This book was released on 2017-12-19 with total page 56 pages. Available in PDF, EPUB and Kindle. Book excerpt: IRS estimates that, in 2014, it prevented or recovered $22.5 billion in attempted IDT refund fraud, but paid $3.1 billion in fraudulent IDT refunds. Because of the difficulties in knowing the amount of undetected fraud, the actual amount could differ from these point estimates. IDT refund fraud occurs when a refund-seeking fraudster obtains an individual's identifying information and uses it to file a fraudulent tax return. Despite IRS's efforts to identify and prevent IDT refund fraud, this crime is an evolving and costly problem. GAO was asked to examine IRS's efforts to combat IDT refund fraud. This report (1) evaluates the performance of IRS's TPP and (2) assesses IRS's efforts to improve its estimates of IDT refund fraud costs for 2014. GAO recommends that IRS update its TPP risk assessment and take appropriate actions to mitigate risks identified in the assessment. GAO also recommends that IRS improve its IDT cost estimates by removing refund thresholds and using return-level data where available.

Book excerpt: IRS estimated it prevented $24.2 billion in fraudulent identity theft (IDT) refunds in 2013, but paid $5.8 billion later determined to be fraud. Because of the difficulties in knowing the amount of undetected fraud, the actual amount could differ from these point estimates. IDT refund fraud occurs when an identity thief uses a legitimate taxpayer's identifying information to file a fraudulent tax return and claims a refund. GAO was asked to review IRS's efforts to combat IDT refund fraud. This report, the second in a series, assesses (1) the quality of IRS's IDT refund fraud cost estimates, and (2) IRS's progress in developing processes to enhance taxpayer authentication. GAO compared IRS's IDT estimate methodology to GAO Cost Guide best practices (fraud is a cost to taxpayers). To assess IRS's progress enhancing authentication, GAO reviewed IRS documentation and interviewed IRS officials, other government officials, and associations representing software companies, return preparers, and financial institutions.

Book excerpt: The growing problem of fraudulent tax returns being submitted based on stolen identities is a “tsunami of fraud,” and victims, lawmakers, and law enforcement are struggling with how to deal with the fallout. The issues surrounding identity theft-based tax fraud are complex. Current IRS efforts to stem the tide involve pouring resources into assisting victims, updating IRS processes to detect and prevent refund fraud, and increasing the number of criminal investigations and prosecutions it pursues. The IRS's approach and pending proposed legislation are not enough to address the problems created by identity theft-based tax fraud. This article argues the IRS and Congress must use a holistic approach to attack this specie of tax fraud. To that end, this article supports enhanced criminal penalties and proposes new civil tax penalties aimed specifically at identity theft tax fraud. This article pursues two goals. First, it documents and explains the problem of identity theft-based refund fraud, highlighting particular issues with respect to tax compliance. In so doing it analyzes existing civil and criminal tax penalties to punish and deter identity thieves, an analysis which reveals that existing criminal penalties are insufficient and that there is no directly applicable existing civil penalty. Second, to address the gaps in existing law, the article proposes standards for Congress to use in crafting a comprehensive penalty scheme to apply to identity theft-based refund fraud. This article proceeds in three parts. Part I addresses the nature and scope of identity theft tax fraud, explaining the consequences such fraud has on tax administration, fair enforcement, and public confidence in voluntary compliance, which is the bedrock of our tax system. Part II explores the inadequacy of existing criminal and civil penalties. Part III then proposes legislative action, evaluates proposed and pending legislation, and makes specific recommendations for enhanced criminal penalties and the creation of a new civil penalty aimed specifically at identity theft-based tax fraud.

Book Undocumented Workers Tax Evasion and Document Fraud

Download or read book Undocumented Workers Tax Evasion and Document Fraud written by Tom Ealey and published by . This book was released on 2014 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: As immigration reform politics heats up, there are regular reminders that aliens in an "amnesty" plan would have to pay federal taxes previously ignored or evaded. Based on extensive research the author finds this back taxes plan likely to be more symbolic than practical, and sees little possibility for any extensive filing or delinquent federal income tax returns or payment of the taxes. This paper focuses on a prosecution which highlights the scope of the problem and the difficulties of crafting any remedy to the wide spread evasion of federal income taxes, identity theft, and document forgery.
