Available in PDF, EPUB and Kindle. Book excerpt: In the literature on Indonesian legal history, the role of language has been paid scant attention. Even the replacement of Dutch by Indonesian as the official language of the law, surely a major event for the work of Indonesian jurists, has not been closely examined. Yet, since the early 1970s, legal usage and terminology have been the topic of a steady stream of highly critical publications by linguists and, remarkably, by jurists as well. Their criticism is focused on the heterogeneity of law language and terminology, and the deviation of legal usage from the official standard language. Government measures (language courses, law dictionaries) have not allayed this criticism. This study exposes two fundamental defects in the government measures and in the criticism itself. Firstly, they are grounded in an instrumental approach to language, an approach that sees language as a mere tool of the jurist, and as secondary in importance to the conceptual world that is considered law’s core business. Secondly, they greatly underestimate the impact of the declining knowledge of Dutch upon the development of Indonesian law language. Massier argues that the law must be viewed as inextricably bound up with the language in which it is formulated. Consequently, legal training and practice are examined in this study in terms of language behaviour and conventions, of learning, writing and speaking the languages of the law. The voice of the law in transition provides a language history of Indonesian law and its practitioners.

Book excerpt: This historiographic study of K'tut Tantri - alias Vannen Walker, the journalist from the Isle of Man; Muriel Pearson, the unhappy wife; and Surabaya Sue, the notorious revolutionary - compares her romantic and colorful autobiography, Revolt in Paradise, with other versions of her past, including those of her fellow Bali colonists and her revolutionary comrades, as well as her foes, the Dutch, and various intelligence organizations. These alternatives accounts of her past question the image of K'tut Tantri as hero, portraying her instead as dishonest, unstable, egotistical, and immoral. Such criticisms have overshadowed proper recognition of her role in the development of modern Indonesia, both as a bohemian hotelier in between-wars Bali and later as propaganda broadcaster and adviser to Indonesian revolutionary leaders including Soekarno, Sutomo, and Syarifuddin. Focusing on the nature of biography and autobiography, this book analyses K'tut Tantri's self-defeating battle to use history - in text and film script - to define her identity and reappropriate her past. An examination of the use of ideas of "truth" and "fiction" in understanding the past leads to broader consideration of the nature of history and its uses. Finally, an attempt is made to reconcile the deconstruction of K'tut Tantri's autobiography with both an acceptance of the validity of "alternative" historical genres and an acceptance of the problems inherent in writing a history of a living person. Book excerpt: Despite their close geographic and cultural ties, Indonesia and Malaysia have dramatically different Islamic education, with that in Indonesia being relatively decentralized and discursively diverse, while that in Malaysia is centralized and discursively restricted. The book explores the nature of the Islamic education systems in Indonesia and Malaysia and the different approaches taken by these states in managing these systems. The book argues that the post-colonial state in Malaysia has been more successful in centralising its control over Islamic education, and more concerned with promoting a restrictive orthodoxy, compared to the post-colonial state in Indonesia. This is due to three factors: the ideological makeup of the state institutions that oversee Islamic education; patterns of societal Islamisation that have prompted different responses from the states; and control of resources by the central government that influences centre-periphery relations. Informed by the theoretical works of state-in-society relations and historical institutionalism, this book shows that the three aforementioned factors can help a state to minimize influence from the society and exert its dominance, in this case by centralising control over Islamic education. Specifically, they help us understand the markedly different landscapes of Islamic education in Malaysia and Indonesia. It will be of interest to academics in the field of Southeast Asian Studies, Asian Education and Comparative Education.

Commodity booms often prompt more nationalist policy styles in resource-rich countries. Usually, this nationalist push weakens once a boom is over. But in Indonesia, a major global exporter of coal, palm oil, nickel, and other minerals, the intensity of nationalist policy interventions increased after the early twenty-first-century commodity boom came to an end. Equally puzzling, the state applied nationalist policies unevenly across the land and resource sectors. Resource Nationalism in Indonesia explains these trends by examining the economic and political benefits that accrue to domestic business actors when commodity prices soar. Recent years have seen a substantial effort by the Indonesian government to improve the investment climate. To date, much of this effort has focused on the constraints faced by businesses at the national level. However, if Indonesia is to be successful in creating jobs and reducing poverty across the archipelago, this will require improving the investment climate for the 15.7 million micro and small enterprises that employ more than half of all the non-farm workers in the country. This book brings together leading Indonesian and international academics to consider seven key constraints that RNFEs face: labour regulations and practices; infrastructure; competition and marketing; knowledge transfer and technology; access to credit and financial services; local taxation and user charges; and insecurity. In each case the authors draw on the Indonesian Rural Investment Climate Survey, a unique dataset of more than 2,500 RNFEs, to identify the size and nature of the constraints, the way in which they impact upon enterprise growth and the implications for policy. In addition, a key chapter estimates the strength of the linkage between agriculture and non-agricultural activities in rural areas, showing that agricultural revitalization is an essential complement to the development of the non-farm economy. "Understanding the rural investment climate in both slow- and fast-growing economies has taken on new urgency in the wake of the world food crisis. The rural non-farm economy often provides half or more of the income of farm families and is especially important for food-deficit rural households hard-hit by rising food prices. Book excerpt: Based on a decade of research in Indonesia, this book provides an in-depth account of the military's struggle to adapt to the new democratic system after the downfall of Suharto's authoritarian regime in 1998. Unlike other studies of the Indonesian armed forces, which focus exclusively on internal military developments, Mietzner's study emphasizes the importance of conflicts among civilians in determining the extent of military involvement in political affairs. Analysing disputes between Indonesia's main Muslim groups, Mietzner argues that their intense rivalry between 1998 and 2004 allowed the military to extend its engagement in politics and protect its institutional interests. The stabilization of the civilian polity after 2004, in contrast, has led to an increasing marginalization of the armed forces from the power centre. Drawing broader conclusions from these events for Indonesia's ongoing process of democratic consolidation, the book shows that the future role of the armed forces in politics will largely depend on the ability of civilian leaders to maintain functioning democratic institutions and procedures.
