About the Author Alonzo T Jones (1850-1923) heard the Adventist message while serving in the United States Army in the State of Washington. He began at once to study history as it related to prophecy, a theme of much of his writing of articles and books. This study also prepared him for his activity on the subject of religious liberty. He participated in the hearings of the Blair Sunday bill in 1889 and became editor of "The American Sentinel." Elder Jones was a powerful speaker and one of the strong voices in the revival of 1888 within the Adventist denomination. For a short time he was a Bible teacher at Healdsburg College. From 1897-1901 he was the editor of the Review and Herald, and he served on the staff of the Signs of the Times. Book excerpt: Church and State examines the wall of separation Thomas Jefferson spoke of in his letter to the Danbury Baptist Association in 1802 to answer a letter from them written in October 1801. The Danbury Baptists were a religious minority in Connecticut, and they complained that in their state, the religious liberties they enjoyed were not seen as immutable rights, but as privileges granted by the legislatureas favors granted. Jeffersons reply did not address their concerns about problems with state establishment of religiononly of establishment on the national level. The letter contains the phrase wall of separation between church and state, which led to the shorthand for the Establishment Clause that we use today: separation of church and state. The Jeffersonian view has been contentious, to say the least; a great many scholars and politicians have tried to comprehend Jeffersons true meaning, extending his viewpoint in later judicial and legislative decisions. Strong feelings expressed by clergy, statesmen, and politicians have created a strong theistic undertow in Constitutional Law that has seen attacks on Christianity and Judaism increase since the Clinton Administration and culminating into a cacophony of anti-theistic rhetoric under the Obama Administration. With the election of President Trump, we must look back to see the original intent of our founding fathers, take a snapshot of the current state of separation, and peer into the future to see if the balance between politics and religion can be sustained.

The framers of the Constitution's Bill of Rights began their blueprint for freedom by drawing exactly such a line. The first clauses of the First Amendment provide: "Congress shall make no law respecting an establishment of religion or prohibiting the free exercise thereof." The justices of the Supreme Court have not been wanting for advice from self-appointed guardians. The difficulty with such advice is that the contestants are more convincing when they criticize their opponents' interpretations than when they seek to establish the validity of their own.Religion and the Law examines the actions and words of the Supreme Court in applying constitutional language to the controversies that have come before it. Lest such an effort be reduced to recitation, these cases are measured against a "neutral principle" that will give the most appropriate scope to the religion clauses in such a manner as to provide guidance for legislatures and courts. This neutral principle has been framed in reliance on the Aristotelian axiom that "it is the mark of an educated man to seek precision in each class of things just so far as the nature of the subject admits."One of the fundamental difficulties with the contemporary discussion of the "hot button" issue has been the failure to distinguish two separable problems: the constitutional issue--in the narrow sense of the meaning to be given to the language of the First Amendment by the Supreme Court--and the broader question of the ideal relationship that should exist between church and state. This is a classic study by one of the great theorists of American constitutional law.

As a former deputy district attorney for Los Angeles County, Guminski gained a wealth of experience in preparing arguments for appellate courts. Based on his experience and careful research, he proposes a persuasive theory that explains why some but not all rights secured against infringement by the United States are also secured against infringement by the states by both the privileges or immunities and the due process clauses of the fourteenth amendment, adopted in 1868. He examines whether national citizenship before the Civil War was paramount and superior, addresses the procedural and substantive aspects of the due process clause, and recites the reasons supporting his general theory. In presenting the essentials of his theory about how the Constitution should be judicially construed, Guminski thereby encourages other citizens to express their own opinions about constitutional law with the hope that these views may one day have an impact on the way the Supreme Court interprets the Constitution.

The result has been a virtual rewriting of the liberties enumerated in the Constitution. A direct victim of this judicial micromanagement has been the religious aspect of the First Amendment.
