It seems needless to repeat or recombine them; but in one relation they have scarcely been handled with any direct purpose. Justice and expediency have been the points insisted on or contested; these have not gone back far enough; they have not touched the central fact, to set it forth in its force and finality. The fact is original and inherent, behind and at the root of the entire matter, with all its complication and circumstance. We have to ask a question to which it is the answer, and whose answer is that of the whole doubt and dispute. What is the law of woman-life? What was she made woman for, and not man? Shall we look back to that old third chapter of Genesis? When mankind had taken the knowledge and power of good and evil into their own hands through the mere earthly wisdom of the serpent; when the woman had had her hasty outside way and lead, according to the story, and woe had come of it, - what was the sentence? And was it a penance, or a setting right, or a promise, or all three? The serpent was first dealt with. The narrow policy, the keen cunning, the little, immediate outlook, the expedient motive; all that was impersonated of temporary shift and outward prudence in mortal affairs, regardless of, or blind to, the everlasting issues; all, in short, that represented material and temporal interest as a rule and order, - and is not man's external administration upon the earth largely forced to be a legislation upon these principles and economies? - was disposed of with the few words, "I will put enmity between thee and the woman." Raphael Sealey analyzes the rights of women in marriage, in the control of property, and in questions of inheritance. He advances the theory that the legal disabilities of Greek women occurred because they were prohibited from bearing arms. Sealey demonstrates that, with some local differences, there was a general uniformity in the legal treatment of women in the Greek cities. For Athens, the law of the family has been preserved in some detail in the scrupulous records of speeches delivered in lawsuits. These records show that Athenian women could testify, own property, and be tried for crime, but a male guardian had to administer their property and represent them at law. Gortyn allowed relatively more independence to the female than did Athens, and in Sparta, although women were allowed to have more than one husband, the laws were similar to those of Athens. Sealey's subsequent comparison of the law of these cities with Roman law throws into relief the common concepts and aims of Greek law of the family. Originally published in 1990. In this period of extensive experience before the courts and in the practice of law he has acquired a fund of knowledge, unusual in its richness to those interested in legal problems. Here you can obtain the information which will assist you to avoid the pitfalls that ensnare those who seek to advise women as to their legal rights. Mr. Tucker was born at New Bedford, Massachusetts, on January 19, 1852. He received the degree of Bachelor of Arts from Brown University at Providence, Rhode Island, in 1873, and his degree of Bachelor of Laws at Boston University in 1875. Subsequently, the degree of Doctor of Philosophy was conferred upon him. He practiced law in New Bedford from 1876 to 1882 and then removed his law office to Boston where he is in practice today. From 1890 to 1892, Mr. Tucker was a member of the Legislature of the Commonwealth of Massachusetts. In 1892, he was appointed the Official Reporter of the Decisions of the Supreme Court of Massachusetts. He served in this position until the year 1900. Mr. Tucker is the author of numerous treatises and articles relating to the law. Among the important are "Testamentary Forms and Notes on Wills," and "Manual of Massachusetts Corporations." He is joint author of Gould and Tucker's "Notes on United States Statutes," and with Dr. Wilson of Harvard on "International Law." But when that treatise was written, the Married Women's Acts in England and America were a sort of first experiment or agitation; and since the second edition of the Domestic Relations not less than three thousand points have been decided, all tending to establish a mod ern jurisprudence concerning married women's rights, which decisions the author has examined while pre paring the present work, in addition to earlier author ities and various local codes. He has consequently expanded his subject, re-arranged his plan, and revised and re-written every topic, and the present work will be found essentially a new one, so far as relates espe cially to Promises to Marry, the Wife's Separate Pr0p erty under Equity and Recent Statutes, Transactions between Husband and Wife, Various Matters of Prac tice, and Separation and Divorce. A summary of the late Married Women's Acts in England and the United States will be found in the Appendix. No one can gain an intelligent comprehension of the rights and disabilities of the marriage union, as they exist to-day, without examining in order, (1) the old common-law or coverture doctrine; (2) the modifica tion of that doctrine by equity and recent legislation; (3) the latest local statute (judicially construed or not) which bears upon the particular point.
