Book excerpt: This book offers a unique overview of the main legal systems of administrative sanctions, with thorough analyses of the administrative law sanctioning systems in 13 Member States and the EU. Especially where deterrent sanctions are involved, the aspects of national and international constitutional law are analyzed, as well as the influences of criminal law approaches in this legal area. After a general analysis of the definitions of sanction, thorough country analyses are presented of Austria, Belgium, Finland, France, Germany, Greece, Italy, the Netherlands, Portugal, Romania, Spain, Sweden, and the UK. The book concludes with an analysis of administrative sanctions in EU law. Book Criminal and Quasi criminal Enforcement Mechanisms in Europe

Download or read book Criminal and Quasi criminal Enforcement Mechanisms in Europe written by Vanessa Franssen and published by Bloomsbury Publishing. This book was released on 2022-02-24 with total page 440 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book looks at the interplay between criminal and other branches of public law pursuing similar objectives (referred to as 'quasi-criminal law'). The need for clarifying the concepts and the interlink between criminal and quasi-criminal enforcement is a topic attracting a lot of discussion and debate both in academia and practice across Europe (and beyond). This volume adds to this debate by bringing to light the substantive and procedural problems stemming from the current parallel or dual use of the different enforcement systems. The collection draws on expertise from academia, practice and policy; its high-quality analysis will appeal to scholars, practitioners and policymakers alike.

Book Environmental Criminal Liability and Enforcement in European and International Law

Download or read book Environmental Criminal Liability and Enforcement in European and International Law written by Ricardo Pereira and published by BRILL. This book was released on 2015-09-29 with total page 389 pages. Available in PDF, EPUB and Kindle. Book excerpt: The drive for harmonisation of environmental criminal standards at both the international and European level emerges from the increasing recognition of the scale and seriousness of environmental crime, the need to strengthen mechanisms of police and judicial interstate cooperation to combat cross-border crime, and the objective to ensure fair competition in a global economy and an integrated EU common market. The harmonisation of environmental criminal law requires a competent institutional framework able to convey the need for criminalisation of environmental harm while not overriding national aspirations to sovereignty in criminal matters. The book Environmental Criminal Liability and Enforcement in European and International Law assesses legal, theoretical and practical questions of harmonisation of national environmental criminal law and the mechanisms for cooperation by sovereign states under European and International Law, with a particular emphasis on legislative developments in the European Union, the Council of Europe and other international institutions, assessing the case for an extension of the jurisdiction of the International Criminal Court over international environmental crimes.

Book Policy Intervention Analysis

Download or read book Policy Intervention Analysis written by Ritu Paliwal and published by The Energy and Resources Institute (TERI). This book was released on 2014-01-03 with total page 230 pages. Available in PDF, EPUB and Kindle. Book excerpt: Environmental Impact Assessment (EIA) is crucial for protecting the environment, especially in a country like India--with its dense and rapidly growing population, shrinking land mass, and an economy poised for rapid growth. In order to make EIA an interactive process, it is necessary that it is supported by a strong follow-up mechanism. A properly formulated follow-up process would not only encourage compliance but also increase awareness among the stakeholders. Policy Intervention Analysis: environmental impact assessment evaluates the adequacy of post project monitoring (PPM) process in India and its effective implementation with a focus on the industrial sector. The book investigates the reasons for poor compliance and gives corrective measures for corrective PPM. It identifies specific measures to improve environmental conditions and provides an action plan that will help strengthen the monitoring and enforcement mechanism based on specific regional concerns.
