. Book excerpt: The act of interrogation, and the debate over its use, pervades our culture, whether through fictionalized depictions in movies and television or discussions of real-life interrogations on the news. But despite daily mentions of the practice in the media, there is a lack of informed commentary on its moral implications. Moving beyond the narrow focus on torture that has characterized most work on the subject, An Ethics of Interrogation is the first book to fully address this complex issue. In this important new examination of a controversial subject, Michael Skerker confronts a host of philosophical and legal issues, from the right to privacy and the privilege against compelled self-incrimination to prisoner rights and the legal consequences of different modes of interrogation for both domestic criminal and foreign terror suspects. These topics raise serious questions about the morality of keeping secrets as well as the rights of suspected terrorists and insurgents. Thoughtful consideration of these subjects leads Skerker to specific policy recommendations for law enforcement, military, and intelligence professionals.

Book Looking for Love in the Legal Discourse of Marriage

Download or read book Looking for Love in the Legal Discourse of Marriage written by Renata Grossi and published by ANU Press. This book was released on 2014-09-01 with total page 182 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book examines the (in)visibility of romantic love in the legal discourse surrounding modern Australian marriage. It looks at how romantic love has become a core part of modernity, and a dominant part of the Western marriage discourse, and considers how the ideologies of romantic love are (or are not) replicated in the legal meaning of marriage. This examination raises two key issues. If love has become central to people’s understanding of marriage, then it is important for the legitimacy of law that love is reflected in both the content and application of the law. More fundamentally, it requires us to reconsider how we understand law, and to ask whether it is engaged with emotions, or separate from them. Along the way this book also considers the meaning of love itself in contemporary society, and asks whether love is a radical force capable of breaking down conservative meanings embedded in institutions like marriage, or whether it simply mirrors them. This book will be of interest to everyone working on love, marriage and sexuality in the disciplines of law, sociology and philosophy.
