Book excerpt: Excerpt from The Spirit of the Common Law HE dartmouth alumni lectureships have been established upon the theory that the influence of the intellectual life of the Col lege ought to be available, in some degree at least, to others than those who are in residence as students, - as for example, to graduates who are solicitous for some contact with the College which will help to maintain the breadth of their scholarship; or to friends who are interested in the kinds of intellectual interest for which the College wishes to stand. The suggestion of the particular form which the project of these lectureships has taken was made in my inaugural address in 1916 when statement was made as follows. Book The Spirit of the Common Law

Download or read book The Spirit of the Common Law written by Roscoe Pound and published by Routledge. This book was released on 2018-04-24 with total page 222 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Spirit of the Common Law is one of Roscoe Pound's most notable works. It contains the brilliant lectures he delivered at Dartmouth College in the summer of 1921. It is a seminal book embodying the spiritual essence of sociological jurisprudence by its leading prophet. This work is both a celebration of the common law and a warning for common law judges and lawyers to return to and embrace the pragmatism and judicial empiricism that define and energize the common law. The two fundamental doctrines of the common law, Pound writes, are the doctrine of precedents and the doctrine of supremacy of law.In an earlier preface, Justice Arthur J. Goldberg writes that The Spirit of the Common Law will always be treasured by judges and lawyers for its philosophy and history, but more importantly for Roscoe Pound's optimism and faith in the capacity of law to keep up with the times without sacrificing fundamental values. It is a faith built upon the conviction that the present is not to be divorced from the past, but rather that the past and the present are to be built upon to make a better future. Neil Hamilton and Mathias Alfred Jaren provide a biographical introduction to the book. They discuss the various influences upon Pound's scholarly pursuits and they analyze many of his writings that led up to The Spirit of the Common Law. This volume is a necessary addition to the libraries of legal scholars and professionals, sociologists, and philosophers.

Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Genius of the Common Law The purpose of the Carpentier Lectures is not to furnish text-books for ordinary professional use, and I have there fore not thought it proper to cite authorities except for a few historical illustrations too lately published to be familiar, or otherwise off the usual lines. Once or twice I have named a leading case for the convenience of learned readers. I do not think I have positively stated anything as law which will not be well known to any such reader, and easily verified if desired; and the same remark applies to the historical data. Book excerpt: Excerpt from A Rubric of the Common Law, Being a Short Digest of the Common Law The general principles of common law are on the whole simple and clear; and it is the mass of cases reported, a large proportion of which turn upon their own peculiar facts, to which facts the general principles have to be applied, that makes each branch of law appear so formidable to the beginner. When once the general principles are firmly planted in the head, the student will follow the cases, which are corollaries or exceptions to those principles, and appreciate the decisions of the judges therein, with facility and profit but until these general principles are clearly laid hold of, he is overwhelmed with what appears to him a. Book excerpt: Excerpt from Readings on the History and System of the Common Law Grateful acknowledgment is made to the authors and publishers who have generously permitted the use of extracts from modern books. Every one who has to do with either the history or the system of our law is under a debt to Professor Wigmore. Beyond this, however, I am indebted to him for several important suggestions. My colleague, Professor Joseph Warren, and Professor H. W. Humble, of the University of Kansas, have also assisted by valuable criticisms. Download or read book The Expansion of the Common Law Classic Reprint written by Sir Frederick Pollock and published by Forgotten Books. This book was released on 2017-12 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Expansion of the Common Law The lectures from which this volume is named were delivered to the Law Schools of several American Universities last autumn. A few additions have been made to the original text. The address given at the request of the Harvard Law School Association for its commemoration of 1895 was not intended at the time to have any sequel, but is now prefixed to the course of 1903 as being sufficiently germane to the matter to serve as a general introduction. Familiar matters of both fact and law were necessarily taken for granted in delivering the lectures; and it does not now seem desirable to vouch authorities at large for them. References have been given only where it is thought that they may be really useful for verification or farther search.
