Download or read book Intellectual Property Rights and Competition in Standard Setting written by Valerio Torti and published by Routledge. This book was released on 2015-10-05 with total page 277 pages. Available in PDF, EPUB and Kindle. Book excerpt: Competition and intellectual property rights (IPRs) are both necessary for a market to work efficiently and to promote consumer welfare. Properly applied, intellectual property rules define a legal framework which allows undertakings to profit from their inventions. This in turn encourages competition among firms and enhances dynamic efficiency, to the benefit of consumer welfare. Standard setting represents one of the fields where the interaction between competition law and IPRs clearly comes to light. The collaborative goal of standard setting organizations (SSOs) is to adopt and promote standards that either do not conflict with anyone’s right or, if they do, are developed under condition that patents are licensed under defined terms. This book examines the tension between IPRs and competition in the standard setting field which can arise when innovators over-exploit the rights they have been granted and hold up an entire industry. The book compares EU and U.S. jurisdictions with a particular focus on the IT and telecommunication sectors. It scrutinizes those practices which could harm standard setting and its goals, looking at misleading conducts by SSOs’ members which may lead to breach the EU and U.S. antitrust provisions on abuse of market power. Recent developments in EU and U.S. standard setting are analysed highlighting the differences in enforcement approaches. The book considers how the optimal balance between IPRs and industry standards can be struck, suggesting a policy model which takes into account both innovators’ interests and SSOs’ goals.
Download or read book Property Based Testing with PropEr Erlang and Elixir written by Fred Hebert and published by Pragmatic Bookshelf. This book was released on 2019-01-17 with total page 466 pages. Available in PDF, EPUB and Kindle. Book excerpt: Property-based testing helps you create better, more solid tests with little code. By using the PropEr framework in both Erlang and Elixir, this book teaches you how to automatically generate test cases, test stateful programs, and change how you design your software for more principled and reliable approaches. You will be able to better explore the problem space, validate the assumptions you make when coming up with program behavior, and expose unexpected weaknesses in your design. PropEr will even show you how to reproduce the bugs it found. With this book, you will be writing efficient property-based tests in no time. Most tests only demonstrate that the code behaves how the developer expected it to behave, and therefore carry the same blind spots as their authors when special conditions or edge cases show up. Learn how to see things differently with property tests written in PropEr. Start with the basics of property tests, such as writing stateless properties, and using the default generators to generate test cases automatically. More importantly, learn how to think in properties. Improve your properties, write custom data generators, and discover what your code can or cannot do. Learn when to use property tests and when to stick with example tests with real-world sample projects. Explore various testing approaches to find the one that's best for your code. Shrink failing test cases to their simpler expression to highlight exactly what breaks in your code, and generate highly relevant data through targeted properties. Uncover the trickiest bugs you can think of with nearly no code at all with two special types of properties based on state transitions and finite state machines. Write Erlang and Elixir properties that generate the most effective tests you'll see, whether they are unit tests or complex integration and system tests. What You Need Basic knowledge of Erlang, optionally ElixirFor Erlang tests: Erlang/OTP >= 20.0, with Rebar >= 3.4.0For Elixir tests: Erlang/OTP >= 20.0, Elixir >= 1.5.0

Rabin, Kwall, Kwall, and Arnold's Fundamentals of Modern Property Law tracks contemporary trends in property law with particular attention to emerging issues of environmental sustainability. The problem-based structure of the casebook comports with the student learning outcomes and assessment approach emphasized in recent years by the American Bar Association and the Carnegie Endowment Report. This edition provides a comprehensive introduction to intellectual property law. The novel legal problems raised by advances in technology demand that students receive early exposure to this area of law. This edition also emphasizes a planning perspective since lawyers spend a significant amount of time planning, as well as resolving controversies.

Download or read book Colored Property written by David M. P. Freund and published by University of Chicago Press. This book was released on 2010-04-13 with total page 528 pages. Available in PDF, EPUB and Kindle. Book excerpt: Northern whites in the post–World War II era began to support the principle of civil rights, so why did many of them continue to oppose racial integration in their communities? Challenging conventional wisdom about the growth, prosperity, and racial exclusivity of American suburbs, David M. P. Freund argues that previous attempts to answer this question have overlooked a change in the racial thinking of whites and the role of suburban politics in effecting this change. In Colored Property, he shows how federal intervention spurred a dramatic shift in the language and logic of residential exclusion—away from invocations of a mythical racial hierarchy and toward talk of markets, property, and citizenship. Freund begins his exploration by tracing the emergence of a powerful public-private alliance that facilitated postwar suburban growth across the nation with federal programs that significantly favored whites. Then, showing how this national story played out in metropolitan Detroit, he visits zoning board and city council meetings, details the efforts of neighborhood “property improvement” associations, and reconstructs battles over race and housing to demonstrate how whites learned to view discrimination not as an act of racism but as a legitimate response to the needs of the market. Illuminating government’s powerful yet still-hidden role in the segregation of U.S. cities, Colored Property presents a dramatic new vision of metropolitan growth, segregation, and white identity in modern America.

Download or read book Strata Title Property Rights written by Cathy Sherry and published by Routledge. This book was released on 2016-12-19 with total page 286 pages. Available in PDF, EPUB and Kindle. Book excerpt: Multi-owned properties make up an ever-increasing proportion of commercial, tourist and residential development, in both urban and rural landscapes around the world. This book critically analyses the legal, social and economic complexities of strata or community title schemes. At a time when countries such as Australia and the United States turn ever larger areas into strata title/condominiums and community title/homeowner associations, this book shows how governments, the judiciary and citizens need to better understand the ramifications of these private communities. Whilst most strata title analysis has been technical, focusing on specific sections of legislation, this book provides higher level analysis, discussing the wider economic, social and political implications of Australia’s strata and community title law. In particular, the book argues that private by-laws, however desirable to initial parties, are often economically inefficient and socially regressive when enforced against an ever-changing group of owners. The book will be of particular interest to scholars and legal practitioners of property law in Australia, but as the Australian strata title model has formed the basis for legislation in many countries, the book draws out lessons and analysis that will be of use to those studying privately-owned communities across the world.
