Book Interpretation of Law in the Global World From Particularism to a Universal Approach

Download or read book Interpretation of Law in the Global World From Particularism to a Universal Approach written by Joanna Jemielniak and published by Springer Science & Business Media. This book was released on 2010-04-08 with total page 378 pages. Available in PDF, EPUB and Kindle. Book excerpt: Capturing the Change: Universalising Tendencies in Legal Interpretation Joanna Jemielniak and Przemys aw Mik aszewicz International and supranational integration on the European continent, as well as the harmonisation of the rules of international trade and the accompanying dev- opment and global popularity of the resolution of commercial disputes through arbitration, constantly exerts a considerable in uence on modern legal systems. The sources of each of these phenomena are different, and their action is dissimilar. Each can be described as reaching either from the top to the bottom, through the direct involvement of interested States and consequently affecting their internal legal s- tems (international and supranational integration; harmonisation of trade regulations through public international law instruments), or bottom-up, as a result of activity by private parties, leading to the achievement of uniform practices and standards (ar- tration, lex mercatoria). Nonetheless, they both enrich national legal cultures and contribute to transgressing the limits of national (local) particularisms in creating, interpreting and applying the law. The aim of this book is to demonstrate how these processes have in uenced the interpretation of law, how they have shaped the methods and techniques of the interpretation and with what consequences for the outcomes of the interpretative procedures. In assessing the extent of this in uence, due regard must be paid to the fact that the interpretation of law is not, in principle, directly determined by the provisions of law itself.

Book Trauma and Meaning Making

Download or read book Trauma and Meaning Making written by Danielle Schaub and published by BRILL. This book was released on 2023-10-20 with total page 271 pages. Available in PDF, EPUB and Kindle. Book excerpt: Trauma and Meaning Making highlights multiple practices of meaning making after traumatic events in the lives of individuals and communities. Meaning making consists both in a personal journey towards a new way to exist and live in a world shattered by trauma and in public politics locating and defining what has happened. In both perspectives, the collection evaluates the impact achieved by naming the victim/s and thus the right of the victim/s to suffer from its aftermath or by refusing to recognise the traumatic event and thus the right of the victim/s to respond to it. A range of paradigms and techniques invite readers to consider anew the specificities of context and relationship while negotiating post-traumatic survival. By delineating how one makes sense of traumatic events, this volume will enable readers to draw links between practices grounded in diverse disciplines encompassing creative arts, textual analysis, public and collective communication, psychology and psychotherapy, memory and memorial.

Available in PDF, EPUB and Kindle. Book excerpt: Evita, Inevitably sheds new light on the history and culture of Argentina by examining the performances and reception of the country’s most iconic female figures, in particular, Eva Perón, who rose from poverty to become a powerful international figure. The book links the Evita legend to a broader pattern of female iconicity from the mid-nineteenth century onward, reading Evita against the performances of other female icons: Camila O’Gorman, executed by firing squad over her affair with a Jesuit priest; Difunta Correa, a devotional figure who has achieved near-sainthood; cumbia-pop performer Gilda; the country’s patron saint, the Virgin of Luján; and finally, Argentina’s president, Cristina Fernández de Kirchner. Employing the tools of discursive, visual, and performance analysis, Jean Graham-Jones studies theatrical performance, literature, film, folklore, Catholic iconography, and Internet culture to document the ways in which these “femicons” have been staged.

Book excerpt: Essays by a modern Jesuit martyr challenge the way that theology should be done and the gospel should be lived. Ignacio Ellacur a, a Spanish Jesuit theologian, philosopher, and rector of the University of Central America in San Salvador, was one of the key intellectual authors of liberation theology. On November 16, 1989 he and other members of the Jesuit community of the university were massacred by Salvadoran army troops. This volume offers twelve important essays by Ellacur a, at last providing English-speaking readers with a comprehensive introduction to his theological thought. Traditional topics such as Christology, ecclesiology, theological method, and spirituality are interwoven with reflections on colonialism, liberation, religion and politics, the philosophy of Xavier Zubiri, and the legacy of Archbishop Oscar Romero in a volume that not only chronicles the thought of one of the most fertile minds of the last century, but challenges the way theology should be carried out for the century to come.
