Download or read book The Washington State Constitution written by Robert F. Utter and published by Oxford University Press. This book was released on 2013-03-15 with total page 330 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Washington State Constitution provides an outstanding constitutional and historical account of the state's governing charter. In addition to an overview of Washington's constitutional history that focuses on the document's 19th century populist roots, it provides an in-depth, section-by-section analysis of the entire constitution, detailing the many significant changes made since its initial drafting. This treatment, along with a table of cases, index, and bibliography, provides an unsurpassed reference guide for lawyers, judges, scholars, and members of the general public. The second edition of The Washington State Constitution has been significantly expanded to detail the impact of the late nineteenth century Populist movement on both the structure and content of Washington's 1889 constitution. The book includes current and important developments in the theory of state constitutional interpretation in Washington State, describes the significant expansion, over the past decade, in the Washington Supreme Court's independent reliance on the state's constitution rather than the federal constitution in many constitutional doctrines, particularly those related to individual rights. The title also includes up-to-date analysis of significant developments in a number of areas, including the rights of criminal defendants; personal freedoms of speech, religion and privacy; powers and constraints on the state legislature and the governor; the initiative, referendum and recall; and the application of Washington's unique public education clause. The Washington State Constitution was cited in the following notable cases: - League of Educ. Voters v. State,__Wn.2d___, 295 P.3d 743, 758-59 (2013.) (both majority and dissent) - In re Bond Issuance of Greater Wenatchee Regional Events Center Public Facilities, 175 Wash.2d 788,813, 816, 287 P.3d 567, 580 (2012) (dissent) - Bellevue School Dist. v. E.S., 171 Wash.2d 695, 717, 257 P.3d 570, 581 (2011) The Oxford Commentaries on the State Constitutions of the United States is an important series that reflects a renewed international interest in constitutional history and provides expert insight into each of the 50 state constitutions. Each volume in this innovative series contains a historical overview of the state's constitutional development, a section-by-section analysis of its current constitution, and a comprehensive guide to further research. Under the expert editorship of Professor G. Alan Tarr, Director of the Center on State Constitutional Studies at Rutgers University, this series provides essential reference tools for understanding state constitutional law. Book The Washington State Constitution

Download or read book The Washington State Constitution written by Robert French Utter and published by Greenwood. This book was released on 2002 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: Providing a useful starting point for practitioners and others interested in working with Washington's basic legal document, this original reference work describes each article and each section of the State Constitution in turn, outlining the historical background of the section, its predecessors or relatives in the U.S. or other state constitutions, and key interpretive cases. The Introduction, written by retired State Supreme Court Justice Robert F. Utter, describes the increasing interest in state constitutions during the past quarter-century and outlines how federal courts have come to rely on Washington State's constitution as an independent source of rights protections. The article of the Constitution described at greatest length is Article I, the declaration of Rights. It contains 35 sections covering religious freedom, protection of speech and privacy, the right to bear arms, rights of the accused, a prohibition of a standing army, and many other provisions. Of the remaining 31 articles, many have their origins in other state constitutions, particularly those of western states, while a few sections are unique in their language. The paramount duty clause of the education article is an example of language that originated first in Washington, although it has cousins in other state constitutions that entrench the concept of common schools that spread throughout the nation after 1830.

Book State Constitutions of the United States

Download or read book State Constitutions of the United States written by Robert Maddex and published by CQ Press. This book was released on 2005-09-23 with total page 574 pages. Available in PDF, EPUB and Kindle. Book excerpt: Newly updated and reflecting the diversity of state policies and the issues that are important to them, State Constitutions of the United States collects, explains, and offers comparison of each of the fifty state constitutions. Its in-depth explorations and easy-to-follow structure reveal individual state priorities, the significance of state constitutions and their impact on issues that affect the day-to-day lives of citizens. This major revision incorporates specific details and describes trends and patterns in state constitutions, drawing on over 380 amendments passed since the first edition of this resource was published in 1998. These amendments address, at the state level, important issues that are also being debated on the national level, such as freedom of religion (Alabama), tobacco (Arizona), death penalty (Florida), and same-sex marriage in a number of states. The new edition addresses all of these issues and more, in well-organized state-by-state chapters-including a new chapter on Washington, DC. Beyond the extensive state-by-state coverage, this resource provides further insights through supplemental materials, including an overview of state constitutions, comparative tables, "new rights" such as privacy and victim′s rights, "special provisions" such as the environment and home rule, and much more. This is the only one-volume resource on state constitutions designed to inform non-specialists, including students, non-constitutional scholars, and interested citizens, about the variety, influence, and continual revision and innovation that define state constitutions in the U.S. A wide range of libraries, including those that serve college students, AP high school students, and the general public, will want to update their collections with this unique and essential reference work.

Book To Protect and Maintain Individual Rights

Download or read book To Protect and Maintain Individual Rights written by Jonathan Bechtle and published by Evergreen Freedom Foundation. This book was released on 2011-08 with total page 145 pages. Available in PDF, EPUB and Kindle. Book excerpt: In To Protect and Maintain Individual Rights, Jonathan Bechtle and Michael Reitz provide a section by section analysis of the Washington Constitution's Declaration of Rights. The authors review the state's 1889 constitutional debates, contemporary accounts of the convention, and significant cases that have dealt with the rights guaranteed in the Washington Constitution. The book includes a foreword by Washington Supreme Court Justice Charles Johnson. A 2006 survey found that only twenty-five percent of Americans can name more than one freedom protected by the First Amendment. Twenty percent of those polled actually thought the right to own a pet was protected. Yet more than half of these adults could name at least two characters from a popular television cartoon. If familiarity with the U.S. Constitution is lacking, awareness of the provisions of the state constitution is deplorable. Bechtle and Reitz urge citizens to become familiar with their state constitution, as individual rights are often afforded greater protection from the state constitution than from the U.S. Constitution. “When citizens are educated in the sources of their freedoms, and familiar with attempts in history to limit these freedoms, they are better equipped to recognize new encroachments.”

Book George Washington Nationalist

Download or read book George Washington Nationalist written by Edward J. Larson and published by University of Virginia Press. This book was released on 2016-07-11 with total page 128 pages. Available in PDF, EPUB and Kindle. Book excerpt: George Washington was the unanimous choice of his fellow founders for president, and he is remembered to this day as an exceptional leader, but how exactly did this manifest itself during his lifetime? In George Washington, Nationalist, acclaimed author Edward J. Larson reveals the fascinating backstory of Washington’s leadership in the political, legal, and economic consolidation of the new nation, spotlighting his crucial role in forming a more perfect union. The years following the American Revolution were a critical period in American history, when the newly independent states teetered toward disunion under the Articles of Confederation. Looking at a selection of Washington’s most pivotal acts—including conferring with like-minded nationalists, establishing navigational rights on the Potomac, and quelling the near uprising of unpaid revolutionary troops against the Confederation Congress—Larson shows Washington’s central role in the drive for reform leading up to the Constitutional Convention. His leadership at that historic convention, followed by his mostly behind-the-scenes efforts in the ratification process and the first federal election, and culminating in his inauguration as president, complete the picture of Washington as the nation’s first citizen. This important and deeply researched book brings Washington’s unique gift for leadership to life for modern readers, offering a timely addition to the growing body of literature on the Constitution, presidential leadership, executive power, and state-federal relations. Gay Hart Gaines Distinguished Lectures Preparation of this volume has been supported by The Fred W. Smith National Library for the Study of George Washington at Mount Vernon and by a gift from Mr. and Mrs. Lewis E. Lehrman.
