Book United Nations Convention on the Law of the Sea 1982 Volume VI

Download or read book United Nations Convention on the Law of the Sea 1982 Volume VI written by Myron H. Nordquist and published by BRILL. This book was released on 2021-08-04 with total page 1064 pages. Available in PDF, EPUB and Kindle. Book excerpt: Volume VI is the sixth substantive volume to be published in the series. It deals with the work of the First Committee at the Third UN Conference on the Law of the Sea, namely the international seabed area. The volume thus embraces the deep seabed mining regime set out in Part XI of the 1982 Convention on the Law of the Sea together with the 1994 Agreement on its implementation. Completion of this commentary was delayed first by the consultations and negotiations that commenced in 1990 and led to the 1994 Agreement and the entry into force of the Convention. It was further delayed until the Assembly of the International Seabed Authority approved the detailed mining regulations in 2000. Additional supplementary material can be found at UNCLOS 1982 Commentary: Supplementary Documents.

Book The Outer Limits of the Continental Shelf

Download or read book The Outer Limits of the Continental Shelf written by Suzette V. Suarez and published by Springer Science & Business Media. This book was released on 2008-06-26 with total page 290 pages. Available in PDF, EPUB and Kindle. Book excerpt: A. The Outer Limits of the Continental Shelf The 1982 United Nations Convention on the Law of the Sea (herein- ter the “Convention”) marks the beginning of a new era in the law of 1 the sea. The negotiations for this treaty at the Third United Nations Conference for the Law of the Sea (hereinafter “UNCLOS III”), lasted for nine years, from 1973 to 1982. The Convention regulates the principal aspects of international oceans affairs. It establishes and fixes the limits of maritime zones, provides for the rights and duties of states in these zones, establishes the law app- cable in the international seabed area on the basis of the principle of common heritage of mankind, imposes obligations on states to protect the marine environment, and provides for the means of dispute sett- ment. One of the most contentious and divisive issues at UNCLOS III were the outer limits of the continental shelf. Previously, in the 1958 Con- 2 vention on the Continental Shelf (hereinafter the “1958 Convention”), no limits were established for the continental shelf. States were allowed to claim areas of continental shelves based on their capacity to exploit the mineral resources of the shelf. The legal framework in the 1958 Convention would obviously conflict with the principle of the common heritage of mankind. Delegates realized that limits have to be est- lished, but up to where and on the basis of which principles, was a c- tentious question.

Book excerpt: This is the first comprehensive study on archipelagic regimes published since the adoption of the United Nations Convention on the Law of the Sea in 1982. The book traces the historical evolution of the archipelagic concept in international law and examines the definition of archipelagos and archipelagic states. The nature, status and regime of the waters of different types of archipelagos is examined and analysed from the perspective of archipelagic states and is based on the requirement of such states for territorial integrity and self-determination. The book introduces the concept of `Ocean States' and links Ocean States with the archipelagic concept. The archipelagic concept is viewed as a practical as well as a functional basis for the determination of the territorial limits of Ocean States.

Book Major Law and Policy Issues in the South China Sea

Download or read book Major Law and Policy Issues in the South China Sea written by Yann-huei Song and published by Routledge. This book was released on 2016-05-13 with total page 327 pages. Available in PDF, EPUB and Kindle. Book excerpt: Major law and policy issues in the South China Sea are discussed mainly from the perspectives of leading American and European scholars in the study of the complex South China Sea disputes. The issues include regional maritime cooperation and regime building, Southeast Asian countries’ responses to the Chinese assertiveness, China’s historic claims, maritime boundary delimitation and excessive maritime claims, military activities and the law of the sea, freedom of navigation and its impact on the problem, the dispute between Vietnam and China, confidence-building measures and U.S.-Taiwan-China relations in the South China Sea, and Taiwan’s role in the resolution to the South China Sea issues. Over the past three years, there have been several incidents in the South China Sea between the claimants, and also between the claimants and non-claimants over fisheries, collection of seismic data, exploration for oil and gas resources, and exercise of freedom of navigation. Third party concerns and involvement in the South China Sea disputes have been increasing as manifested in actions taken by the United States, India, and Japan. It is therefore important to examine South China Sea disputes from the legal and political perspective and from the view point of American and European experts who have been studying South China Sea issues for many years.
