En effet, pour que la protection des victimes soit une réalité et non une intention, il est nécessaire et conforme à nos principes de présumer qu’un mari violent est un père dangereux, c’est-à-dire de prendre en compte la violence dans la conjugalité pour garantir la protection dans la parentalité. Cela signifie que l’exercice de l’autorité parentale ne doit pas être attribué au violent conjugal mais confié exclusivement au parent victime. Cela signifie aussi que si des rencontres entre l’enfant et le violent conjugal sont organisées, elles doivent se dérouler sous contrôle social pour garantir la protection de l’enfant.
