Book Third Party Funding in International Arbitration

Download or read book Third Party Funding in International Arbitration written by Lisa Bench Nieuwveld and published by Kluwer Law International B.V.. This book was released on 2016-04-24 with total page 330 pages. Available in PDF, EPUB and Kindle. Book excerpt: Since the first edition of this invaluable book in 2012, third-party funding has become more mainstream in international arbitration practice. However, since even the existence of a third-party funding agreement in a dispute is often kept secret, it can be difficult to glean the specifics of successful funding agreements. This welcome book, now updated, expertly reveals the nuances of third-party funding in international arbitration, examines the phenomenon in key jurisdictions, and provides a reliable resource for users and potential users that may wish to tap into and make use of this distinctive funding tool. Focusing on Australia, the United Kingdom, the United States, Germany, the Netherlands, Canada, and South Africa, the authors analyze and assess the legal regime based upon legislation, judicial opinions, ethics opinions, and practitioner anecdotes describing the state of third-party funding in each jurisdiction. In addition to updating summaries of the law of the various jurisdictions, the second edition includes a new chapter addressing third-party funding in investor-state arbitration. Among the issues raised and examined are the following: · payment of adverse costs; · “Before-the-Event” (BTE) and “After-the-Event” (ATE) insurance; · attorney financing: pro bono representation, contingency representation, conditional fee arrangements; · loans; · ethical doctrines affecting the third-party funding industry; · possible future bundling, securitization, and trading of legal claims; · risk that the funder may put its own interests ahead of the client’s interests; and · whether the existence of a funding agreement must or should be disclosed to the decision maker. The second edition also includes discussion of recent institutional developments as they relate to third-party funding, including the work of the ICCA-Queen Mary Task Force on Third-Party Funding and how third-party funding is being incorporated into arbitral rules and investment treaties. Ably providing a thorough understanding of what third-party funding entails and what legal parameters exist, this book will be of compelling interest to parties aiming to take advantage of the high values, speed, reduced evidentiary costs, outcome predictability, industry expertise, and high award enforceability characteristic of the third-party funding arrangements available in international arbitration.

Book Families and Food in Hard Times

Download or read book Families and Food in Hard Times written by Rebecca O’Connell and published by UCL Press. This book was released on 2021-05-24 with total page 288 pages. Available in PDF, EPUB and Kindle. Book excerpt: Food is fundamental to health and social participation, yet food poverty has increased in the global North. Adopting a realist ontology and taking a comparative case approach, Families and Food in Hard Times addresses the global problem of economic retrenchment and how those most affected are those with the least resources. Based on research carried out with low-income families with children aged 11-15, this timely book examines food poverty in the UK, Portugal and Norway in the decade following the 2008 financial crisis. It examines the resources to which families have access in relation to public policies, local institutions and kinship and friendship networks, and how they intersect. Through ‘thick description’ of families’ everyday lives, it explores the ways in which low income impacts upon practices of household food provisioning, the types of formal and informal support on which families draw to get by, the provision and role of school meals in children’s lives, and the constraints upon families’ social participation involving food. Providing extensive and intensive knowledge concerning the conditions and experiences of low-income parents as they endeavour to feed their families, as well as children’s perspectives of food and eating in the context of low income, the book also draws on the European social science literature on food and families to shed light on the causes and consequences of food poverty in austerity Europe.

Download or read book Children Act 1989 written by Sally Gore and published by Family Law Publications. This book was released on 2011 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: The UK's Children Act 1989, Pt III ('Local Authority Support for Children and Families') has considerable relevance both as an area of UK law in its own right, but also, increasingly, to practitioners in the field of child law. The recent threats to public funding in the more traditional areas of family work have led many practitioners to seek to broaden their experience in different areas. Judicial review in the field of child law is one area that has seen an increase in interest for child specialists. In addition, an understanding of the duties imposed on UK local authorities to provide services to children and families is becoming increasingly important to those representing local authorities, children, and parents in public law proceedings, where the need for these services is often seen to arise. This book will act as a useful companion, both for those making decisions on behalf of local authorities and their advisers, and also for child law practitioners more generally.

Book The Psychology of Quality of Life

Download or read book The Psychology of Quality of Life written by M. Joseph Sirgy and published by Springer Nature. This book was released on 2021-06-09 with total page 804 pages. Available in PDF, EPUB and Kindle. Book excerpt: The third, thoroughly revised and enhanced edition of this bestselling book analyses and discusses the most up-to-date research on the psychology of quality of life. The book is divided into six parts. The introductory part lays the philosophical and academic foundation of much of the research on wellbeing and positive mental health, showing the beneficial effects of happy people at work, health, and to society at large. Part 2 (effects of objective reality) describes how sociocultural factors, income factors, other demographic factors, and biological and health conditions affect wellbeing and positive mental health. Part 3 focuses on subjective reality and discusses how individuals process information from their objective environment, and how they manipulate this information that affects wellbeing and positive mental health. Part 4 focuses on the psychology of quality of life specific to life domains, while Part 5 reviews the research on special populations: children, women, the elderly, but also the disabled, drug addicts, prostitutes, emergency personnel, immigrants, teachers, and caregivers. The final part of the book focuses on theories and models of wellbeing and positive mental health that integrate and unify disparate concepts and programs of research. The book addresses the importance of the psychology of quality of life in the context of public policy and calls for a broadening of the approach in happiness research to incorporate other aspects of quality of life at the group, community, and societal levels. It is of topical interest to academics, students and researchers of quality of life, well-being research, happiness studies, psychotherapy, and social policy.
