Book excerpt: La caractéristique du droit de la rupture du contrat de travail est qu'elle est réglée par une multitude de disciplines : par le social qui a ses aspirations, par l'économie qui a ses contraintes, par le civil et ses règles grandissantes relevant de l'éthique de l'exercice raisonnable ou normal du droit. Le droit actuel, dans toutes ses branches, tend à déterminer les conditions de l'exercice normal du droit en vue de sanctionner son exercice anomal et ce sous des vocables divers : abus de droit, exécution de bonne foi, principe de proportionnalité, standards de comportements, légitimes anticipations des droits d'autrui, etc. « Irrésistible ascension du principe de proportionnalité », écrit Paul Martens ; mais aussi irrésistibles ascensions de la théorie de l'abus de droit et du principe de l'exécution de bonne foi. C'est à ces empreintes civilistes que les auteurs ont notamment consacré l'ouvrage. L'ouvrage a pour ambition de tenter d'adapter la rigidité formelle du droit à une plus juste rupture du contrat de travail. Perdre son emploi, c'est non seulement perdre sa principale source de revenus mais c'est aussi être atteint dans sa dignité d'être humain. C'est parfois aussi perdre son logement, son conjoint, son statut social, autant d'effets collatéraux qui sont souvent oubliés par ceux qui ne subissent pas la rupture du contrat : l'employeur, l'avocat ou le juge qui, tenu d'appliquer la loi, perd parfois de vue les réalités sociales. Le droit de la rupture du contrat de travail ne peut plus être qu'une affaire d'indemnités. Il doit, aussi, être affaire de dignité et de sanction juste. La première partie est consacrée à l'analyse de la théorie de l'abus de droit, à son fondement, on apparition et à ses critères. La seconde porte sur l'exigence de motif valable de licenciement en droit international. La troisième concerne le licenciement abusif de l'ouvrier, le contenu de l'article 63 de la loi du 3 juillet 1978 relative aux contrats de travail, ses conditions d'application notamment en relation avec le droit international et sa finalité, la portée qui lui est donnée par les cours et tribunaux, ses relations avec le droit civil, ses modes de preuve et ses sanctions. La quatrième aborde la problématique du licenciement abusif de l'employé réglée par les grands principes de droit civil confrontés aux caractéristiques propres du droit de licenciement de l'employé.

The results of this work were sent to the European Commission and have already been published in French. The English translation is now being published by sellier.elp. This work could contribute to the wider European project. The part on the guiding principles could be a component of the CFR, in the form of "black letter" model rules or recitals. The part on terminology is, in itself, useful for the elaboration of the final various linguistic versions of the CFR. It finds its place within the materials which will accompany the model rules. Last but by no means least, the revised version of the PECL should be considered by the European institutions as an alternative set of model rules on contract law.

Book excerpt: In Socialism of Fools, Michele Battini focuses on the critical moment during the Enlightenment in which anti-Jewish stereotypes morphed into a sophisticated, modern social anti-Semitism. He recovers the potent anti-Jewish, anticapitalist propaganda that cemented the idea of a Jewish conspiracy in the European mind and connects it to the atrocities that characterized the Jewish experience in the nineteenth and twentieth centuries. Beginning in the eighteenth century, counter-Enlightenment intellectuals and intransigent Catholic writers singled out Jews for conspiring to exploit self-sustaining markets and the liberal state. These ideas spread among socialist and labor movements in the nineteenth century and intensified during the Long Depression of the 1870s. Anti-Jewish anticapitalism then migrated to the Habsburg Empire with the Christian Social Party; to Germany with the Anti-Semitic Leagues; to France with the nationalist movements; and to Italy, where Revolutionary Syndicalists made anti-Jewish anticapitalism the basis of an alliance with the nationalists. Exemplified best in the Protocols of the Elders of Zion, the infamous document that "leaked" Jewish plans to conquer the world, the Jewish-conspiracy myth inverts reality and creates a perverse relationship to historical and judicial truth. Isolating the intellectual roots of this phenomenon and its contemporary resonances, Battini shows us why, so many decades after the Holocaust, Jewish people continue to be a powerful political target.
