This book examines the current debate on nuclear non-proliferation and disarmament, notably the international non-proliferation regime and how to implement its disarmament provisions. Discussing the requirements of a new international consensus on nuclear disarmament and non-proliferation, this book builds on the three pillars of the nuclear non-proliferation treaty (NPT): non-proliferation, disarmament and peaceful uses of nuclear energy. It reviews the impact of Cold War and post-Cold War policies on current disarmament initiatives and analyses contemporary proliferation problems: how to deal with the states that never joined the NPT (India, Pakistan and Israel); how states that have been moving toward nuclear weapons have been brought back to non-nuclear-weapon status; and, in particular, how to deal with Iran and North Korea. The analysis centres on the relationship between disarmament and non-proliferation in an increasingly multi-centric world involving China and India as well as the US, the European powers and Russia. It concludes with a description and discussion of three different worlds without nuclear weapons and their implications for nuclear disarmament policies. In 2002 Dr. Hans Blix, then chief United Nations weapons inspector, led his team on a search for weapons of mass destruction in Iraq. Before the United States went to war with Iraq the next March, he maintained there were no WMD in Iraq. History proved him right. For more than forty years Dr. Blix has worked on global disarmament, and with this new book he renews the call for nuclear nonproliferation. His interests, though, go beyond stemming the threat of nuclear attack from rogue states and terrorists. Almost two years later, the Global Zero movement was born with its chief aim to rid the world of such weapons once and for all by 2030. But is it realistic or even wise to envision a world without nuclear weapons? More and more people seem to think so. Barack Obama has declared “America’s commitment to seek the peace and security of a world without nuclear weapons.” But that is easier said than done. Michael O’Hanlon places his own indelible stamp on this critical issue, putting forth a “friendly skeptic’s case for nuclear disarmament.” Calls to “ban the bomb” are as old as the bomb itself, but the pace and organization of nonproliferation campaigns have picked up greatly recently. The growing Global Zero movement, for example, wants treaty negotiations to begin in 2019. Would this be prudent or even feasible in a world that remains dangerous, divided, and unpredictable? After all, America’s nuclear arsenal has been its military trump card for much of the period since World War II. Pursuing a nuclear weapons ban prematurely or carelessly could alarm allies, leading them to consider building their own weapons—the opposite of the intended effect. O’Hanlon clearly presents the dangers of nuclear weapons and the advantages of disarmament as a goal. But even once an accord is in place, he notes, temporary suspension of restrictions may be necessary in response to urgent threats such as nuclear “cheating” or discovery of an advanced biological weapons program. To take all nuclear options off the table forever strengthens the hand of those that either do not make that pledge or do not honor it. For the near term, traditional approaches to arms control, including dismantling existing bomb inventories, can pave the way to make a true nonproliferation regime possible in the decades ahead.

This book aims to support compliance, implementation, and further development of international disarmament law. Traditionally, disarmament focused on weapons of mass destruction. This remains a critically important area of work. In recent decades, the scope of disarmament has broadened to encompass also conventional weapons, including through the adoption of rules and regulations to govern arms transfers and measures to eliminate specific munitions from stockpiles and to destroy explosive remnants of war. There have also been four "generations" of programmes to address small arms and light weapons at national or sub-national level through disarmament, demobilisation, and reintegration (DDR) programmes during and following the end of armed conflict. While an internationally accepted definition of disarmament does not yet exist, it is widely agreed that disarmament encompasses or interrelates with prohibitions and restrictions on the development, production, stockpiling, testing, and transfer of weapons and on their destruction. In addition to clarifying these elements, chapters of this guide will also consider the relationship between disarmament and the law of armed conflict, and with the United Nations Security Council, human security, public health, and non-state actors.

Chapter II will cover thematic similarities between these conventions, and then demonstrate how the ideas codified within these treaties left the issue of the use of nuclear weapons’ legality ambiguous. It will then analyse the ICJ’s famous Advisory Opinion on the matter, and the debates leading up to the acceptance for such a request. Chapter III will discuss the main recurring ideas and issues furthering the need for a convention with clarity on the illegality of nuclear weapons, and analyse the drafting process of the Treaty by observing the contribution of several states, international organizations, and non-governmental organizations (‘NGOs’). Various opinions will be observed to outline the perceived legal impact of the Treaty, considering that most are dubious of the cooperation of nuclear weapons states. Chapter IV will analyse key provisions of the Treaty, its adoption, and voting patterns. This will include a look at the boycotting of the process by states with nuclear weapons and their allies, with a closer observation of the case of the Netherlands, who was the only State voting against the adoption. The thesis will conclude by identifying the potential successes of the Treaty pursuant to goals outlined in the drafting process, and identifying possible recurring issues that may occur with regards to the cooperation of nuclear-weapons states. The Treaty on the Prohibition of Nuclear Weapons’ likelihood of achieving its aims will depend on the pressure it creates on states that possess nuclear weapons and their efforts towards disarmament. With an analytical view of the drafting process and subsequent voting on the Treaty, it seems the only states likely to sign or ratify the Treaty belong to the group that does not possess them to begin with. Nonetheless, the Treaty may have an effect on nuclear weapon states’ behaviour if it is widely accepted by other states, compelling them to take more aggressive action towards nuclear disarmament. Therefore, while the TPNW’s adoption is a progressive step towards greater certainty on the illegality of nuclear weapons, its success in creating a safer world for humanity will largely depend on the likelihood of states in possession of nuclear weapons to feel some obligation to comply with its provisions.
