Book excerpt: Far from being a measure of progress or humanitarian aid, Indian welfare policy in Canada was used deliberately to oppress and marginalize First Nations peoples and to foster their assimilation into the dominant society. 'Enough to Keep Them Alive' explores the history of the development and administration of social assistance policies on Indian reserves in Canada from confederation to the modern period, demonstrating a continuity of policy with roots in the pre-confederation practices of fur trading companies. Extensive archival evidence from the Indian Affairs record group at the National Archives of Canada is supplemented for the post-World War Two era by interviews with some of the key federal players. More than just an historical narrative, the book presents a critical analysis with a clear theoretical focus drawing on colonial and post-colonial theory, social theory, and critiques of liberalism and liberal democracy.

Using case studies from Australia and Canada, it discusses aboriginal child welfare in historical and comparative perspectives and critically examines recent legal reforms and changes in the design, management and delivery of child welfare services aimed at securing the 'decolonization' of aboriginal children and families. Within this context, the author identifies the limitations of reconciling the conflicting demands of self-determination and sovereignty and suggests that international law can provide more nuanced and culturally sensitive solutions. Referring to the UN Declaration on the Rights of Indigenous Peoples, and the UN Convention on the Rights of the Child, it is argued that the effective decolonization of aboriginal child welfare requires a journey well beyond the single issue of child welfare to the heart of the debate over self-government, self-determination and sovereignty in both national and international law.

In 1958, the federal government leased part of the small Musqueam Reserve in Vancouver to an exclusive golf club at below market value. When the band members discovered this in 1970, they initiated legal action. Their tenacity led to the 1984 decision in Guerin v. The Queen, whereby the Supreme Court of Canada held that the government has a fiduciary duty towards Indigenous peoples. Jim Reynolds, who served as one of the legal counsel for the Musqueam, provides an in-depth analysis of this landmark case and its impact on Canadian law, politics, and society. By recognizing that the Musqueam had enforceable legal rights, the Guerin case changed the relationship between governments and Indigenous peoples from one of wardship to one based on legal rights. It was a seismic decision.
