Book excerpt: Ten years before the start of the American Revolution, backcountry settlers in the North Carolina Piedmont launched their own defiant bid for economic independence and political liberty. The Regulator Rebellion of 1766-71 pitted thousands of farmers, many of them religious radicals inspired by the Great Awakening, against political and economic elites who opposed the Regulators' proposed reforms. The conflict culminated on May 16, 1771, when a colonial militia defeated more than 2,000 armed farmers in a pitched battle near Hillsborough. At least 6,000 Regulators and sympathizers were forced to swear their allegiance to the government as the victorious troops undertook a punitive march through Regulator settlements. Seven farmers were hanged. Using sources that include diaries, church minutes, legal papers, and the richly detailed accounts of the Regulators themselves, Marjoleine Kars delves deeply into the world and ideology of free rural colonists. She examines the rebellion's economic, religious, and political roots and explores its legacy in North Carolina and beyond. More than thirty men were killed in assassinations, lynchings, ambushes, street fights, and pitched battles. The sheriff of Harrison County was murdered, and so was the founder of Marshall, as well as a former district judge. Senator Robert Potter, a signer of the Texas Declaration of Independence, was slain by Regulators near his Caddo Lake home. Courts ceased to operate and anarchy reigned in Shelby County, Panola District, and Harrison County. Only the personal intervention of President Sam Houston and an invasion of the militia of the Republic of Texas halted the bloodletting. The Regulator-Moderator War was the first and largest—in numbers of participants and fatalities—of the many blood feuds of Texas, and Bill O'Neal's book is the first detailed account of this feud. He has included numerous photographs, maps to help the reader to identify various locations of specific events, and rosters of names of the Regulator and Moderator factions arranged by the counties in which the individuals were associated—along with a roster of the victims of the war.

In this book, Andrei Shleifer argues that the ubiquity of regulation can be explained not so much by the failure of markets as by the failure of courts to solve contract and tort disputes cheaply, predictably, and impartially. When courts are expensive, unpredictable, and biased, the public will seek alternatives to dispute resolution. The form this alternative has taken throughout the world is regulation. The Failure of Judges and the Rise of Regulators gathers Shleifer's influential writings on regulation and adds to them a substantial introductory essay in which Shleifer critiques the standard theories of economic regulation and proposes "the Enforcement Theory of Regulation," which sees regulation as the more efficient strategy for social control of business. Subsequent chapters present the theoretical and empirical case against the efficiency of courts, make the historical and theoretical case for the comparative efficiency of regulation, and offer two empirical studies suggesting circumstances in which regulation might emerge as an efficient solution to social problems. Shleifer does not offer an unconditional endorsement of regulation and its expansion but rather argues that it is better than its alternatives, particularly litigation.

It is important to consider how this process can be improved in order to better allocate resources, time, and efforts to improve public health. Regulating Medicines in a Globalized World: The Need for Increased Reliance Among Regulators considers the role of mutual recognition and other reliance activities among regulators in contributing to enhancing public health. This report identifies opportunities for leveraging reliance activities more broadly in order to potentially impact public health globally.
