My Thesis is that the construction of the Grand Ethiopian Renaissance Dam poses no threat to Egypt and in this paper, I will provide a historical and geographical overview of the geopolitical conflict, followed by an explanation of the treaties that Egypt has invoked to date. I will then provide an overview of Ethiopia's legal development since 1959. At the end, I will then draw an appropriate conclusion. The following provides a geographical overview of the Nile River basin. According to an article in the New York Times "Without the Nile, there is no Egypt." (Walsh & Sengupta, 2020). The construction in 2011 of the largest dam "Grand Ethiopian Renaissance Dam" also known as GERD has caused dispute for centuries between Egypt and Ethiopia, which despite several negotiations, also with the African Union as a mediator, cannot agree on the utilization of the dam. Egypt obtains most of the water it needs from the Nile which flows from Lake Tana in Ethiopia into the Blue Nile and from Lake Victoria originating in the White Nile, which crosses the borders of Kenya, Uganda and Tanzania. Ethiopia on the other side is one of the countries with one of the fastest growing economies in Africa, at the same time over half of the population in the country live without electricity, which could be remedied by the construction and use of the dam. However, Egypt fears that Ethiopia could now gain control over the flow of the river, citing an old Anglo-Egyptian colonial treaty signed between the United Kingdom and Egypt on behalf of Ethiopia in 1929 that promises Egypt veto power and rights over the distribution and use of the Nile waters to this day.

The Nile is an essential source of water for domestic, industrial and agricultural uses throughout the basin, yet for more than a century it has been at the centre of continuous and conflicting claims and counter-claims to rights of utilization of the resource. In this book the author examines the multifaceted legal regulation of the Nile. He re-constructs the legal and historical origin and functioning of the British Nile policies in Ethiopia by examining the composition of the Anglo-Ethiopian Treaty of 1902, and analyses its ramifications on contemporary riparian discourse involving Ethiopia and Sudan. The book also reflects on two fairly established legal idioms - the natural and historical rights expressions – which constitute central pillars of the claims of downstream rights in the Nile basin; the origin, essence and legal authority of the notions has been assessed on the basis of the normative dictates of contemporary international watercourses law. Likewise, the book examines the non-treaty based claims of rights of the basin states to the Nile waters, setting out what the equitable uses principle entails as a means of reconciling competing riparian interests, and most importantly, how its functioning affects contemporary legal settings. The author then presents the concentrated diplomatic movements of the basin states in negotiations on the Transitional Institutional Mechanism of the Nile Basin Initiative (NBI) - pursued since the 1990’s, and explains why the substance of water use rights still continued to be perceived diversely among basin states. Finally, the specific legal impediments that held back progress in negotiations on the Nile Basin Cooperative Framework are presented in context.

Book excerpt: As part of a Symposium on the book The Economic Foundations of International Law, this Article briefly compares and contrasts two distinct analytical approaches to international law - doctrinal versus economic - in the context of Egypt's and Ethiopia's dispute over the right to exploit the Nile River's water resources. The Article argues that the traditional doctrinal approach, one based solely on an examination of international water law, treaties, and customary international law is unlikely to result in a legal conclusion that either state is likely to respect because such an approach fails to consider the incentives, material capabilities, and national interests of Egypt and Ethiopia. However, the Article argues that an economics approach focusing on state preferences and incentives for compliance with international law in a world without a central enforcement mechanism will better illuminate the obstacles that Egypt and Ethiopia face and the likelihood of legal resolution of the conflict. After examining the interests and political constraints on both states, the Article concludes with a simple application of transaction costs economics, focusing on property rights and liability rules, to understand how Egypt and Ethiopia might respond to different legal arrangements designed to resolve the conflict.

Book excerpt: Aksum and Nubia assembles and analyzes the textual and archaeological evidence of interaction between Nubia and the Ethiopian kingdom of Aksum, focusing primarily on the fourth century CE. Although ancient Nubia and Ethiopia have been the subject of a growing number of studies in recent years, little attention has been given to contact between these two regions. Hatke argues that ancient Northeast Africa cannot be treated as a unified area politically, economically, or culturally. Rather, Nubia and Ethiopia developed within very different regional spheres of interaction, as a result of which the Nubian kingdom of Kush came to focus its energies on the Nile Valley, relying on this as its main route of contact with the outside world, while Aksum was oriented towards the Red Sea and Arabia. In this way Aksum and Kush coexisted in peace for most of their history, and such contact as they maintained with each other was limited to small-scale commerce. Only in the fourth century CE did Aksum take up arms against Kush, and even then the conflict seems to have been related mainly to security issues on Aksum’s western frontier. Although Aksum never managed to hold onto Kush for long, much less dealt the final death-blow to the Nubian kingdom, as is often believed, claims to Kush continued to play a role in Aksumite royal ideology as late as the sixth century. Aksum and Nubia critically examines the extent to which relations between two ancient African states were influenced by warfare, commerce, and political fictions. The River Nile has been seen by many as the most important river in the world, and the secrets of the sources of the Nile and their mysteries have, from the dawn of civilization, attracted philosophers, emperors and explorers searching for answers. The source of the Blue Nile, Gish Abay, is believed to be the outlet of the biblical river Gihon, flowing directly from Paradise, linking this world with Heaven. The holiness of Abay (the Blue Nile) and its source in particular still has an important role in the Ethiopian Orthodox Church. In the Lake Tana region, there are also numerous other myths, traditions and rituals concerning the river. Several of the island monasteries are incredibly holy, and indigenous practices and sacrifices to the river are still conducted. The most important celebration in the Ethiopian Orthodox Church is the Timkat festival, which is an annual commemoration of the importance of baptism. Despite the importance of the River Nile from antiquity to present-day practices and beliefs in Ethiopian Orthodox Christianity, very little research has been conducted on the cultural and religious aspects of the Blue Nile in general and its source, Gish Abay, and Lake Tana in Ethiopia in particular. This book combines historic sources and new empirical ethnography, presenting parts of this cultural heritage and the traditions of water along the Blue Nile.
