Book excerpt: The empty chair crisis of 1965, resolved in the Luxembourg Compromise of 1966, forms part of the dramatic past of the European Union, and is for many a turning-point in European political integration. This volume, based on new research, revisits these events. It sheds fresh light on the mixed motives of the principal member states, European institutions and third-country actors, and identifies the shadows cast over subsequent legal and political practice. The book results from a collaborative project among historians, lawyers, and political scientists. It draws on new archival material and on many insights from practitioners, both some involved in the events of 1965-66 and others engaged in subsequent negotiations in the Council of the EU. Traces of these events persist in the consensus-oriented culture in the Council, where a concern to avoid sharply polarised confrontation limits recourse to active voting, even though the formal use of qualified majority voting has been greatly extended. Arguments over agricultural policy, the EU budget and world trade negotiations thus continue to provide occasions for some member states to insist on their 'very important interests'. This book stems from a co-funded project of the Fondation Paul-Henri Spaak in Brussels and of the European University Institute and the Historical Archives of the European Union in Florence.

A significant upshot of these issues is that the concept of European identity - defined in terms of such factors as culture, history and economics - has supplanted the long-dominant theme of 'widening and deepening, ' particularly since the Union's expansion has become primarily eastward. The major contribution of this important book lies in its analysis of the conceptualization and perception of enlargement from various points of view, focusing on the concerns of stakeholders and the 'identity' conflicts and uncertainties incurred by enlargement initiatives. In the course of its presentation, it details the actual pre-accession Europeanization process and its complex history. Among the key elements discussed are the following: the conflict between 'widening' and 'deepening' and the effect on EU institutional reform; institutional requirements on candidate countries; pre-accession criteria and negotiations; administrative capacity, judicial capacity, and legal approximation in accession states; capacity of the EU to absorb new Member States; and EC law as part of European identity. Also covered are specific historical details of particular pre-accession negotiations (e.g., Greece, Spain, Portugal, Malta, and Cyprus), the still inconclusive negotiations with Turkey and the Western Balkan states, and political factors involved in the non-accession of Norway, Iceland and Switzerland. Assembling powerful evidence and applying incisive analysis, the author's conclusion shows that, absent further (and major) EU institutional reform, it will be difficult for an enlarging Union to continue to 'deliver the goods.' Scharpf's renowned model of the 'joint-decision trap' suggestes that the requirements of (nearly) unanimous decisions in the EU's Council of Ministers, combined with conflicting preferences among member governments, will systematically limit the problem-solving effectiveness of European policies. However, certain conditions have significantly changed in the 25 years since the theory was first posited. In particular, the unanimity rule has been replaced by qualified-majority voting in most issue areas, and successive rounds of enlargement have augmented the diversity of member state interests and preferences. This volume examines the continued relevance of the model. It presents a comparative study on the differential politics in EU policies. Looking at the political dynamics in an array of EU activities, it analyses breakthroughs as well as stalemates and asks why leaps occur in some areas whilst blockages characterise others. The dynamics that allow the EU to escape various forms of decision trap are analysed in-depth, including those suggested by 'rationalist' theorists (supranational-hierarchical steering, treaty-base games, and arena shifting) and those suggested by 'constructivist' approaches (socialisation). The volume concludes that when the EU is confronted with a high degree of problem pressure in a given issue area, these mechanisms will often not be available because most remain outside politicians' immediate grasp.

Older frameworks for understanding have been challenged, while the outlines of new ones are only now beginning to emerge. This book looks to history to provide a more durable explanation of the nature and legitimacy of European governance going forward. Through detailed examination of certain fundamental but often overlooked elements in EU history, Peter Lindseth describes the convergence of European integration around the 'postwar constitutional settlement of administrative governance.' 'Administrative' here does not mean 'non-political' or 'technical'-it means that supranational regulatory authority should properly be seen as 'delegated' from national constitutional bodies. As such, supranational policymaking has relied to a significant degree on forms of oversight by national executives, legislatures, and judiciaries, following models of 'mediated legitimation' first developed in the administrative state and then translated into the European context. These national mechanisms developed specifically to overcome the core disconnect in European integration-between exercises of otherwise autonomous supranational regulatory 'power,' on the one hand, and the persistence of the nation-state as the primary source of democratic and constitutional 'legitimacy' in the European system, on the other. It has been through recourse to the legitimating structures and normative principles of the postwar constitutional settlement, this study shows, that European public law has sought to reconcile 'Europe' and the nation-state for more than fifty years.
