Book Military Weapons and Environment

Download or read book Military Weapons and Environment written by Wing Commander (Dr) Umesh Chandra Jha and published by KW Publishers Pvt Ltd. This book was released on 2017-10-15 with total page 358 pages. Available in PDF, EPUB and Kindle. Book excerpt: Armed conflicts have become more complicated, with the emphasis shifting towards new weapons such as drones, cybercrime and autonomous weapons. In July 2017, the UN General Assembly adopted the Treaty on the Prohibition of Nuclear Weapons. This treaty prohibits a full range of nuclear-weapon-related activities, such as undertaking to develop, test, produce, manufacture, acquire, possess or stockpile nuclear weapons or other nuclear explosive devices, as well as the use or threat of use of these weapons. The ongoing conflicts have shown that the consequences of the use of explosive weapons are not limited to death, physical injury and disability, but also include long-term impacts on mental well-being. The use of improvised weapons by States and non-State actors is an area of concern for the environment. Every State must, therefore, ensure that weapons used by their armed forces are explicitly adjudged under International Humanitarian Law (IHL) and Human Rights Law. While reviewing a new weapon, the States must adopt multilateral approaches, drawing upon relevant legal, health, environmental and military expertise. This book describes the environmental effects of eight weapons and explosive remnants of war that have caused extensive environmental harm in the recent past. It also makes specific recommendations addressed to the international community and the States for protecting the natural environment from the impact of weapons of war. This book will contribute towards a better understanding of the environmental harm caused by military weapons.

Book Building a Just World Order

Download or read book Building a Just World Order written by Alfred de Zayas and published by SCB Distributors. This book was released on 2021-10-01 with total page 359 pages. Available in PDF, EPUB and Kindle. Book excerpt: In 2011, the UN Human Rights Council created the mandate of the Independent Expert on the Promotion of a Democratic and Equitable International Order. This book, based on the reports by Dr. Alfred de Zayas, the first mandate-holder (2012-2018), offers a brilliant and comprehensive critique of the UN system, addressing the changes that must be made in order to further the emergence of a democratic and equitable international order. De Zayas proposes concrete reforms of the UN system, notably the Security Council. He advocates recognition of peace as a human right, slashing military budgets, and establishing the right of self-determination as a conflict-prevention measure. As it concerns the global economy, he calls for reversing the adverse impacts of World Bank and International Monetary Fund policies, rendering free-trade agreements compatible with human rights, abolishing tax havens and ISDS, alleviating the foreign debt crisis, and criminalizing war-profiteers and pandemic vultures. He denounces unilateral coercive measures, economic sanctions and financial blockades, because they demonstrably have led to hundreds of thousands of deaths. "Alfred de Zayas is a gifted human rights lawyer who, alongside Jakob Moller, pioneered the development of UN human rights jurisprudence. He was a dynamic Special Rapporteur, as is evidenced by his Principles for a Democratic and Equitable International Order." --BERTRAND RAMCHARAN, Acting UN High Commissioner for Human Rights 2002-2004 "The 25 Zayas Principles of International Order are a modern Magna Carta. If implemented by the international community, they would help ensure peace with social justice in the 21st century. Pursuant to the UN Charter member States bear responsibility for future generations. Hence, they should take concrete measures to achieve this rules-based order in international solidarity." --Maria Fernanda Espinosa, President of the 73rd session of the UN General Assembly, 2018-19 "Zayas proposes a new functional paradigm of human rights for all. His elaboration on principles and on how to apply international law uniformly is a welcome contribution to a necessary debate on the foundations of a just international order." --Professor Dr. Carlos Correa, University of Buenos Aires, Executive Director of South Centre

Book excerpt: The end of the twentieth century, which was marked by multiparty democracy in Eastern European entities and Third World countries, moved Cte dIvoire to adhere to the new democratization system in 1990. Nine years later, the territory registered its first bloodless state coup. On September 19, 2002, the country was shared into two parts with human losses and damages when President Gbagbo was on official visit to Italy. After different attempts in negotiations (Linas-Marcoussis (2003), Pretoria agreement (2005), and the Political Agreement of Ouagadougou (2007)), for some protagonists, international organizations and NGOs, the perfect conflict resolution was about running elections so that the former peaceful land could regain its image of a prosperous and stable country. The elections that were delayed six times came to pass, and two presidents came out of the scrutiny. Gbagbo was proclaimed victorious by the Ivorian Constitutional Council, while Ouattara was acknowledged by the Independent Electoral Commission. Once more, the country fell into a postelection crisis. Meanwhile, the African Union, the European Union, the USA, the French Licorne, and the United Nations urged President Gbagbo to step down since Ouattara was considered the happy winner of the scrutiny. The refusal of Gbagbo cost human losses and led to his arrest on April 11, 2011. Nowadays, the country is not unified and reconciled, but it will have the 2015 elections.

Book The United Nations Principles to Combat Impunity A Commentary

Download or read book The United Nations Principles to Combat Impunity A Commentary written by Frank Haldemann and published by Oxford University Press. This book was released on 2018-03-21 with total page 592 pages. Available in PDF, EPUB and Kindle. Book excerpt: The fight against impunity has become a growing concern of the international community. Updated in 2005, the UN Set of Principles for the Protection and Promotion of Human Rights Through Action to Combat Impunity is the fruit of several years of study, developed under the aegis of the UN Commission on Human Rights and then affirmed by the Human Rights Council. These Principles are today widely accepted as constituting an authoritative reference point for efforts in the fight against impunity for gross human rights abuses and serious violations of international humanitarian law. As a comprehensive attempt to codify universal accountability norms, the UN Set of Principles marks a significant step forward in the debate on the obligation of states to combat impunity in its various forms. Bringing together leading experts in the field, this volume provides comprehensive academic commentary of the 38 principles. The book is a perfect companion to the document, setting out the text of the Principles alongside detailed analysis, as well as a full introduction and a guide to the relevant literature and case law. The commentary advances debates and clarifies complex legal issues, making it an essential resource for legal academics, students, and practitioners working in fields such as human rights, international criminal law, and transitional justice.
