They will probably always result in compromises. The question is whom or what the compromises are about? The focus in the present volume has been set on a detailed examination of some legal preconceptions commonly found in situations of mass refugee in-migration. The author concludes that situations when refugees arrive en masse do not, as a rule, qualify as a public emergency that threatens the life of the nation under contemporary international human rights law, and that mass expulsion of refugees as an emergency measure is prohibited at all times when this entails the risk of violating rights immune to derogation.

Based on extensive interviews and an original survey of 1,200 local Serbs and ethnic Serbian refugees fleeing violent conflict in Bosnia and Croatia, The Politics of Social Ties argues that those immigrants who form close interpersonal networks with others who share their experiences, such as the loss of family, friends, and home, in addition to the memory of ethnic violence from past wars, are more likely to vote for nationalist parties. Any political mobilization occurring within these interpersonal networks is not strategic, rather, individuals engage in political discussion with people who have a greater capacity for mutual empathy over the course of discussing other daily concerns. This book adds the dimension of ethnic identity to the analysis of individual political behavior, without treating ethnic groups as homogeneous social categories. It adds valuable insight to the existing literature on political behavior by emphasizing the role of social ties among individuals.

Yet, IDPs are protected only by the soft-law Guiding Principles on Internal Displacement at the global level. Instead of a dedicated international organization, IDPs receive protection and assistance only through the UN’s cluster approach. Orchard argues that while an international IDP protection regime exists, many aspects of it are informal, with IDP issues bound up in a humanitarian regime complex that divides the mandates of key organizations and even the question of IDP status itself. While the Guiding Principles mark an important step forward, implementation of laws and policies based on them at the domestic level remains haphazard. Action at the international level similarly reflects an all-too-often ad hoc approach to IDP issues. Through an in-depth examination of IDP efforts at the international level and across the forty states which have adopted IDP laws and policies, Orchard argues that while progress has been made, new and greater monitoring and accountability mechanisms at both the domestic and international levels are critical. This work will be valuable to scholars, students, and practitioners of forced migration, international relations theory, and the Responsibility to Protect doctrine.
