Available in PDF, EPUB and Kindle. Book excerpt: In this volume Livio Melina attempts to overcome the deadlock in which moral theology can easily find itself due to the false alternative between moralism, with its emphasis on external rules, and antimoralism, with its insistence on freedom from all norms. The key, Melina argues here, is not to regard morality as a simple list of principles directing our choices and helping us to make correct moral judgments. Rather, we must step back and begin to comprehend the dynamic mystery of Christian action. Only in the light of Christ can the proper correlation between faith and morality, freedom and truth, be clearly understood. True morality springs from a synergistic relationship with God, born of faith in Christ, nurtured in the church, and made manifest in that which inspires all authentic goodness -- the epiphany of love.

Book Homicide Justified

Download or read book Homicide Justified written by Andrew Fede and published by University of Georgia Press. This book was released on 2017 with total page 362 pages. Available in PDF, EPUB and Kindle. Book excerpt: This comparative study looks at the laws concerning the murder of slaves by their masters and at how these laws were implemented. Andrew T. Fede cites a wide range of cases--across time, place, and circumstance--to illuminate legal, judicial, and other complexities surrounding this regrettably common occurrence. These laws had evolved to limit in different ways the masters' rights to severely punish and even kill their slaves while protecting valuable enslaved people, understood as "property," from wanton destruction by hirers, overseers, and poor whites who did not own slaves. To explore the conflicts of masters' rights with state and colonial laws, Fede shows how slave homicide law evolved and was enforced not only in the United States but also in ancient Roman, Visigoth, Spanish, Portuguese, French, and British jurisdictions. His comparative approach reveals how legal reforms regarding slave homicide in antebellum times, like past reforms dictated by emperors and kings, were the products of changing perceptions of the interests of the public; of the individual slave owners; and of the slave owners' families, heirs, and creditors. Although some slave murders came to be regarded as capital offenses, the laws con-sistently reinforced the second-class status of slaves. This influence, Fede concludes, flowed over into the application of law to free African Americans and would even make itself felt in the legal attitudes that underlay the Jim Crow era.

Book The Roman Inquisition

  • Author : Thomas F. Mayer
  • Publisher : University of Pennsylvania Press
  • Release : 2015-04-15
  • ISBN : 0812246551

Download or read book The Roman Inquisition written by Thomas F. Mayer and published by University of Pennsylvania Press. This book was released on 2015-04-15 with total page 368 pages. Available in PDF, EPUB and Kindle. Book excerpt: Few legal events loom as large in early modern history as the trial of Galileo. Frequently cast as a heroic scientist martyred to religion or as a scapegoat of papal politics, Galileo undoubtedly stood at a watershed moment in the political maneuvering of a powerful church. But to fully understand how and why Galileo came to be condemned by the papal courts--and what role he played in his own downfall--it is necessary to examine the trial within the context of inquisitional law. With this final installment in his magisterial trilogy on the seventeenth-century Roman Inquisition, Thomas F. Mayer has provided the first comprehensive study of the legal proceedings against Galileo. By the time of the trial, the Roman Inquisition had become an extensive corporatized body with direct authority over local courts and decades of documented jurisprudence. Drawing deeply from those legal archives as well as correspondence and other printed material, Mayer has traced the legal procedure from Galileo's first precept in 1616 to his second trial in 1633. With an astonishing mastery of the legal underpinnings and bureaucratic workings of inquisitorial law, Mayer's work compares the course of legal events to other possible outcomes within due process, showing where the trial departed from standard procedure as well as what available recourse Galileo had to shift the direction of the trial. The Roman Inquisition: Trying Galileo presents a detailed and corrective reconstruction of the actions both in the courtroom and behind the scenes that led to one of history's most notorious verdicts.

Available in PDF, EPUB and Kindle. Book excerpt: Despite its relevance to the subsequent development of Western Islamic studies, the intellectual contribution of early modern Catholicism is still an under-researched area. The aim of this volume is to fill this gap, offering a series of essays dealing with the study of the Qur’an and Arabic language in early modern Catholic Europe. Focusing on the circulation of manuscripts, translations and printed books, the essays highlight how Catholic Orientalism contributed to the birth and spread of Western Islamic studies, although sometimes it was still directed towards religious polemics. Among the protagonists of this period of Islamic studies, the volume will focus on Catholic priests, missionaries, religious orders (Jesuits, Franciscans, Carmelites) Eastern Christians, converts, and other prominent figures in the Catholic culture of the time. Special attention will be given to the work of Ludovico Marracci, author of a fundamental edition of the Arabic text and Latin translation of the Qur’an with an introduction, notes, refutations and religious and linguistic insights. The volume is of interest to an audience of specialists and non-specialists interested both in Islamic and Qur'anic studies and in the history of modern Catholicism, missions, and Orientalism
