Book excerpt: The collection of poems is an intriguing reflection of the sometimes torturous evolution of inner self which so many South Africans face as they struggle to find who they are in a multicultural society that espouses the values of traditional culture while reaching for the promise of a global community. Thus the blend of Xhosa and English as Ntsiki strives to merge her modern views with cultural roots. She feels strongly the need to reclaim her culture and language and blend them within the context of a cosmopolitan society. She captures the vibe and energy of young South Africa and its blossoming as well as its quandaries. Ntsiki does not hesitate to deal with controversial and painful issues, such as rape, and her work challenges the reader to stop and think, really think. The quest for self expression and self-understanding echoes throughout the book and through it, she exhorts the reader to have the courage to explore and understand himself. Underlying many poems is the unspoken but burning desire that, by telling the truth, she will create possibilities for others to do the same. In many ways, Wena is a celebration of life. The poems brim over with Ntsikis own desire to drink to the full and then go out there and pour love and life out into the world. The manner in which she distills meaning and value from the negative is perhaps best expressed in her own words, from the poem, I choose life:

Book The Reasons Requirement in International Investment Arbitration

Download or read book The Reasons Requirement in International Investment Arbitration written by Guillermo Alvarez and published by BRILL. This book was released on 2008-08-31 with total page 379 pages. Available in PDF, EPUB and Kindle. Book excerpt: This collection of essays emerged from a seminar on international investment law taught jointly by the editors at the Yale Law School . The participants brought a rich experience and, as important for a subject like this, a rich national diversity. A considerable part of the seminar involved close reading of recent international investment arbitral awards. These decisions have emerged as the most important engines of legal development in this field. Interestingly, in almost all instances, it was felt that the right decision had been reached. But without the building blocks that reasons reflect, one could not reconstruct or “reverse engineer” the reasoning of the tribunal. From this experience, it was concluded that it would be a useful exercise to examine the adequacy of reasons in some of the most important recent international investment law awards in order to see if there were significant trends with policy implications. The studies in this collection represent the best of the seminar.

Book Scything Time

  • Publisher : Partridge Africa

  • Pages : 197 pages

Download or read book Scything Time written by Alan Hall and published by Partridge Africa. This book was released on 2015-01-07 with total page 197 pages. Available in PDF, EPUB and Kindle. Book excerpt: I believe that I will make a better future, is a popular notion of political, religious, educational and business leaders. To believe is to think that something is true or real. This does not mean it is true. Beliefs become opinions, which are fixed and non-negotiable. It is difficult to exchange ideas when a sentence starts with I believe and there is no backup of fact. The belief is irrelevant and the behaviour will determine the state of the future. Western leadership drowns in greed, entitlement, belief and gross ignorance, while those who follow, scrabble for the remnants of bad behaviour. Zionism is a quasi Christian/Jewish belief that has distorted behaviour for 3000 years. Western leaders do not understand that unshared wealth is a crime against humanity.

Book Applicable Law in International Investment Disputes

Download or read book Applicable Law in International Investment Disputes written by Taida Begic and published by Eleven International Publishing. This book was released on 2005 with total page 269 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book gives a comprehensive overview of all relevant aspects of the issue of applicable substantive law in the context of investor/State arbitration. It is a comparative survey of both the International Center for Settlement of Investment Disputes (ICSID) and non-ICSID arbitral practice. The applicable substantive law represents an important issue in investment disputes as it determines the rules of law that should be applied to the merits of the dispute. This study demonstrates the need for a discussion on the applicable law before examining the merits of the case, as it appears to be non-existent in most arbitral awards. The author gives an extensive survey of choice of law clauses as found in direct agreements between parties and in multilateral or bilateral investment treaties. Furthermore, the author analyzes the following issues: stabilization clauses in investment agreements, the application of the residual rule (if parties failed to agree on the applicable law), the special position of the Iran-US Claims Tribunal and various annulment decisions.

Book ICSID Convention after 50 Years Unsettled Issues

Download or read book ICSID Convention after 50 Years Unsettled Issues written by Crina Baltag and published by Kluwer Law International B.V.. This book was released on 2017-02-15 with total page 642 pages. Available in PDF, EPUB and Kindle. Book excerpt: The International Centre for Settlement of Investment Disputes (ICSID) has played a leading role in establishing the field of foreign investment law. It is primarily due to the ICSID that it is no longer peculiar for individuals and corporations to have legal standing in claims against governments — probably the most notable development of international law of the last half century. Now, in its fiftieth year and ratified by more than 150 states, the ICSID received in 2015 its 500th case. This book celebrates this anniversary with an overview and analysis of ICSID case law to date and, focusing particularly on unsettled issues, assesses possible developments in the institution’s next phase. This volume collects twenty-two essays by prominent practitioners with substantial experience in investment arbitration law. The topics they cover encompass such issues as the following: • the political and economic reasons behind the creation of the ICSID; • admissibility and jurisdiction; • ICSID vis-à-vis bilateral investment treaties; • States’ concerns about the ‘partiality’ of arbitrators in favour of investors; • applicable laws under the ICSID Convention; • fact-finding rules; • conflicting interpretations of ICSID Convention provisions; • interaction of foreign investment and economic development; • value of ICSID awards in the light of EU law; • annulment of ICSID awards; • effects of denunciation (Bolivia, Ecuador, Venezuela) and non-contracting States (Russia, Brazil, India); • attribution of conduct of State-owned enterprises (SOEs); • counterclaims; • guarantees against political risk; and • allocation of costs. As a detailed response to the question whether ICSID has contributed as promised to an improvement in the investment climate and promoted the flow of private foreign capital — and as an assessment of the present and future feasibility of the ICSID system for the resolution of investment disputes by arbitration and conciliation — this book has no peers. Considering the current crisis of investment law, the book’s immediate value not only to investors and their counsel but also to practitioners and academics in the field of investment law and arbitration and public international law cannot be overstated. Dr Crina Baltag is the author of Kluwer’s 2012 book The Energy Charter Treaty: The Notion of Investor and the Associate Editor of Kluwer Arbitration Blog.

The academic literature has grown in response and there have been several theoretical and empirical advances. Whilst concentrating on the economic literature, the articles also approach the topic from a psychological, sociological and political point of view. Part One focuses on a range of theoretical developments, Part Two on empirical measurements of the effectiveness of eco-labelling, Part Three on the factors that influence the success and design of eco-labelling programmes and Part Four on the effects of eco-labelling on international trade and development.

Book Africa s International Investment Law Regimes

Download or read book Africa s International Investment Law Regimes written by Won Kidane and published by Oxford University Press. This book was released on 2023 with total page 657 pages. Available in PDF, EPUB and Kindle. Book excerpt: "Decolonization restored African states' sovereign independence. The post-colonial period was, however, characterized by major economic disruptions that resulted in chronically weakened economies. The newly independent African states faced a profound dilemma between economic liberalization and openness on the one hand, and the maintenance of regulatory autonomy on the other. Confronted with unrelenting poverty and inadequate infrastructure, African states needed direct foreign investment to boost their economies. However, most foreign investors were cautious about investing in African countries due to the perceived lack of clear and predictable legal regimes necessary to protect foreign investments from expropriation and other forms of harm"--

Book Botsotso 17 Fiction Poetry Art Work Essays Reviews

Download or read book Botsotso 17 Fiction Poetry Art Work Essays Reviews written by Kolski Horwitz and published by African Books Collective. This book was released on 2016-12-29 with total page 272 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Botsotso literary journal started in 1996 as a monthly 4 page insert in the New Nation, an independent anti-apartheid South African weekly and reached over 80,000 people at a time largely politisized black workers and youth with a selection of poems, short stories and short essays that reflected the deep changes taking place in the country at that time. Since the closure of the New Nation in 1999, the journal has evolved into a stand-alone compilation featuring the same mix of genres, and with the addition of photo essays and reviews. The Botsotso editorial policy remains committed to creating a mix of voices which highlight the diverse spectrum of South African identities and languages, particularly those that are dedicated to radical expression and examinations of South Africa's complex society. Botsotso 17 reflects the depth and creative range of the South African cultural and emotional environment, as well as the broader social currents in which they were spawned; and that the coexisting phenomena of love and violence, alienation and precious comings-together mingle to create a unique, if familiar, panorama as streams of words reveal the inner meanings of so many different lives.
