Book Environmental Justice and Land Use Conflict

Download or read book Environmental Justice and Land Use Conflict written by Amanda Kennedy and published by Routledge. This book was released on 2017-07-28 with total page 221 pages. Available in PDF, EPUB and Kindle. Book excerpt: Conflict over the extraction of coal and gas resources has rapidly escalated in communities throughout the world. Using an environmental justice lens, this multidisciplinary book explores cases of land use conflict through the lived experiences of communities grappling with such disputes. Drawing on theories of justice and fairness in environmental decision making, it demonstrates how such land use conflicts concerning resource use can become entrenched social problems, resistant to policy and legal intervention. The author presents three case studies from New South Wales in Australia and Pennsylvania in the US of conflict concerning coal, coal gas and shale gas development. It shows how conflict has escalated in each case, exploring access to justice in land use decision making processes from the perspective of the communities at the heart of these disputes. Weaknesses in contemporary policy and regulatory frameworks, including ineffective opportunities for public participation and a lack of community recognition in land use decision making processes, are explored. The book concludes with an examination of possible procedural and institutional reforms to improve access to environmental justice and better manage cases of land use conflict. Overall, the volume links the philosophies of environmental justice with rich case study findings, offering readers further insight into both the theory and practice of land use decision making.

Book Environmental Principles and the Evolution of Environmental Law

Download or read book Environmental Principles and the Evolution of Environmental Law written by Eloise Scotford and published by Bloomsbury Publishing. This book was released on 2017-02-09 with total page 315 pages. Available in PDF, EPUB and Kindle. Book excerpt: Environmental principles – from the polluter pays and precautionary principles to the principles of integration and sustainability – proliferate in domestic and international legal and policy discourse, reflecting key goals of environmental protection and sustainable development on which there is apparent political consensus. Environmental principles also have a high profile in environmental law, beyond their popularity as policy and political concepts, as ideas that might unify the subject and provide it with conceptual foundations or boost its delivery of environmental outcomes. However, environmental principles are elusive legal concepts. This book deepens the legal understanding of environmental principles in light of recent legal developments. It analyses the increasing legal effects of environmental principles in different jurisdictions and demonstrates how they are shaping and revealing innovative and evolving bodies of environmental law. This analysis is a step forward in understanding a key feature of modern environmental law and presents a robust methodology for dealing with novel legal concepts in the subject. It also makes a contribution to environmental policy debates and discussions internationally that rely heavily on environmental principles, including their supposed legal effects.

Book EU Environmental Principles and Scientific Uncertainty before National Courts

Download or read book EU Environmental Principles and Scientific Uncertainty before National Courts written by Mariolina Eliantonio and published by Bloomsbury Publishing. This book was released on 2023-04-20 with total page 425 pages. Available in PDF, EPUB and Kindle. Book excerpt: This comparative book explores the dynamics driving how courts across Europe and beyond understand and analyse scientific information in nature conservation. The Habitats and the Birds Directives-the core of EU nature conservation law-are usually seen as the most 'uniform' parts of EU environmental law. This book analyses the case law from 11 current and former EU Member States' courts and explores the dynamics of how, and crucially why, their understandings of scientific uncertainty on the one hand, and EU environmental principles on the other, vary. The courts' scope and depth of review, access to scientific knowledge, and scientific literacy all influence such decisions-as does their interpretation of norms and principles. How have the courts evaluated scientific evidence, encompassing its essential uncertainties? This book answers this and many more questions pertinent to EU environmental law, comparative environmental law, administrative law, and STS studies. Co-edited by experienced leaders in the field, and with outstanding contributors, this book is an essential guide to the dynamics of nature conservation law.
