Book excerpt: In July 2012 the United Nations convened a conference to negotiate a legally binding arms trade treaty (ATT) to regulate trade in conventional arms at the highest possible common international standards. Arms export controls can only be effective if implemented at the global level, in a coherent and consistent manner. The European Union (EU) strongly supports the development of a global ATT. The EU coordinated internally to streamline national positions and converge diverging approaches on the content of the ATT. Furthermore, it pleaded for an inclusive process and put this into practice by organizing outreach seminars for all UN member states. However, during the negotiations in July 2012 the EU encountered difficulties in streamlining national policies and fulfilling its ambitious role to act as a global actor. Striking the right balance between effective national diplomacy and EU consistency during the negotiations proved to be challenging. Although UN member states did not reach an agreement in July, the EU has a crucial role to play in future negotiations, which will continue in March 2013.

Book excerpt: The United States and the Soviet Union have been negotiating nuclear arms control agreements for over twenty years, yet radical differences remain in the two sides' concept of, and approaches to, strategic stability and arms control. This book compares and contrasts those approaches, using START (Strategic Arms Reduction Treaty) as a case study. Throughout two decades of negotiation, U.S. policy has been directed toward dialogue that would encourage convergence of American and Soviet thought on nuclear deterrence. In Kartchner's view, that hope is belied not only by continuing asymmetries in the development and deployment of their strategic nuclear arsenals, but by differing U.S. and Soviet negotiating positions. The Reagan administration viewed START as a means of repudiating SALT II, restoring a measure of balance in the U.S.-Soviet strategic competition, and as a way of closing the so-called window of vulnerability. In contrast, Kartchner analyzes the Soviets' differing views of nuclear balance, emphasizing their satisfaction with SALT II and a strategic equilibrium shaped by a decade of bilateral arms control. Kartchner offers a detailed exposition of the major negotiating issues in START, contrasting concerns of U.S. and Soviet negotiators. Not surprisingly, each side's agenda was dominated by weapon systems that figure prominently in the other's development program. The author concludes by summarizing and comparing American and Soviet quests for stability and drawing up an assessment of U.S. efforts in both SALT and START to use arms control negotiations as a kind of classroom for instructing Soviet officials in American notions of "stabilizing" versus "destabilizing" weapon technology and America's own ethnocentric view of stability. START will profoundly affect the acquisition, operation, maintenance, and cost of U.S. strategic nuclear forces well into the next century. The history and analysis presented here will provide an essential source to policymakers and students of military-political relations for much-needed further study of this treaty's implications.

Hundreds of millions of dollars are spent each year on disarmament operations, yet no comprehensive guide exists to explain clearly the international rules governing disarmament. This book seeks to fill that gap. It describes the international legal rules that govern disarmament and the operational, political, and technical considerations that govern their implementation. This book aims to support compliance, implementation, and further development of international disarmament law. Traditionally, disarmament focused on weapons of mass destruction. This remains a critically important area of work. In recent decades, the scope of disarmament has broadened to encompass also conventional weapons, including through the adoption of rules and regulations to govern arms transfers and measures to eliminate specific munitions from stockpiles and to destroy explosive remnants of war. There have also been four "generations" of programmes to address small arms and light weapons at national or sub-national level through disarmament, demobilisation, and reintegration (DDR) programmes during and following the end of armed conflict. While an internationally accepted definition of disarmament does not yet exist, it is widely agreed that disarmament encompasses or interrelates with prohibitions and restrictions on the development, production, stockpiling, testing, and transfer of weapons and on their destruction. In addition to clarifying these elements, chapters of this guide will also consider the relationship between disarmament and the law of armed conflict, and with the United Nations Security Council, human security, public health, and non-state actors.

Book excerpt: In recent years states have increasingly begun to recognize that the regulation of the international trade in conventional arms is a necessary and essential component of national and international security. National systems have been established and enhanced, and a number of regional agreements have been adopted, with a marked level of commonality across these agreements. Still, the network of systems is incomplete and the patchwork that currently exists raises the risk of loopholes being used to permit potentially dangerous international arms transfers. As states move forward with an Arms Trade Treaty, some of these loopholes may be eliminated. However, even with an ATT, states will still be required to make national decisions concerning arms transfers, whether to allow a transfer and how to implement their various national procedures. An ATT will set specific minimum standards that all states will be expected to incorporate into their national laws and processes. This practical guide is intended to assist states in meeting their future obligations under a treaty. However, irrespective of the ATT, the guide is available for states' use to enhance and develop their national systems. States are continually updating and putting in place the building blocks for an effective national system. These building blocks are essential for effective transfer controls, at both the national and global levels, and should be taken into account regardless of the ATT process. Once an Arms Trade Treaty is negotiated, states that have developed comprehensive national transfer control systems will be better placed to effectively and efficiently implement the ATT.
