Book The Law and Theory of Trade Secrecy

Download or read book The Law and Theory of Trade Secrecy written by Rochelle C. Dreyfuss and published by Edward Elgar Publishing. This book was released on 2011 with total page 639 pages. Available in PDF, EPUB and Kindle. Book excerpt: This timely Handbook marks a major shift in innovation studies, moving the focus of attention from the standard intellectual property regimes of copyright, patent, and trademark, to an exploration of trade secrecy and the laws governing know-how, tacit knowledge, and confidential relationships. The editors introduce the long tradition of trade secrecy protection and its emerging importance as a focus of scholarly inquiry. The book then presents theoretical, doctrinal, and comparative considerations of the foundations of trade secrecy, before moving on to study the impact of trade secrecy regimes on innovation and on other social values. Coverage includes topics such as sharing norms, expressive interests, culture, politics, competition, health, and the environment. This important Handbook offers the first modern exploration of trade secrecy law and will strongly appeal to intellectual property academics, and to students and lawyers practicing in the intellectual property area. Professors in competition law, constitutional law and environmental law will also find much to interest them in this book, as will innovation theorists.

Book Abuse of Dominant Position and Globalization Protection and Disclosure of Trade Secrets and Know How

Download or read book Abuse of Dominant Position and Globalization Protection and Disclosure of Trade Secrets and Know How written by Pranvera Këllezi and published by Springer. This book was released on 2017-05-05 with total page 637 pages. Available in PDF, EPUB and Kindle. Book excerpt: This publication provides an unparalleled comparative analysis of two "hot topics" in the field of antitrust and unfair competition law with regard to a number of key countries. The first part of the book examines the prohibition of abuse of a dominant position and globalization in relation to two broad questions: first, whether there is consistency between the approaches of different jurisdictions to the notion of abuse, and, second, whether there are too many restrictions on legal rights and business opportunities resulting from the prohibition of abuse of dominance. The international report drafted by Professor Pinar Akman reveals that there are as many similarities as differences between the approaches of the twenty-one jurisdictions studied and presented in this book. This is an invitation to read the excellent international report as well as the reports on specific jurisdictions in order to grasp the variety of arguments and approaches of this antitrust area, which may, on the surface, appear alike. The second part gathers contributions on the question of protection and disclosure of trade secrets and know-how from various jurisdictions. The need for adequate protection of trade secrets has increased due to digitalization and the ease with which large volumes of misappropriated information can be reproduced. The comprehensive international report, prepared by Henrik Bengtsson, brings together these reflections by comparing various national positions. The book also discusses the resolutions passed by the General Assembly of the International League of Competition Law (LIDC) following a debate on each of these topics, and includes proposed solutions and recommendations.

Book Guide to Intellectual Property

Download or read book Guide to Intellectual Property written by The Economist and published by The Economist. This book was released on 2015-07-14 with total page 353 pages. Available in PDF, EPUB and Kindle. Book excerpt: Intellectual Property (IP) is often a company's single most valuable asset. And yet IP is hard to value, widely misunderstood and frequently under-exploited. IP accounts for an estimated 5trn of GDP in the US alone. It covers patents, trademarks, domain names, copyrights, designs and trade secrets. Unsurprisingly, companies zealously guard their own ideas and challenge the IP of others. Damages arising from infringements have fostered a sizeable claims industry. But IP law is complex, and the business, financial and legal issues around it are difficult to navigate. Court decisions and interpretation of IP laws can be unpredictable, and can dramatically change the fortunes of businesses that rely on their IP - as demonstrated in the pharmaceutical industry's battle with generic drugs. This comprehensive guide to intellectual property will help companies, investors, and creative thinkers understand the scope and nature of IP issues, pose the right questions to their advisers and maximize the value from this crucial intangible asset.

Book Trade Secret Protection

  • Author : COOK
  • Publisher :
  • Release : 2021-01-31
  • ISBN : 9781787424586
  • Pages : 525 pages

Download or read book Trade Secret Protection written by COOK and published by . This book was released on 2021-01-31 with total page 525 pages. Available in PDF, EPUB and Kindle. Book excerpt: The law of trade secrets is one of the most important and fastest developing areas of intellectual property, but is by far the least harmonised internationally. Indeed, the protection of trade secrets was not mandated by any international treaty until the 1994 Agreement on Trade-Related Aspects of Intellectual Property Rights, which nonetheless left countries with significant latitude as to how they should implement such obligations. Since the last edition the EU Trade Secrets Directive has had the effect of establishing minimum levels of protection in the Member States of the EEA, but major differences of approach still remain, and the Directive has neither achieved total harmonisation under the civil law nor had any effect on the protection of trade secrets by means of the criminal law. The wide variety of approaches to the protection of trade secrets internationally betrays the murky legal origins of such protection. Are they protected by civil actions, in the criminal courts, or both? And from the point of view of the civil courts, is their protection effected under unfair competition law, as seen in many civil law countries, or is it based instead on some implied contract, fiduciary or other equitable obligation theory, as seen in common law countries?Edited by leading IP practitioner Trevor Cook, this important title demystifies the law of trade secrets in over 30 jurisdictions, covering substantive and procedural aspects of both criminal and civil law and exploring the final remedies available under each. Designed to provide clear, comprehensive and practical guidance, this is a powerful tool for anyone requiring a broader and fuller understanding of trade secret protection globally.

Book Trade Secret Law and the Computer Fraud and Abuse Act

Download or read book Trade Secret Law and the Computer Fraud and Abuse Act written by Kyle Wesley Brenton and published by . This book was released on 2014 with total page 54 pages. Available in PDF, EPUB and Kindle. Book excerpt: As businesses move their confidential information onto computers, sensitive data gains the protection not only of state trade secret law, but also potentially of federal computer misuse statutes. The interaction between those two bodies of law, however, is more problematic than any commentator has yet realized. The Computer Fraud and Abuse Act, 18 U.S.C. § 1030, is a federal criminal statute with a private right of action allowing those who suffer information theft via computer to maintain a civil action against the thief. More and more in recent years, however, employers whose faithless employees misappropriate purported trade secrets have used the CFAA as a basis for employee liability, as well as a way to bootstrap their claims into federal court. Using the CFAA in this manner creates two problems. First, substantively, since a CFAA claim is much easier to prove than a traditional state-law trade secret misappropriation claim, plaintiffs will be more likely to plead the former. But because the CFAA lacks virtually all of the policy-based protections built into trade secret law, this upsets the delicate balance between employers and employees that trade secret law strikes. Second, jurisdictionally, using the CFAA to establish federal question jurisdiction, then bringing trade secret claims into federal court under supplemental jurisdiction, contravenes the intent of Congress in passing the CFAA and damages core notions of federalism and the relationship between federal and state law. This Article proposes two solutions to the two problems that arise at the intersection of trade secret law and the Computer Fraud and Abuse Act. First, Congress should act to remove the CFAA's substantive crime that most closely approximates trade secret misappropriation from the Act's private right of action, thus removing the threat that the CFAA will disrupt the values underlying substantive trade secret law. Second, judges ruling on motions to dismiss CFAA claims should carefully examine the parties' contentions and use the discretion granted in 28 U.S.C. § 1367(c) to dismiss state-law trade secret claims. Thus claims in which the CFAA is merely, in the words of one judge, “a federal tail” wagging “a state dog” can be returned where they belong: state court.
