Book Denial of Justice in International Law

Download or read book Denial of Justice in International Law written by Jan Paulsson and published by Cambridge University Press. This book was released on 2005-10-06 with total page 307 pages. Available in PDF, EPUB and Kindle. Book excerpt: Denial of justice is one of the oldest bases of liability in international law and the modern understanding of denial of justice is examined by Paulsson in this book, which was originally published in 2005. The possibilities for prosecuting the offence of denial of justice have evolved in fundamental ways and it is now settled law that States cannot disavow international responsibility by arguing that their courts are independent of the government. Even more importantly, the doors of international tribunals have swung wide open to admit claimants other than states: non-governmental organisations, corporations and individuals, and Paulsson examines several recent cases of great importance in his book.

  • ISBN : 0197630227
  • Pages : 369 pages

Download or read book Undocumented Saints written by William A. Calvo-Quirós and published by Oxford University Press. This book was released on 2022 with total page 369 pages. Available in PDF, EPUB and Kindle. Book excerpt: Undocumented Saints follows the migration of popular saints from Mexico into the US and the evolution of their meaning. The book explores how Latinx battles for survival are performed in the worlds of faith, religiosity, and the imaginary, and how the socio-political realities of exploitation and racial segregation frame their popular religious expressions. It also tracks the emergence of inter-religious states, transnational ethnic and cultural enclaves unified by faith. The book looks at five vernacular saints that have emerged in Mexico and whose devotions have migrated into the US in the last one hundred years: Jesús Malverde, a popular bandido turned saint caudillo; Santa Olguita, an emerging feminist saint linked to border women's experiences of sexual violence; Juan Soldado, a murder-rapist soldier who is now a patron for undocumented immigrants and the main suspect in the death of an eight-year-old victim known now as Santa Olguita; Toribio Romo, a Catholic priest whose ghost/spirit has been helping people cross the border into the US since the 1990s; and La Santa Muerte, a controversial personification of death who is particularly popular among LGBTQ migrants. Each chapter contextualizes a particular popular saint within broader discourses about the construction of masculinity and the state, the long history of violence against Latina and migrant women, female erasure from history, discrimination against non-normative sexualities, and as US and Mexican investment in the control of religiosity within the discourses of immigration.

Download or read book Investor State Arbitration written by Christopher F. Dugan and published by Oxford University Press. This book was released on 2011-11-25 with total page 818 pages. Available in PDF, EPUB and Kindle. Book excerpt: Investor-State Arbitration describes the increasing importance of international investment and the necessary development of a new field of international law that defines the obligations of host states and creates procedures for resolving disputes. The authors examine the international treaties that allow investors to proceed with the arbitration of their claims, describe the most-commonly employed arbitration rules, and set forth the most important elements of investor-State arbitration procedure - including tribunal composition, jurisdiction, evidence, award, and challenge of annulment. The authors trace the evolution and rapid development of the field of international investment, including the formation of the International Center for the Settlement of Investment Disputes (ICSID), and the more than 2,000 bilateral investment treaties, most of which were entered into in the last twenty years. The authors explain how this development has led to far greater certainty for foreign investors in dealing with their host countries, as well as how it has incentivized growth in international trade and commerce.

Book The Interpretation of International Investment Law

Download or read book The Interpretation of International Investment Law written by Todd Weiler and published by Martinus Nijhoff Publishers. This book was released on 2013-05-02 with total page 572 pages. Available in PDF, EPUB and Kindle. Book excerpt: In The Interpretation of International Investment Law: Equality, Discrimination and Minimum Standards of Treatment in Historical Context, author Todd Weiler demonstrates how historical analysis should be adopted in the interpretation of international investment law obligations. Weiler subjects some of the most commonly held beliefs about the nature and development of international investment law to a critical re-appraisal, based upon meticulously assembled historical record. In the process, the book provides readers with a fresh perspective on some of the oldest obligations in international law.

Book The International Minimum Standard and Fair and Equitable Treatment

Download or read book The International Minimum Standard and Fair and Equitable Treatment written by Martins Paparinskis and published by OUP Oxford. This book was released on 2013-01-31 with total page 318 pages. Available in PDF, EPUB and Kindle. Book excerpt: Investment protection treaties generally provide for the obligation to treat investments fairly and equitably, even if the wording of the rule and its relationship with the customary international standard may differ. The open-textured nature of the rule, the ambiguous relationship between the vague treaty and equally vague customary rules, and States' interpretations of the content and relationship of both rules (not to mention the frequency of successful invocation by investors) make this issue one of the most controversial aspect of investment protection law. This monograph engages in a comprehensive analysis of the relationship between the international minimum standard and fair and equitable treatment. It provides an original argument about the historical development of the international standard, a normative rationale for reading it into the treaty rules of fair and equitable treatment, and a coherent methodology for establishing the content of this standard. The first part of this book untangles the history of both the international minimum standard and fair and equitable treatment. The second part addresses the normative framework within which the contemporary debate takes place. After an exhaustive review of all relevant sources, it is argued that the most persuasive reading of fair and equitable treatment is that it always makes a reference to customary law. The third part of the book builds on the historical analysis and the normative framework, explaining the content of the contemporary standard by careful comparative human rights analysis.
