Yet, cultural studies has so far had little engagement or institutional connection with these movements. How can cultural studies as a progressive discipline think with, and make space for, rights-inflected legal and humanitarian practices? This book considers the ways in which cultural humanism and the critical approach to rights, and more broadly between culture and law, can be brought together to open a new intellectual space to allow cultural studies to better engage with the current challenges presented by social and political struggles worldwide. It lays out the central theses essential for constructing a critical view of human rights, and then advances a distinctive critical model of analysis that incorporates insights of postcolonial legal theorists and jurists from the Global South and important cultural theorists from the North, while rethinking law, rights, and social movements as something constituted by multiple legal modernities. Through case studies covering questions relating to sovereignty, citizenship, refugee displacement, human rights defenders, and gender and sexual rights, Law and Cultural Studies develops a means by which the practice of cultural studies can be reinvigorated around the legal spaces, institutions, and movements tied to human rights struggles. In this novel argument, Lara Harb suggests that literary quality depended on the ability of linguistic expression to produce an experience of discovery and wonder in the listener. Analyzing theories of how rhetorical figures, simile, metaphor, and sentence construction are able to achieve this effect of wonder, Harb shows how this aesthetic theory, first articulated at the turn of the eleventh century CE, represented a major paradigm shift from earlier Arabic criticism which based its judgement on criteria of truthfulness and naturalness. In doing so, this study poses a major challenge to the misconception in modern scholarship that Arabic criticism was 'traditionalist' or 'static', exposing an elegant widespread conceptual framework of literary beauty in the post-eleventh-century Islamicate world which is central to poetic criticism, the interpretation of Aristotle's Poetics in Arabic philosophy and the rationale underlying discussions about the inimitability of the Quran.

Book excerpt: Using the work of Edward Said as a point of departure, this book dissects the concept of Orientalism through the lens of 19th century missionary impressions of Kurdistan. Wilcox argues that dominant interpretations of Said's work have a tendency to present Orientalism as an essentialist practice and instead offers an alternative manifestation in which the Oriental is perceived as the mutable product of cultural forces. The relationship between missionaries and imperialism has long been a contentious issue with many scholars highlighting their apparent ambiguity. This study reveals how Protestant missionaries can be identified as anti-imperialist in their rhetoric of ecumenical independence; yet through their preconceptions of Oriental inferiority, they contributed to a more subtle undermining of local forms of knowledge and identity. Wilcox argues that this apparent ambiguity is in part a consequence of the ways in which the term imperialism is frequently used to allude to diverse and even contradictory meanings; therefore it is not so much the missionaries who are ambiguous, as the ways in which they are judged by today's multivalent standards. The analysis also makes clear the complex discursive processes which can undermine the actions of altruistic individuals. By drawing threads from this 19th century example into the current geopolitical foreground of Middle East-West relations, this book not only sheds light upon a little-known historical case study but also illuminates larger questions of the present and future encouraging a more vigorous examination of contemporary Orientalist prejudices.

Book excerpt: This book offers a manifesto for a radical existentialism aiming to regenerate the place of the outside that contemporary theory underestimates. Neyrat calls this outside “atopia”: not utopia, a dreamt place out of the world where everything would be perfect, but atopia, the internal outside that is at the core of every being. Atopia is neither an object that an “object-oriented ontology” would be able to formalize, nor the matter that “new materialisms” could identify. Atopia is what constitutes the existence of any object or subject, its singularity or more precisely its “eccentricity.” Etymologically, to exist means “to be outside” and the book argues that every entity is outside, thrown in the world, wandering without any ontological anchor. In this regard, a radicalized existentialism does not privilege human beings (as Sartre and Heidegger did), but considers existence as a universal condition that concerns every being. It is important to offer a radical existentialism because the current denial of the outside is politically, and aesthetically, damaging. Only an atopian philosophy—a bizarre, extravagant, heretic philosophy—can care for our fear of the outside. For therapeutic element, a radical existentialism favors everything that challenges the compact immanence in which we are trapped, losing capacity to imagine political alternatives. To sustain these alternatives, the book identifies the atopia as a condition of the possibility to break immanence and analyze these breaks in human and animal subjectivity, language, politics and metaphysics.

In the Skin of a Beast shows how the concept of sovereignty comes to the fore in such narratives, reflecting larger concerns about relations of authority and dominion at play in both human-animal and human-human interactions. Peggy McCracken discusses a range of literary texts and images from medieval France, including romances in which animal skins appear in symbolic displays of power, fictional explorations of the wolf’s desire for human domestication, and tales of women and snakes converging in a representation of territorial claims and noble status. These works reveal that the qualities traditionally used to define sovereignty—lineage and gender among them—are in fact mobile and contingent. In medieval literary texts, as McCracken demonstrates, human dominion over animals is a disputed model for sovereign relations among people: it justifies exploitation even as it mandates protection and care, and it depends on reiterations of human-animal difference that paradoxically expose the tenuous nature of human exceptionalism.
