Book excerpt: The book inquires into the effectiveness of the regional and international environmental law frameworks that regulate co-operation in the Lake Victoria Basin. Such an inquiry is important in view of the incessant environmental malaises that afflict Lake Victoria and its Basin. The book shows that the legal frameworks and institutions responsible for effective management and trans-boundary co-operation in the Lake Victoria Basin are inchoate and anodyne in nature. This assessment leads to the conclusion that the solution to the problems in Lake Victoria and its Basin lies not in adopting more laws to regulate diverse trans-boundary aspects of the Lake Victoria Basin, but in initiating a strong political process to enhance the quality of extant laws and heighten the reach and bite of institutional implementation. The study underscores political will as an indispensable pathway to robust legal measures that are needed to drive effective trans-boundary resource co-operation in the Lake Victoria Basin.

With the increasing focus on transboundary cooperation as a part of the Sustainable Development Goal Framework, there is global recognition of transboundary water cooperation as a tool for improved governance and management of transboundary surface and groundwaters. However, there is not an agreed upon definition of transboundary water cooperation in the literature or in practice. This book develops the Four Frames of Transboundary Water Cooperation, which is a neutral modular framework for developing context-specific explanatory definitions of transboundary water cooperation in basins and aquifers. The Four Frames of Cooperation are legal, institutional, relational, and outcome. However, we need to move beyond defining cooperation to understand better measures of the quality and effectiveness of cooperative processes. The Weighted Model of Effective Cooperation presents a first step in qualitatively evaluating the effectiveness of transboundary water cooperation. This model defines effective transboundary water cooperation and operationalizes a method to evaluate the effectiveness of cooperative processes over internationally shared waters. Effective cooperation emphasizes the relational and outcome frames of cooperation while working towards equitability and sustainability. Together, the Four Frames of Cooperation and the Weighted Model of Effective Cooperation will improve the understanding of cooperation and encourage a detailed evaluation of the quality, success, and effectiveness of cooperative processes. This book will be of great interest to students and scholars of water resource management, water governance, and environmental politics. It will also appeal to policymakers and professionals working in the fields of water conflict, water diplomacy, and international cooperation.

Book excerpt: The four decades long ideological-based insurgencies and conflict in the Kabul River Basin (KRB) have seriously hampered the relations and foreign policies of both Afghanistan and Pakistan. Consequently, it restricts them to solve various bilateral issues including transboundary waters. This lack of cooperation over shared water resources is one of the barriers to achieve inclusive and sustainable development. Additionally, it has contributed to the prevailing anarchic situation where each country does what it wants. The absence of a formal water-sharing mechanism coupled with poor water management practices within both the riparian counties are resulting various flow and administration-related challenges. Moreover, these challenges are further exacerbated by regional changes in social, political, environmental and economic systems. The scholarly literature suggests that an analytical transboundary water governance framework is essential to address the challenges of water politicisation and securitisation, quality degradation and quantity reduction. Additionally, the literature rarely integrates (a) a multi-level approach, (b) an institutional approach (c) an inclusive development approach, or (d) accounts for the uses of different types of water and their varied ecosystem services for improved transboundary water governance. To enhance human wellbeing and achieve inclusive and sustainable development in the KRB this research indicates that it is essential to: (1) defrost frozen collaboration; (2) bypass border dispute; (3) use biodiversity and ecosystem services approach; (4) address existing and potential natural and anthropogenic challenges; (5) remove contradictions in the policy environment; (6) combat resource limits and dependence by promoting collaboration on long-term cost effective solutions; and (7) enhance knowledge and dialogue on inclusive development.
