To a large extent they will serve that purpose, as the fountains feed the streams; but the reason that they should be published and put in the hands of the general reader, and of students and practitioners of the law, is chiefly that they are the mirror of the events of by far the most interesting period of our American life. These are therefore not merely decided cases to be used as dull precedents with which to win causes. That is their minor function. Their chief use here is the picture they give of the colonial period in all its shades and aspects, and that they make the observer see what the more detailed narrative of history fails to tell, of those brooding times of the States. Moreover, the publisher has not been content to reproduce simply a statement of the cases, the argu ments of counsel, and the decisions of the courts, recorded in these manuscripts near one hundred and eighty years ago. Printed by themselves they do not seem to appeal sufficiently to the imagination to be pre sented fully in the light in which they should be viewed. The eighteen years of the London Company's existence saw the erection on the banks of the James of the first permanent English settlement in the Western Hemisphere; the meeting at Jamestown of the earliest representative assembly to convene within the present area of the United States; the establishment of the first civil and criminal courts; the first trial by jury; the first grant of separate titles to land; the planting of the first staple crops; the manufacture of the first merchantable articles; the building of the first church; and the construction of the first dwelling-house. The era of Nathaniel Bacon made up another interval of supreme importance, for it was then that the first armed blow on a large scale was struck on American soil for the preservation of the rights of the common people and for their equality before the law. Subsequently, it was during the administrations of Culpeper and Effingham that the Virginians contended, with indomitable courage and persistence, for the inherited, and inalienable, and sole right of their General Assemblies to impose taxes and originate the measures necessary for the proper government of their local affairs. And next, it was during the administrations of Spotswood and Gooch that the first great movement of population westward began, never to pause until the shores of the Pacific were reached; and it was during this interval, also, that the' Dissenters carried on their noble struggle for religious liberty, which was to end, at a later day, in a splendid triumph. And, finally, it was during the administrations of Din widdie and Fauquier that the expansion of the French Power towards the Alleghanies was permanently halted. All these dramatic and pregnant episodes were, by their transmitted influence, to make a profound impression on the character and career of the great Republic which now dominates the Western Hemisphere, and they are, there fore, entitled to a discriminating study as much from a national, as from a Virginian, point of view. I have not lost sight of' this larger significance in my treatment of the different aspects of my central theme, whether it deals with the facts in the ordinary current of events, or with the qualities of the men who played the chief part during the years of the colonial period. Book excerpt: Excerpt from Executive Journals of the Council of Colonial Virginia, Vol. 1: June 11, 1680-June 22, 1699 That full copies were not sent over to England is inferred from the fact that the two orders given in the Appendix (see pp. 536 and dated 1680 and 1683, respectively, are not found among the proceed ings for those years transmitted in regular course, but in a paper con taining copy of the proceedings of the Council from September 25, 1680, to April 22, 1707, in reference to the boundaries of Virginia and North Carolina, sent over in 1708. With copies of these two orders were then sent copies of orders on the same subject dated 1688, 1690, and 1691, already transmitted. Evidently the Council did not at first think the omitted orders of sufficient importance to copy for trans mission, but changed their minds when the question of the boundary between Virginia and North Carolina became a burning one. Either that, or Mr. Secretary Jennings, who by order was also required to send important information to England, thought it best in 1708 to transmit copies of all orders of the Virginia Council in reference to the Virginia - North Carolina boundary. The inference that there were omissions in the copies of proceed ings sent to England is also drawn from the fact that the Randolph Manuscript has abstracts of items not in the transcripts now being received from England, which must have been obtained by the com piler of the original Bland Manuscript from the original journals and not from the other record books of the Council in existence at the time the compilation was made. This hypothesis accounts also for the lack of strict chronological order of the entries, which is a notice able peculiarity of the text. The procedure probably was that the clerk of the Council copied the items he thought important and then, if on re-perusal of the journals he was convinced that something of value had escaped his attention made good the omission without re-copying the whole. After this, no doubt, on his reading to the Council for their approval what he had copied, the members and the Governor would call attention to still other items that might be considered of sufficient importance to copy for transmission. The Monthly or County Courts.--The most important inferior court was the one regularly held in each county. It was at first known as the monthly court, but it was afterwards given the English name of county court. The first monthly courts were established as early as 1624. At that time it was provided by an act of assembly that courts should be held every month in the corporations of Charles City and Elizabeth City.1 The creation of these courts was the necessary outcome of the rapid growth of the colony which began in 1619. When the cleared areas began to lengthen along the river and to encroach more and more on the wilderness, it became very inconvenient for those colonists living at a distance from James City to go there for the arbitration of their minor differences. The need of local adjudication in small matters naturally became felt first in the more remote settlements, and, as one would expect, the first two monthly courts were established on the eastern and western frontiers. The jurisdiction of the county courts was limited to petty cases coming up from the precincts immediately adjacent to them, and thus the judicial authority of the governor and council was, for a considerable part of the country, left unimpaired. 1 In an address made before the Virginia Bar Association in 1894, Judge Waller Staples said that monthly courts were first established in 1623. This statement is based on a law passed by the assembly in 1624; the mistake in the date arises, I presume, from an erroneous reading of "1623-4," which is given by Hening as the date of the act.
