Book excerpt: This report is the Home Affairs Committee's response to the House's invitation of 15 July 2013, together with the Justice and European Scrutiny Committees, to submit a report by the end of October 2013 relevant to the exercise of the block opt-out of pre-Lisbon Treaty EU police and criminal justice measures, before the start of negotiations between the Government and the European Commission, Council and other EU member states on measures which the UK wishes to rejoin following exercise of the block opt-out. The Government has given notification of its intention to exercise the block opt-out. Its right to do so, and the conditions attached to the exercise of that right, are contained in Article 10 of Protocol 36 annexed to the EU Treaties. The block opt-out covers 130 EU police and criminal justice measures which had been adopted prior to 1 December 2009, the date of the entry into force of the Lisbon Treaty. The Committee has also set out: (i) That there are many problems with the European Arrest Warrant, in its existing form, in particular that it is on a system of mutual recognition of legal systems which in reality vary significantly; (ii) The Committee welcomes and supports the Government's reform package for the arrest warrant; (iii) The Committee recommends separate votes on the arrest warrant to the rest of the opt-in package at an early stage to provide a parliamentary mandate for the Government's negotiations.; (iv) The Committee concludes that if the Government proceeds with the opt-in as proposed, it will not result in any repatriation of powers. Indeed, the increased jurisdiction of the European Court of Justice may result in a net flow of powers in the opposite direction.

Book excerpt: The Committee's inquiry addresses concerns that the operation of libel laws and the impact of costs were stifling press freedom. It also considers the balance between personal privacy and press freedom, and the increasing use of injunctions and super-injunctions. It also examines press standards in the UK, particularly considering Madeleine McCann's disappearance, the suicides in and around Bridgend in 2008 and phone hacking and blagging. The Committee does not consider that it would be right to legislate on privacy. The Press Complaints Commission (PCC) should amend its Code to include a requirement that journalists notify the subject of their articles prior to publication, subject to a "public interest" test. The report also assesses the damage so called 'libel tourism' has caused to the UK's reputation as a country which protects free speech and freedom of expression. In cases where the UK is not the primary domicile or place of business of the claimant or defendant, the claimant should face additional hurdles before being allowed to bring a case. There is an urgent need to control defamation litigation costs more effectively. Competitive and commercial factors led to an inexcusable lowering of press standards in the gathering and publishing of 'news' about the McCann case, and self-regulation signally failed. The PCC should be renamed the Press Complaints and Standards Commission, reflecting its role as a regulator, not just a complaints handling service. The regulator should have the power to fine its members where it believes that the departure from the Code of Practice is serious enough to warrant a financial penalty.

Book excerpt: The Commons Home Affairs Committee "deplores" News International's attempt to "deliberately thwart" the original investigation into phone hacking in 2005-06 but also states that the police set aside a huge amount of material that could have identified other perpetrators and victims. The committee agrees with John Yates's own assessment that his 2009 review of this investigation was "very poor", that he did not ask the right questions and that he was guilty of a "serious misjudgement". The committee criticises Andy Hayman's cavalier attitude towards his contacts with those in News International who were under investigation which, even if entirely above board, risked seriously undermining confidence in the impartiality of the police, and accuses him of deliberate prevarication in order to mislead the committee. It urges the swift and thorough investigation of allegations that payments were made to police officers by the media, which will help to establish whether or not such payments may have influenced police inquiries into phone hacking. The committee welcomes DAC Sue Akers's decision to contact all potential victims of phone hacking by the News of the World as part of the current investigation, but is alarmed that only 170 have as yet been informed. At this rate it would take years to inform all of the several thousands of people potentially affected. The committee therefore recommends that extra resources are allocated to her investigation, by the Government directly if necessary. The committee also expresses concern about both the scope and understanding of current laws on phone hacking, with prosecutors and police still arguing over the meaning of relevant sections of the Regulation of Investigatory Powers Act 2000. However, this was no reason for the Metropolitan Police to limit their investigation of these matters. Finally, potential victims of phone hacking should be given a means of seeking formal advice from the Information Commissioner and easier access to redress. The Information Commissioner should be given additional powers to deal with breaches of data protection, including phone hacking and blagging. Mobile phone companies should give greater prominence to security advice in the information provided to their customers. The report sets out 24 conclusions and recommendations.
